America's unfair judicial system

First off, I'd like to say how great this site is, and how much i enjoy being apart of this unique online community.

About 4 days ago I attended trial for an arrest that occured in late March for possesion of about a gram of marijuana(though, in Texas they classify everything under 2 ounces in the same category). Unfortunately, I had the same judge that I had at the county's juvenile detention center when I attended court to appeal for my release, which was denied and I was sentenced to 7 more days, making my stay a total of 10 days, and when I had served my sentence and I was to discuss my release. To say the least the judge didnt think to highly of me(in fact, my attorney even commented on it the second we got out of the court room). She sentenced me to 9 months of probation, because of a previous arrest for possesion of vikaden, and suspended my driver's license for a year. The reason for the extra-long suspention of my drivers license is the main reason i wrote this. When I was released from jail she mandated that I get a hair cut, and being completely emotionally crushed after 10 days in jail I didnt think twice to agree. Now, according to the law, I did just what she said; i got 2 haircuts over the 3 and a half month period between my release and this most recent trial. The only problem was, my hair is now longer than it was in March despite getting it cut twice. This aparently pissed her off to some degree, and she mandated I cut my hair to my ears. Now, I'm not a very materialistic person, and looks dont mean much to me, but my hair means alot to me, and it says something about me, something about being different and having my own style i guess. Right now my hair in the front its about an inch past my chin, while in the back its about an inch past my shoulders. Its going to take an extremely long time to get this back(getting this long already took 2 years). I think its wrong that judges can force people to do things just because the way they feel on a certain matter. I mean, in all honesty i dont give a damn what she thinks, because i did not grow my hair out to impress her, I did it for myself. So basically my question is is there anything i can do about this or am i pretty much fucked. Ive talked to an adult friend and after hearing the situation said theres nothing i can do. Any feedback or advice on how to logically excercise my right to decide how long my fucking hair is would be greatly appreciated. I would also like to encourage any discussion pertaining to how we should go about legalizing marijuana, as i am very intrested in changing things for the better so others dont have to be put in the position "this great nation" has so unfairly put me in.

also, there is proper dress for court and hair is one of them. if you don't cut it, i'd suggest just not to have it hanging in your face. put some rubberbands in it or something.

i havent got it cut yet and thats the point. Im supposed to get one within the next couple of days and basically at this point im looking for any way to prevent this....i mean honestly, it doesnt exactly seem legal to me.

it's not. is she going to order you to pluck your eyebrows too? she's just being a bitch probably based on your looks and maybe even your attitude.

no, but i do have to go to meet with my probation officer, and from what i understand the haircut mandation was included in the court order, which the probation officer will recieve a copy of. And though the probation officer may not think it was fair and totaly object to it, if he doesnt follow the rules and do as the judge ordered, he could loss his job and when it comes to that I dont think he'll risk his job for something so small(in his opinion).

this kind of shit boggles my mind. you need to get the fuck out of tehas man. anywhere else, you get caught with a gram, they're just gonna take it and / or write you a fine.

wait and see what the PO says. i'd like to know what happens with this if you want to keep us updated. it may be because you're a juvenile though. you don't really have rights until you're 18...

But yea i do agree she was judgeing me by my looks as well as my attitude(at the first trial she brought up the issue that there was some suspicion of me dealing, and i immediately said there was no evidence, and she said some shit about how that "didnt impress her"). I mean yes thats her job, but it was my understanding judges were to judge based on the law, not contempt for someone different to you. It has honestly made me hold a grudge on this country....i mean to a degree they were jsut doing their jobs and i understand that, but things shouldnt be this way...the goverment shouldnt be able to fuck u like this, there are more important things the cops could be doing(this is not to say i think all drugs should be legal, I've had my fair share of struggles with addiction and in retrospect i see no good in most hard drugs). Im just so disgusted with the utter stupidity that the government has used to deal with the situation of drugs.

IANAL (I Am Not A Lawyer)

If you want to take the hard road and fight this do the following.

#1) Get a Lawyer!
#2) Discuss this with him/her!
#3) If s/he agrees Proceed to
#4) Do not cut your hair.
#5) Go to Jail
#6) File a writ of HABEAS CORPUS - Lat. "you have the body"

NOTE: a party may file a habeas corpus petition if a judge declares him/her in contempt of court and jails or threatens to jail him/her.

In Brown v. Vasquez, 952 F.2d 1164, 1166 (9th Cir. 1991), cert. denied, 112 S.Ct. 1778 (1992), the court observed that the Supreme Court has "recognized the fact that`[t]he writ of habeas corpus is the fundamental instrument for safeguarding individual freedom against arbitrary and lawless state action.' Harris v. Nelson, 394 U.S. 286, 290-91 (1969). " Therefore, the writ must be "administered with the initiative and flexibility essential to insure that miscarriages of justice within its reach are surfaced and corrected." Harris, 394 U.S. at 291.

Life's a bitch. You live in Texas, which has fucked up laws. You were unlucky enough to get some stone cold bitch who a problem with stoners. Just cut your hair. Of course you don't have to, but she's a bitch, deal with it. You could also wear a pair of shorts and a singlet to court but it wouldn't help you. Act really nice in court. Make up some bullshit how you were an addict, but you've seen the light thanks to her (the byatch judge) stern words. Then move out of Texas.

If the judge put this in the court order as part of your probation, then by not getting your hair cut you will pick up a Violation of Probation charge. Then you will have to go back to court and answer to that charge. That would be the place for you to fight the hair cut clause, but if you lose, then its off to Juvy for ya!
