Libertarians, Land Ownership and Sucession...
    #3197326 - 09/29/04 08:00 PM (19 years, 5 months ago)

It seems to me that a number of libertarians believe that the government has no ownership rights over private property. This means that the individual who owns the property has sole rights over it. Now, lets say that I owned 1,500 acres in Montana and I decided to surrender my land to the Iranians. Would this be allowed? Could I have Palsteine setting up terror training camps? If the government doesn't own it, as they claim when the gov't uses imminent domain, then would the government have a say in what happened to it?

Land ownership doesn't mean you get to make your own laws, so a terrorist training camp would definitely not be allowed. You could sell your land to Iranians, as long as they obeyed US and state laws(which presumably would mean they'd have to get a Green Card). However, the government cannot rightfully confiscate your land whenever it feels like it.

If it's "my land", why is it part of America? If I want "my land", that isn't the Governments, to be part of Iran, why can't it be?

Why can you not understand the difference between property and jurisdiction?

Because it's "My" land. If you'd like me to search all the times you've said "private property" and how it doesn't belong to the government, I'd be happy to do so. If it is my land that the government can't do anything with, even for the "Greater good", then why wouldn't I be allowed to secede from the country? Why couldn't I just make it part of Iran? Or saudi Arabia? I'm about to call the leaders of SA and see if they want to buy my land. I live about an hour from our nations capitol, maybe Hamas could buy it from me, and it would be their own soverign nation.

Well, I suppose that theoretically, you could secede. However, good luck getting any power or plumbing to your house if you do that.

Why would I have to secede? Isn't a secession just "seperation from the governing body"? Wouldn't a libertarian 'America' just consist of a number of seceded bodies, owned by individuals?

I suppose that the point I'm trying to make is that the government is made up of a federation of citizenry. By being part of the citizerny, which isn't an option if you live in the borders of the country, you are assured certain rights and you are being assigned certain responsibilities, such as paying taxes. We don't have the right to secede, or the right to "surrender" our soverignity of the land to another country.  Maybe it's right to say that the individual owns the property, but the government has soverignity over the land. You are the sole owner of that property, but it is still part of the 'nation', and you don't have total executive rights. If you want to construct something there or mainpulate the land, thats OK, but the fact that you cannot secede indicates that their is a "larger ownership" of the land. or so i see it ...
