hey I got busted today at school with about 3 grams od dried mushrooms in my bag. What kinda legal trouble am I in, I live in colorado and have no prior record.

he sure did. there was a report of some people smokin dope. He saw the 3 of us walking back into school and pullled us into his office searched out bags and bam. How about unlawfull dearch and seiazure will that work because he said he knew we weren't smokin pot. I need ideas and some info on anything.

What the principle did to you was illegal if somebody wants to search you they need a search warrant as with if they want to enter your home.

I think when you are enrolled in any public school you give your rights away when you enter the building i think. They can search you when ever they want. A couple of my friends have got busted at school because of this. I don't think it was too good of a idea for you to have shrooms in your bag at school. Personally i would have ran .

well i'm not sure on this one. did you ever give consent to the search? if you did you are screwed. But if you didn't I think you may have some leverage here. I believe the laws allow for searchs to be done by school faculty members with reasonable cause though I'm not sure on that one though. I can't remember if this pertained to lockers or students bags. Plus the laws may have changed since I've been out of high school. You need to either get a lawyer or look up the laws for yourself. i hope you can fight this one off but you should be more careful. School is the last place you want to be carrying drugs. Many people I knew who got busted during High school got busted the exact same way you did. Leave your shit at home, you can go without it for 6 hours. or at the very least leave it in your car in the parking lot. good luck.

I just wanted to clear up the illegal search and seizure issue. The constitution prevents people from being illegally searched by agents of the government. The supreme court has ruled that administrators and teachers can search students because they are not police officers, and the safety of the school outweighs the personal seizure rights of the individual. Suck as it may, this is the time in which we live.

I don't actually live in America, and don't know the laws and attidudes over there so much; you might want to take my advice with a grain of salt.
I wouldn't be too worried if I where you. They're only mushrooms! You could always claim that you picked them not knowing they where psycadelic. Say to the principal, ' Thanks a lot for saving me from that! '. Just say you picked them on your way to school one day and they dried out in your bag because you forgot to take them out.
I don't know if that's really stupid or not - If I did that when I was in High School and used that excuse, I'd get away with a slap on the wrist, and that's if they where recognized to be psychedelic at all. Mushrooms are not exactly mainstream (over here at least) so the authorities don't usually know what they are - and if they suspect they just don't care.

I dont know about that man, at my school they started bringing dogs in and you could say know even if they were going off on your bag. If you said no, they had to get a warrant to search your stuff.
On another note though I have been pulled over and had my car searched twice without consent, one time they asked me and I said no (but they still searched eventually), the other time they just started going through the car even after I made it clear I gave no consent. Cool cops are rare, most judge you right off and will break laws themselves in order to bust yo ass.

my friend tried to eat a bag of coke when the pigs came to get him then they made him throw it up and charged him with trying to destroy evidence.i dont think you'll get into law trouble if they didnt report it right away to the police.at my school you woulda been in handcuffs the second they found it.my school sucks there is a $200-300 reward for people reporting drugs.plus we have a cop on campus at all times so the refusal to search thing doesnt work cause they just go get the cop and he has probobal cause to search.

My dad is a superintendant of schools and deals with this all the time. Basically, if a teacher doesn't like the color of your shoes they can have you searched with out a reason. Just today my crew got narced on for fucking up the bathroom. They called my best friend in and patted him down, searched his shit and everything. He wasn't even the one who fucked it up, and they didn't find any physicall evidence, but if the school gets hit up again they are going to expell him.

1 thing you should always do in these cases (this also means cops at your door) is when you are asked to do something, ask them back "are you ordering me to or asking me to"? this eliminates grey area and you may refuse where you are only asked to do something. if its an order get out of the way.

this is very good advice. Always ask this if you are not sure. Even if you are sure ask anyway, it keeps the cops on there toes, they are used to most people bowing down to them and doing what ever they say.
