Are Liquid Cultures legal to Sell?

I’m an admin for a Facebook group that has been covered up with members attempting to sell liquid cultures, claiming they’re treated the same as spores and do not contain psilocybin.
Is this legal?

Everything's legal till you get caught.
Being a culture I'd say no. That's why legit vendors only sell prints or spore syringes for actives.

If it were legal everyone would be doing it.

Lots of people are selling liquid cultures these days and I haven't heard of anyone getting in trouble for it.
Whether it would test positive for psilocybin depends on the LC media and the species / strain.
I have heard of a few people getting their LC's tested at psilocybin testing labs and they have turned up negative. It is hard to be sure due to the low number of samples tested, large numbers of LC recipes and many crime labs throughout the world doing the testing, all with unknown cutoffs.
In general, it seems pretty safe, similar to selling spores.

I guess live cultures don't have as much of a "for microscopy use only" fig leaf as spores do. But that seems to matter less and less, anyway.
I feel like the current cannabis situation has really transformed the legal climate. The patchwork of state laws, all existing under federal law which remains absurdly outdated, has created a world where psilocybin is falling through the cracks. Many states already followed a policy of enforcing the law, determining penalties, etc., by treating it the same as cannabis. But as local jurisdictions get further and further away from busting weed grows, and any coordination with federal agencies on cannabis laws, the likelihood is that very few people are paying any attention at all to these new developments in the online marketplace.

A lot of places are selling; however, the legit vendors are not. At best, its a legal gray area. I'm of the opinion, the vendors selling culture if anything, hurt the movement and risk being made an example of in the future.

How would selling liquid cultures hurt the movement?

What, like this guy they made an example of 20 years ago? He had the audacity to produce and sell spore syringes with instruction booklets, when others were keeping their heads down and only dealing discretely in prints.
If people are actually selling clean and properly developed cultures, I salute them.

I'd add age of LC as a factor. It may eventually produce Psilocybin if unused for a long period of time.

It would be an interesting question of when the LC was tested by law enforcement. Was it positive at the time of confiscation or later? If the answer is unknown…..

Then potentially the LE were manufacturing after confiscation...?

I'm having a hard time imagining anyone in law enforcement in the 21st century going that far down the rabbithole when dealing with liquid cultures. There's also a legal chain-of-custody issue there. Randomly confiscating stuff to test it is not necessarily illegal in all cases, but it's the sort of thing that gets cases thrown out.
You know what's all the rage right now? Pretextual traffic stops that lead to civil asset forfeiture (your money and vehicle aren't innocent until proven guilty, so it's quite lucrative). You know what isn't? Messing with all that hippie shit. Complicated court cases with no political benefit. "Microdose" was one of the answers in my crossword puzzle the other day, clue being "take a little trip?" The current moral panic is mostly centered around Fentanyl and meth, so that's where the action is.
When Psilocybe Fanaticus ended up on the DEA's radar over 20 years ago, they got enough evidence to do a raid by ordering a syringe and following his instructions. He basically taught some DEA agents how to grow mushrooms.

I am curious about the same thing. there are at least two vendors that are selling LC of of active strains Myco.com and Thick Spores. There are a few positive ratings for them. Anyone please correct me if I am wrong not trying to get banned. I will take this down right away.
https://www.shroomery.org/forums/showflat.php/Number/28565450
In their post in the Vendors section they explain:
"Legality: The compounds psilocybin and psilocin emerge during the mycelium knot stage of growth. This was a theory that we developed years ago after reviewing the literature on psilocybin-containing species and later confirmed in extensive testing of our LC by a DEA-accredited forensic lab. The testing found that our LC does not contain psilocybin or psilocin. Meaning, as long as our Research LC is used for research purposes, not growth, it falls under the same legal categorization as spores.
We’re always open to any feedback, comments, and thoughts on our product and operations. What's working? What's not working? How can we improve?
Thanks & Love.
MYYCO Team"
I am still doing some research. On the fense.

So they're working the "microscopy" fig leaf angle, just like spore vendors. Not that it matters, most of us will go on to commit felonies with the material.
For the feds, it was never about the psychoactive content of a given substance- just legal interpretation of intent. Cops are notorious for pushing the envelope in that area (and then intimidating people into rolling or taking a plea), so I think all of this is a matter of there just not being any law enforcement resources being invested in this realm. In short, they haven't signed off on anything, they just don't give a shit. Back when they cared more, and busted Psilocybe Fanaticus, they described his operation in a press release as being like selling all the materals and lab equipment to make meth, and including an instruction booklet. But that was over two decades ago now, and cop culture has shifted. Busting hippies isn't cool anymore. They're apparently willing to let shit slide as long as you leave the instruction booklet part to someone else. But a good prosecutor could still nuke the "microscopy use" angle in court, if it ever got that far.
Vice laws have always been a nonsensical patchwork of selectively enforced bullshit. There is no internal logic here, and nobody keeping score. Just people pushing the envelope a bit more when nothing bad happens, and the cops either not noticing or not caring.

Mycelium is active before it knots.
But there's so little in the few strands in a culture syringe the tests are giving false negatives.
We have a thread where people are eating grain spawn and tripping balls
Anyway, with the fentanyl crisis and the administration pushing for weed to be rescheduled, the DEA isn't worried about LCs.
Just don't do anything dumb, research your vendors, and you should be alright.
But no, they're not legal and the people selling them either know better or don't want to know better.

The way things are headed, I think all this is destined to become irrelevant.

Some LC's are active and others are not, it depends on the strain, how old the LC is and the LC ingredients. I've never heard of anyone getting busted for LC, so it's kind of legal. I wouldn't worry about ordering it.
