Following their first successful conviction in June, San Mateo County prosecutors have filed three other cases, after about a dozen motorists had been pulled over in recent years, said San Mateo Deputy District Attorney Chris Feasel on Monday.


Kava, while not considered as a drug by federal health officials, is classified by the U.S. Food and Drug Administration (news - web sites) as a nutritional supplement that can be used to relieve anxiety.


Motorists under the influence of Kava had a "thousand-yard stare", Feasel said. "They're drooling on themselves sometimes, their motor function is so bad," he added.


He said that police had pulled over kava-addled motorists who were swerving, veering into other lanes and drifting onto the road's shoulder.


"Kava basically has the opposite effect of alcohol," Feasel said. "Kava affects your motor skills before it affects your mental abilities."


The June conviction is believed to be only the second successful one in the country, following a 1996 case in Utah.


In the pending cases, motorists have admitted to drinking between 10 to 20 bowls of the bitter tea, which comes from the kava root, a member of the black pepper family.


"We're cracking down on DUI drivers," Feasel said. "Whether it's driving under the influence of kava, or a good merlot or Advil, you're going to be prosecuted."

DUI doesn't mean it has to be alchohol related. As far as I'm concerned if you're driving on anything but sober then you're asking for trouble.

Yeah, I agreed mostly with what they were saying until the Advil part. Makes his creditablity of persuing DUIs for kava go down the drain. I honestly feel as though if they want to make driving under the influence of kava a DUI, they should let the past incidents go as warnings and THEN include kava as DUI, not retroactively. How the hell do they prove someone is under the influence of kava anyway?

That stuff is pretty crazy. My friend owns his own Fujian' Import Store and they have TONS of Kava.

Why would anyone try to drive on that shit -- okay a stupid question, but man, that stuff is strong and make you feel pretty crazy.

I would crash a car if I tried to drive on Kava, I know, I would die or kill someone else, so I don't have to worry about DUIs at all.

wow man, never affected me like that at all. and i've used quality kava.

anyway, about the article. i really wonder how they know he was on kava. he must of said he had only drank kava or something thinking that wouldn't get him in any trouble. i dunno.. the advil comment though.. that's rediculous..

yeah, this is definitely the piggies ego's at work here. how lame.

it just makes me think back to the time i watched this shit on tv about what was worse: drunks, or sleep deprived drivers.

im not sure how many hours they were deprived, well over 24. but both fucked up equally bad on the lil course they drove. Both's reaction times were slow. not sure how drunk the drivers that drank were either.

but reading how the kava influenced motorists are driving, sounds a whole lot like someone coming home from a long day/nights work at the office(or anywhere). Are we going to start prosecuting the tired people now too? how ridiculous. sleepy motorists are just as bad as drunks. its been proven.

If being tired results in an accident, the charges are usually increased. This is because one is expected to be responsible and STOP DRIVING if tired.

I think you guys are looking too deeply into the advil thing. He was probably speaking with a bit of generality...meaning... They don't care what caused the intoxication...be it even a sugar high..... If you're driving intoxicated, you're going to jail.

I'm sure he was being sarcastic, but it really takes away from his creditability considering he's trying to prosecute people for something that doesn't quite have a precedence yet. Some people might consider a DUI for driving while using kava to be excessive, so saying that driving under the influence of Advil only makes it sound even more excessive. In other words, I think people take someone who says something like that much less seriously.

(it also reeks of self-righteousness and using power in a self-gratifying way rather then actually caring about preventing accidents. A lot of people feed off the ability to say things like that)

I agree with mycoguy.

I always thought that it was general knowlege that driving under the influence of any substance which could possibly impair your motor skills or reaction time is against the law.

I take the statement as it was meant to be taken. If you are driving while intoxicated on anything, you are breaking the law.(not that I care so much about breaking the law, but rather you are endangering lives)
