Fire blew the whistle
    #3103364 - 09/07/04 01:23 PM (19 years, 8 months ago)

Well yesterday my apt caught fire.I do not grow hardley anything anymore,i just had 3 invitro penis envy jars.I had them in the dropped ceiling hidden above the tiles. No one will ever find them there, besides i dont really do anything to give he police a reason to look.So away they stayed hidden.Well im standing outside with the other people who live in the building when a detective come up to me .He says they found mushrooms in my ceiling because they tore down panels to see if the fire had spread.I just about died.My life flashed before my eyes. Not only the 3 pretty mature jars, but a 4th with about 12 grams of dried shrooms bagged up.Also they had found about 3 grams of pot broken up in my stash box.I was in a state of shock as they took me to the station.
Well after about 4 hours of me playing very very dumb, one cop said that since i was honest they would just give me an appearance ticket.I thought to myself, well maybe not jail today but im in serous trouble down the road.
Anyway he wrote out the ticket and handed it to me and all it was for was ready for this?: unlawful possesion of a controlled substance in the 7th degree!!!!!!!he then told me that as long as i showed up for court it was probably just a $150-$200 fine,a class d misdemeanor, and how he could have very easily charged me with a bigtime felony, but that he could tell i was just experimenting because i was cureous and that he was gonna give me a break.then he took me back to my apt and dropped me off at my by nowdisaster of an apt.So i didnt go to jail(which is GREAT!),but i lost alot of stuff to the fire/water damage, which sucks.
My point of this story besides expressing my relief at the fact of my trremendoius luck is that whether you think your safe or not,you never know the roadblocks life might throw at you.I never thought in a million years that fireman would find them in my ceiling.
So be carefull and dont get stupid.
BTW as a sidenote, wait till you hear this, they were so excited about the shrooms that they left my stashbox and all the weeed broken up inside!!!!!I also had a jar of bluehoney with about 20 grams dry in it in my fridge wghich they never saw, however i threw that out.You better believe i smoked a fatty as soon as it was safe!

You said you "played dumb"  how dumb did you play it

I mean, you could go as far as saying "I never knew those things were in the celling?  They're probably from the former tenant".

In other words, don't admit to ANYTHING.

I think you got very lucky!  I hope the cop doesn't change his mind about his decison before your trial.

Good Luck,
Lana

naw, they wont change their mind. He didnt have that much, he didnt have that big of an operation going. Even if the cop was a dick and charged you with a greater offense, any decent lawyer would have gotten you off with a $1000 fine at the most.

First of all, it was your first offense.

Second, there was no sign of distribution. (glad you didnt have that bag divided up into eighths huh?)

Third, your apartment burned down, there is at least some sort of sympathy factor there....

I think the dumbest thing you did was grow in an apartment. Your lanlord could actually press charges for that. But even then, your not a big-time drug dealing criminal, im actually surprised they even brought you to the station.

And they didnt give you a break, they always say that. There wasnt enough there to charge you with much. Many cops in that situation would throw the jars out and 'say' they will be watching you.

I feel VERY VERY lucky.by playing dumb i mean that i acted like i was very nieve.I acted like i didnt know anything about the hobby, like i was sorry youngings but"like i was a dumb kid, even though I am not even close to the age where i could be called a kid"I was told basicly that the fire dept found them, not the cops, and that that allowed them to sieze them even trhough they didnt have a warrent ect..They also threw alot of other crap andeven tried to get me to sign a search waiver.I declined and they tried to scare me,well to be honest i was scared,i didnt want to spend even 1 night in jail, but i still kept my head and didnt cave to them really.in the end at least up till now its worked out, hopefully it does stay that way,but ill tell you my dyas of growing are done,at least for some time.
I knew it wasnt alot, and the jars arent whst scared me it was the 12 grams dry that did.Besides they kept taking the lids off the jars and poking at them so hopefully green mold sets in real fast or something worse. They kept asking stupid things that almost kept making me laugh like"tell us about mushrooms,do you smoke them or what?,can they get you high by touching them?whats all the white stuff?ect....cops were coming in from all over saying"ive never seen mushrooms what do tthey look like?It was crazy.I said i didnt know much about them.so eventually they stopped asking me.It was wacky.
I just find it crazy that they forgot the weed. That just blew my mind.

wow that is crazy, youre good for keeping your head and NOT letting them search by waiver.  ALWAYS SAY NO, and it seems you did, good for you.

Honeslty though, these cops seem pretty cookie, if they havent even seen mushrooms or thought they could get high by touching them.  Many metropolotin or larger city cops wouldnt have even done anything.  It seems to me these were small town cops with nothing to do.

They didnt forget the weed either, this stuff is almost a joke nowadays.  They likely thought they 'had' you for a 'much' larger crime so they didnt care about the green.  they see it all the time anyways, and 1 out of 3 of them used to smoke it regularly.

If you can dont try to sweat this too much.  They were just being pussies trying to scare you for nothing really, they like to do that.  therye not going to watch your every move or follow you or anything like that, youre fine.

Next time though, i wouldnt say anything to them.  Tell them you know your fith amendment and will not speak without a lawyer present. Sure youll spend a night in jail if you dont have bail money, but for your situation (being you 'didnt know' they were up there) your lawyer probably would have had the charges dropped.

Then again, the way you did it worked well too, only difference is its on your record now.

Either way its a bad situation, how did the fire start anyways?

Edit: another thing to mention.  Most states dont even have a classification for mushrooms.  Almost all states consider them equal to weed.  1 gram of weed is one gram of shrooms.  This is very nice for places that consider anything under and ounce a misdomeaner

butternut you can search the general legislature in your state. they usually have the laws on the books and it provides sentancing guidelines sometimes depending on what class of a misdemeanor/felony you did get. google for your states legislature.

They took my HPS light which sucked considering i wasnt even using it for anything and they took my bag of perlite. It was a very odd bust to say the least.I had a bottle in the medicine cabnit with 2 valuims that werent perscribed in my name, they left that, but they took a bottle of amoxcillin i had with no label on it!Crazy.
Anyway its all gone now, pipes are being used by a friend and everything else was flushed.
And thanx for the tip Socratesmind Ill check it out.

Well, if i were you i would still get a lawer.  He will almost definitely get you court supervision, which means in a year or less this whole ordeal will come off your record. Your lawer fee will probably be $500-$1,000 but its worth it.  Also you will have a court fine.  The fine might be $200 for the controlled substance but then add all the court fees and its up to $750

That homocide was for real?  i sure hoped his lawyer kept him out of jail, or i would kill the lawyer if i were him hahaha.... thats crazy though, the fireman killed themselves by not being prepared.  sad story though.

Glad to hear things didn't turn out worse than they did. You definately need to get a lawyer, a good one will get you supervision and most likely get the charge lowered down further to like jaywalking or some shit. Good luck!

friend of mine (on probation now) got caught with a lot of ganja. even has a bunch of it lining his pant pocket. the cops took a picture of it as well for evidence. however, they forgot remove the weed from his pocket before letting him leave.

obviously, he smoked it, and it was good. popo-weed always is
