Ohio voters to decide on recreational marijuana legalization * PASSED * * 3

Voters will choose whether to pass or reject Issue 2 on Tuesday.

Issue 2 would legalize and regulate recreational marijuana for adults aged 21 and above, including cultivation, processing, sale, purchase, possession, and home growth. If the initiative is approved, adults would be able to possess up to 2.5 ounces of marijuana and up to 15 grams of marijuana concentrates. Additionally, individuals would be permitted to cultivate up to six marijuana plants at home, while households could cultivate up to 12 plants collectively.

The Division of Cannabis Control, created under the initiative, would be responsible for regulating and licensing marijuana operators and facilities and would oversee the compliance and standardization of marijuana businesses and production in Ohio. Licensing for distributing facilities would take up to nine months after the law takes effect 30 days after approval (December 7) if it is approved.

Under Issue 2, marijuana sales would be taxed at 10%. The revenue generated from this tax would be directed toward establishing a cannabis social equity and jobs program. This program would be designed to provide financial support and assistance for license applications to individuals who have been disproportionately affected by past marijuana-related law enforcement.

It passed!  Now it just has to be ratified.  Some states in this country are so fascist they literally over-ruled the popular vote on legalizing cannabis.

Ohio just voted to legalize cannabis. Here’s what happens next.

Ohio voters have officially legalized recreational cannabis via Issue 2. The ballot initiative passed this evening, November 7.

The state’s vote to legalize cannabis follows several reforms. Ohio lawmakers legalized medical marijuana in 2016. Additionally, 38 Ohio cities have already decriminalized the possession of up to 7 ounces of cannabis.

In 2015, Ohioans failed to pass a separate legalization initiative, by a vote of nearly two to one.

Read on to learn how legalization in Ohio could unfold. We encourage readers to consider that the state’s legislature reserves the right to modify (or even repeal) the measure; any and all of these provisions could easily change.

When will it be legal to possess weed in Ohio?

The law will “become effective” 30 days after passage. That date will likely apply to possession, but the ballot measure does not specify when adult-use sales will begin.

How much marijuana can I possess in Ohio?

Issue 2 allows adults 21 or older to possess up to 2.5 ounces of cannabis and 15 grams of cannabis concentrate.

Can I smoke a joint in public?

Nope.

Can I grow cannabis at home?

Yes. An individual can grow up to six plants at home, with a maximum of twelve plants per household.

Who will regulate legal growers and sellers?

The state will create a new Division of Cannabis Control within the Ohio Department of Commerce to oversee the nascent industry.

How many weed stores will be allowed?

The state’s 130-odd existing medical marijuana dispensaries will have a green light to sell to recreational customers. Furthermore, the state will license 40 new cultivators and 50 new retailers. The Division of Cannabis Control can issue more licenses two years after they approve this first batch.

Will Ohio offer any equity or small-business licenses?

Yes. The ballot measure dictates that the state will issue new licenses “with a preference to applications who are participants under the cannabis social equity and jobs program.” But it does not quantify but the language in the ballot measure does not specify how many.

Can local towns or counties ban stores?

Towns and counties can ban new stores, but cannot stop existing medical dispensaries from selling to adult-use customers. Towns and counties furthermore cannot impose local taxes on cannabis.

Will Ohio tax marijuana?

Yes. Ohio will add a 10% excise tax to cannabis sales. The state’s 5.75% sales tax, as well as local taxes up to 2.25%, would also apply to cannabis purchases. Ohio would direct 36% of the revenue towards a marijuana social equity and jobs fund.

What about the expungement process?

The measure does not include specific language around automatic expungement, but does require the state to use some cannabis tax revenue to fund reform efforts including expungement.

This is a nice victory but the drug war republicans in Ohio may try to scuttle it. I dont think they can do what the scum governor Kristi Noem and the South Dakota Supreme injustice court did but they may fuck it right up including right to grow your own.

Ohio modeled after Michigan which is easily the best rec market I've been to.  I think they are in the sweet spot of tax so that it is cheap enough to kill off most black market.  MI dispensary top shelf ounces are like $100.  Real live resin vapes start at $10-15.

I like how they limit by plant number.  If you start inside in april you could grow a 12ft tall weed plant with 3lbs on it.  Or you can grow a small auto with 2 oz on it.

It passed 57/43 which is pretty huge considering trump won in 16 / 20 in ohio as well as repubs did good in 22.  That means a lot of republicans wanted weed (and abortions).  I think it would be political dynamite to try and cancel this with legislation. 

