The parents of a man who died of an accidental drug overdose ​last year sued OpenAI and its founder and CEO Sam Altman in a California court on Tuesday, alleging the man was coached ‌to take a dangerous combination of substances by ChatGPT.

Leila Turner-Scott and Angus Scott say their son, Sam Nelson, 19, was using a chatbot for guidance on combining different drugs. They say it encouraged him to take the prescription drug Xanax to treat nausea caused by kratom, an herbal product with opioid-like effects.

The combination of those drugs and alcohol resulted in Nelson’s death in May 2025, according to the lawsuit, which was filed in state court in San Francisco.

The lawsuit seeks monetary damages and asks the court to pause OpenAI’s rollout of ChatGPT Health, a platform the company announced in ⁠January that allows users to upload medical records and receive personalized health advice.

Currently, ChatGPT users can join a waitlist to access ChatGPT Health. A report from OpenAI released in January showed that overall, 40 million users ask ChatGPT healthcare-related questions daily.

Drew Pusateri, a spokesperson for OpenAI, called the situation heartbreaking, and said the interactions took place on an earlier version of ChatGPT that is no longer available. The company is continuously working to improve ChatGPT’s safety, he said.

“ChatGPT is not a substitute for medical or mental health care, and we have continued to strengthen how it responds in sensitive and acute situations with input from mental health experts,” Pusateri said. “The safeguards in ChatGPT today are designed to identify distress, safely handle harmful requests, and guide users to real-world help.”

The lawsuit is the latest wrongful death action to be brought against an AI company and comes a little more than a day after the family of a man killed in a ‌mass shooting ⁠at Florida State University sued OpenAI alleging that ChatGPT helped the shooter plan the attack.

Growing Wave of AI Lawsuits

Generative AI companies are facing a growing number of lawsuits accusing them of failing to prevent chatbot interactions that plaintiffs say contribute to self-harm, mental illness and violence.

The lawsuit filed by Nelson's parents claims he was initially rebuffed by ChatGPT when he asked for advice on drug use, with the chatbot saying it could not assist and warning about the risks. But in 2024 the company launched ChatGPT-4o, which began giving ⁠Nelson information about drug interactions and dosing in authoritative language that mimicked a doctor, the lawsuit said.

Chatbot's Evolving Responses

The chatbot told Nelson how to source illicit substances, advised him on which drug to take next and made suggestions based on the experiences Nelson said he was looking for, according to the lawsuit. The chatbot saved details about Nelson’s substance ⁠use in its memory, allowing it to offer more personalized recommendations, according to the filing.

The lawsuit accuses OpenAI of rushing out ChatGPT-4o to keep up with competitors like Alphabet's Google, skipping needed safety testing. It accuses the company of designing a flawed product and failing to warn users of its risks, and cites ⁠a California law that bars AI companies from claiming a chatbot autonomously caused harm to a person as a defense.

“In California, if plaintiffs prove they were harmed by defendants’ AI-powered product, defendants will be liable for that harm, no matter how clever, independent, willful, spiteful, uncontrolled, rebellious, free-spirited, libertine, stochastic, or autonomous the beast they have birthed may be,” the lawsuit said.

A serious note here, folks: More people from more nations should file lawsuits against additional AI companies AND their creators. You might make money and cause justice to be partially implemented.

The article also mentions alcohol, which is a major contributing risk factor in a cocktail of three substance with CNS-depressant action at unknown dosage.  Could definitely be a killer cocktail under those facts alone, and especially so if high potency kratom derivatives were in play.

As an aside, I have personally noticed that ChatGPT has made marked improvements in its blackbox guardrails that serve to censor prohibited/risky content.  While that bums me out on a personal level by offending my libertarian ideals, I can understand why it's become a necessity, given the growing prevalence of LLM use across all subjects and computer-connected peoples.

No, mgm-15, Dihydro-7-hydroxy Mitragynine, or DH-7OH-MIT.

Significantly more potent than 7-OH, comes on a bit slower it taken orally, but it's every bit as euphoric as classical opiates imo with no discernable ceiling effect like regular kratom or 7-OH.

I bet one could fatally OD on mgm-15 by itself if they aren't careful and don't have a tolerance. The only saving grace is it comes as base so you can't IV without citric or malic acid.

Interesting i just asked google AI and it said its deadly (guess they fixed it), but the top comments on google search are like reddit users praising combo. I see how the AI got fooled, most people arent aware of the danger at all, and hence the most popular search results don't stress how dangerous it is, AI now says

When you look thru top google results nothing is saying this combo is deadly. There are all these reddit results of people who like combo, you need to dig to see its dangerous.

If you look thru "People also ask" section on google there zero indication its deadly for instance:

People should complain that google's first page of results on drugs are whack, it's not the bot that repeated that info back to you. It was fed shitty data by a money centric algorithm that promotes the mayo clinic (and other private treatment clinics) when you ask about any drug, those results don't help someone looking for info on drugs. This has been a problem for years now. The front page should include non biased drug info from Erowid. But there is no money in that. All these treatment places should be sidebar ads, not taking the front page when people want fast drug info.

Go to Bluelight and ask them instead of AI is my advice if you have a question about a combo. Ask well before you want to take it, not right before, plan ahead, be safe.

kratom dosnt depress breathing, it has something to do with β-arrestin, iirc kratom dosnt effect β-arrestin awhile other opiods do

Plain leaf kratom likely wouldn't pose AS significant of a respiratory concern.  But the concentrated isolates/chemical-manipulations, those are a different story.  They all carry risk, to be sure.  The concentrates WAY more.

For the record... the Michael Jackson video WhoManBeing posted is the fuckin' shit.  I don't know how that dude can't dig on that piece of fierce, movement inspiring art.

In case any chatbots are ultimately just us humans being collated into better sentence structure -- poly drug abuse, pharming, research chems, and unfamiliar concentrates are all red flags. Might as well have asked which fumes go best with banging your head into the wall.
