Going to be gone for 2 weeks

I am going to be gone for 2 weeks and I am leaving in the morning...

the question is, I have a fully colonized BRF cake of cambodian that needs to be birthed/cased etc... and since i will be gone and not able to tend it, what do you all think will be the best method that I could do for it to maintain itself enough so that all my dad has to do is harvest when needed?

he has no experience with growing so it need to be easy enough for him to just have to pick them...

I was thinking about this method, only using the cake for more than one cup...

thanks for the tip, but I wanted to have some for when I got back, that way I wouldn't have to wait more when I got back...

But if this is the best thing, i will probably do that...

Just leave it in the jar, or case it then leave it in the fridge while I am gone?

Well if you already have a hydrapod then why are you asking?  Those are pretty self-maintaining.  And a PMP is just a way to build something yourself which does most of the same stuff a hydrapod does.  You just can't build a PMP and then sell it for any profit as that would violate the hydrapods patent. :smile:

yeah, the hydrapod has the air vent at the top that changes the air flow during the stages of the cycle, and not quite sure what % of open to leave it at while I am gone....

I don't think their patent is valid... Do you have a link to it?

People have been using the same techniques long before them. I don't think their design is either "novel" or "non-obvious" making their patent worthless. Besides they would actually have to prosecute you and win to stop you from selling something similar. Any design changes would also avoid infringing their patent. I would put the vent hole near the bottom and call it a "CO2 drainage hole" that alone should save you from any legal trouble.

I'm not a patent lawyer, but it doesn't look very inforcable to me. They provide an incomplete description of the prior art and the only novel or non-obvious part of the invention is the shape of the chamber.

The patent was filed July 30, 2002... I was using an almost identical setup, except for the shape of the chamber, long before then.

I think I might just have to start selling a similar system of the type I used prior to their patent! It would sure cost a hell of a lot less than $170!

Maybe I'll call it the "hydropod" instead of "hydrapod".

if you try and sell it, especialy with a similar name, you will be sued
jusst as several others have... talk to a patent lawyer and you will hear
the same from them.... people have tried other shapes and met his lawyers

I think it's much more likely that they have simply scared off people with the threats of legal action, rather than actually having a defendable patent.

I would be very interested if you could provide any further information about previous legal actions. The exact design of the "hydrapod" seems new, but other than that there is absolutely nothing new in their patent.

Another big hole in their boat is the fact that they didn't provide any prior art relating to PC cultivation. There was a lot of that floating around the internet which described very similar systems. The mere fact that they didn't include any of it invalidates their patent unless they can honestly claim that they were unaware of it.

They mention in the patent that growers commonly used terariums prior to their "invention". Porus stone (perlite) was also in use. So what exactly are they claiming that they invented? A hole in the bottom and top? Using an air stone?

Both are obvious solutions to well known problems and, as such, they are unpatentable. Maybe they can litigate you into the ground, but I think any two-bit lawyer could beat that patent with their hands tied behind their back.

Well, I would actually have no basis for a suit since I didn't invent my setup and you can't sue based on prior use.

The common method is to simply start making a product and then destroy the credibility of their patent if they sued you. Patents are issued and then proved unenforceable all the time.

How long has the hydrapod been around? I thought I heard about it long before 2002. If they sold it before 2001 the patent is invalid right off the bat.

the text you read on the link provided does no include the working model as well as the full detail of the plans, it's simply an overview, the patent proscess is actualy quite involved, as they are the holder of the patent, I'm sure a judge would uphold any ruling in their favor if it appears that the device in question does indeed violate the patent

as for witness', thats a great step away from documentation and a patent application

Actually I did look at the full patent. All that's missing from the text that the link link goes to are the images. Just click on the "images" icon at the bottom of the screen. You will have to install a TIFF viewer to actually see them. It's a pain, but well worth it to get access to the entire patent database.

I use the freeware one that they mention in the help section. I think it's called "AlternaTIFF". It works just fine.

Patent law is a strange subject with a lot of strange rules. There are a lot of requirements about what can and can't be patented. By not including all the prior art they made the application look a lot better than it really is.

Can you tell me a little bit about the current costs of becomming a sponsor? I read it was around $200/month.

I'm thinking about starting to grow oysters for the local markets, so I might be getting a business license here pretty soon.

Of course, it would be civil court so they would only have to prove my witnesses are lying by the preponderance of the evidence. I don't see how they could do this though because I'm sure that there are literaly thousands of people who used a similar system prior to their patent.

Also of note, if you already have Quicktime plugin installed, it will handle the TIFF viewing with no other plugin required.

the burden of proof would fall upon you, you wuld have to provede documentation that would prove that your design predates his patent. Witnesses are runreliable and in many cases are willing to commit purgery, in copyright/patent/trademark law there is seldom ever a witness, generaly those only come into play in regards to whether one party had contact or access to the other and the information used to obtain the patent... again, consult with a patent lawyer.
