If he catches him (legitimately or not) this close to the election people will view it as a trick and it would backfire. I'm willing to bet the Bush team knows this as well.

If it ever got out that Bush had OBL all along but used him as an re-election pawn, the scandal would reach Watergate proportion. Not only would there be a serious abuse of the political process, but it would be the ultimate exploitation of the September 11th attacks.

I don't think it would be that simple. They couldn't just walk in there an take him, they would have to fight through several hundred militants, all of whom would be holding back U.S. troops while OBL and his inner circle move around to another local. They lost him in Tora Bora because they were afraid of too many U.S. deaths - instead they opted to let the Afghans do it, many of which who don't relate to the grievances of 9/11 the way Westerners do. Heck, Osama might not even be in the mountains, he could be in the basement of a safehouse in Peshawar; unlikely though, since wherever OBL goes, hundreds of jihadis protecting him follow.

No. Quite the opposite actually. I think if he is found it will be legitimate (not a re-election ploy), but the issue will get spun so badly by Kerry's camp that people will start to believe in a conspiracy that does not exist.

Most people don't want to believe their government is capable of something like that. If Kerry accused him of that, he would see a major drop in the polls. Endorsing conspiracy theories is not politically advantageous for a politician.
