was sitting here thinking that the current sentence we have is a conglomeration of judicial and legislative branches creating sentencing laws and sentences. I am not 100% knowledgable about the current system but it would seem to me that one branch or the other should have this direct power due to the fact that it would add simplification to the checks and balances we currently have in place. What are your thoughts? Can anyone clarify how the current system is set up on creating sentencing laws and do you think that one branch should have this power and why?
I have occasionally heard President Bush refer to "activist judges" attempting to write law. I am not trying to discuss the gay marriage debate in the least but to debate which branch should have more influence on sentencing power.
