U.S. military investigates alleged shooting of Iraqi prisoner

BAGHDAD - American military officials are investigating an alleged war crime, after the apparent killing of an unarmed Iraqi prisoner by a U.S. marine was caught on videotape.

In a release issued Tuesday, the U.S. military said it was investigating an allegation of the unlawful use of force in the death of an enemy combatant in Fallujah.

The television reporter who filmed the incident, NBC pool correspondent Kevin Sites, says he was with marines as they entered a mosque in Fallujah on Saturday where five wounded men were being held from fighting a day earlier.

In the video, a marine from the 3rd Battalion, 1st Regiment enters the mosque, says Sites. A soldier can be heard saying one of the prisoners is pretending to be dead.

The video then shows a marine firing his gun at the man's head, Sites says.

The marine has been removed from the battlefield during the investigation.

As the battle in Fallujah entered its second week on Monday, U.S. troops said they have secured full control over the city, with more than 1,000 insurgents killed and another 1,000 taken prisoner.

The U.S. marine general who is in command of the operation to take Fallujah says those insurgents still inside the city are the rebel hard core and will be killed.

U.S. warplanes were used on Monday, to strike at some of the pockets of resistance that remain.

Iraqi Interior Minister Falah Hassan al-Naqib has declared victory claiming, "Fallujah is no more a safe haven for the terrorists and killers. This thing is over."

The U.S. says 38 American troops and six Iraqi soldiers were killed in the operation and 275 were injured. It also says it estimates more than 1,200 insurgents were killed, but has not given any estimate of civilian casualties.

Since the U.S. offensive was launched a week ago, insurgent activity has surged across Iraq's Sunni Muslim region. At least 27 people were killed in fierce battles between militants and U.S.-led forces on Monday.

The clashes occurred in Baqouba and south of Baghdad in what is the heartland of Sunni Muslims in Iraq.

There have also been five days of violence in Mosul. Rebels set fire to oil wells and a pumping station in the north of the country.

Elsewhere, Prime Minister Ayad Allawi's office confirmed that two of his relatives who were kidnapped last week have been released. There is no word about a third relative who was also abducted.

fuck the soldiers - especially if they can't stick to the rules and obligations of their jobs. That being said it is obvious this stuff goes on day in day out - that's what war is: murder, rape, killing, looting and occupying.

insurgents = freedom fighters

what would you do if a mighty foreign power invaded your land, your town and tried to take your culture away, not hesitating to bomb your holy places and kill your families?

I doubt anyone would just sit their and cowtow...

They may be insurgents to the mighty GWB and co; however they are noble and strong fighters for their home to the townsfolk of their communities.

insurgents is a nice word, but it's a bullshit word.

Change only happens when people want it and feel they can take it, you can't force it - that's why the Berlin wall came down and the Soviet Union fell. Not a bomb was needed, not a single insurgent rose up.

AHAHAHA! The term "war crimes" makes me laugh everytime. Its war, how can their be a crime? I know, Treaty this, and treaty that... its fuckin war. A piece of paper that says "dont do this" and "dont do that" doesnt mean anything when you are at war.

Murdering an unarmed man is a crime.

That man should be handed over to the Iraqi authorities for trial and execution.

That's it isn't it - we all know that the reality of war on the ground is lawless and it seems strange to expect anything but that.

However if one has signed oneself up to a code of honour upon entering this realm of war - one must then live up to that.

The US military sets its own standards by signing up to such codes of honour (via government) and naming certain criteria of killing, raping, torture and looting as'crimes'.

Therefore the military must live by this code - to claim honour and forthright conduct is always upheld, and to make it a legal requirement; then to go below this code is lowly and dispicable.

Legally binding is unfortunately - legally binding

That means soldiers somehow must refrain from 'crime' no matter the circumstances - comes with the glorious job I guess.

I agree. Though I understand how such a thing could easily happen, to any soldier on any side during any war... anybody that has been through basic training or in combat will understand as well. I am not making light of what happened, or excuse the soldier from responsibility for what happened.

What I find really odd is the double standard. It is fine for the 'freedom fighters' to kidnap innocent civilians that are trying to feed the hungry, and chop off their heads in an act of premeditated, cold-blooded, murder... but when a soldier looses his mind in the heat of the moment during battle, he is immediately judged to be the worst thing since Hitler.

It is so easy for us to sit in our nice comfy chairs, safe in our warm homes, and judge these soldiers from afar feeling good about ourselves and our freedom at the expense of those we are judging. War is awful; it turns good people into bad people, at least for a while. If we want to judge somebody, we need to judge those that started this war, not those that are fighting it... let those that are fighting the war judge each other.

You know whats funny though?  John Kerry attested to similiar, actually worse war crimes (ie. shooting an unarmed Vietnamese boy in the back), when in Vietnam, and he was praised as a hero by the media.

Why the astounding bash of the American military all of a sudden by the media?  John Kerry did it and he was a hero.

the ppl that started the war have already been judged favourably by an electoral majority...and to argue against them would not only be pointless..but could also be construed as a slap-in-the-face to american workers.. both those who have laboured for 3 generations to build the war machine.. and those who have busted their asses for decades..just so that they could drive a hummer...

What the soldier did is murder - plain and simple. The insurgent was unarmed, wounded, and poised no threat to the soldiers because of these factors; the insurgent was held captive and badly wounded. The situation required no killing, only patience for him to be removed and treated by the Iraqi authorities (for the sake of trial, intelligence, and possible execution).

The soldier committed the killing out of emotion not reason. In any court of law, this is considered second degree murder or voluntary manslaughter. I hope the solder is charged and sentenced time.

Whether or not the insurgents have committed similiar or worse crimes is irrevelent, that is if we value and wish to protect law and order (the very backbone of civil society).