LaRose and Huffman are shit to me.  They pulled some crap so legal cannabis didn't make it on the 2022 ballot and it blew up in their face on them.  Voting legal weed along with abortion rights both passed 57/43.  It would have probably passed in 2022, but it would have maybe effected the senate race.

Here in California, dispensaries operate with a heavy regulatory and tax burden, which perpetuates a black market bigger than the legal market (at least for flower).

Home-grow of up to six plants at a time has been legal since 2016, yet it seems that most consumers would rather pay for illegally-grown than grow their own. And keep in mind this is California. We have the best possible climate for outdoor home grow! With some care, it's possible to grow three rounds of autos outdoors in a season, no lights or tents. OH's climate would make that impossible.

California, and every other stat quasi legalization of marijuana under democrat majorities proves how corrupt and pro drug war the undDemocratic party is not just on marijuana but on capitalism as a whole. It's not incompetence or Republicans in the way, it is the unDemocratic party making a plant quasi legal.

Are prices still expensive as fuck in California dispensaries though? And how did the dispensary price curve go since legalization of home grow? People are lazy as fuck and growing means watering and feeding nutrients which is just too much for large percentage of people that smoke or eat the plant. On one hand marijuana should be about as expensive as tomatoes and we should have about as many people growing marijuana as tomatoes. On the other hand, who doesn't eat tomatoes in some form everyday? While  smoking marijuana for recreational everyday makes you an idiot and abusive of what the plant can do for you.

As for tomatoes and cannabis, my experience is that growing outdoor cannabis can be easier than growing tomatoes, especially if you grow feminized autoflowers. Good seeds have high germination rates, and that makes starting them comparable in effort to buying tomato plants from a nursery. Nutrient and watering requirements are pretty similar. Yet a first round of autos is ready to harvest even earlier in the season than "Early Girl" tomatoes.

Preparation, however, is another story. Home-grown tomatoes are just as easy to prepare as store bought fresh tomatoes. Pick them and toss them in your salad or use in your favorite recipe. Home-grown cannabis takes much more effort to prepare. If you want to smoke it: drying, cleaning, separating and curing takes time and effort. If you're making topicals or edibles: you still need to dry it, clean it, decarb it and infuse it before it's ready for action. The flower you buy at the dispensary is pricey, but it's very pretty and it makes a great smoke, right out of the bag.

Dispensary prices are driven up over black market prices by excise taxes and sales taxes, plus the cost of maintaining a bricks-and-mortar business place. Plus, most cities and even most counties don't permit dispensaries.

Cannabis is still actually quite affordable in dispensaries, for all but the most intense users. I really don't think it's a problem. One can get a 1000mg tincture for $40, and for a moderate user for whom 20-50mg is a medium or strong dose, then this tincture will last them a while.

While some flower is massively overpriced, one can actually get quite good flower at $20-30 per 3.5 grams. I've gotten it cheaper, slightly lower quality but still fine, at $44 for 20 grams. For many casual users this is more than enough.

One usually doesn't have many bulk deals at the dispensary, however. For someone who wants to buy a lot of flower, there isn't a great option. I've heard of people talking about amazing deals from illegal pot, a few hundred for a pound. It seems most illegal buyers don't get nearly that good a deal, but perhaps their price is slightly better than the one dispensaries offer. How much are they saving, really?

Dispensaries are about marketing and much is overpriced; nonetheless, some seems to be reasonably priced. And the dispensary I go to discounts all the tax, so there isn't any additional charge. Or another way to put it is, the tax is baked into the price.

The last time I bought black market weed in ohio the price was down to something like $500 for a quarter pound.  That was a couple years ago when the cali import stuff started flooding in the market and MI went legal.  A decade ago a quarter pound went for about twice that. 

The last two times I went to a MI dispensary i asked for the best they had in their "on sale" category.  Point Break and Super Chronic where both very flavorful and got me high @ $100 and ounce. The bud is incredibly dense compared to my home grow.  The mass to volume is almost double.

I don't really care what happens to medical. I think it will go extinct honestly. I never got medical because the ohio medical program was no good.  I bought black market, home grow or went to MI because of the costs and quality was better.

In ohio a med dispensary "eighth" is like 2.8grams or something.

If 1/4th pound went for 1k a decade ago, that's 250 an ounce or around 33 an eighth. I've seen better prices at the dispensary.

It seems that dispensary pricing forced the illegal market to undercut it and price better.

That is still too much for dried flowers from a plant. In fact its an absurdly high price.

No its not off topic it is showing how the unDemocratic party is continuing the drug war and making a plant expensive by giving eclusive licenses to a few select capitalists while continuing the drug war.

There are so many ppl out there legitly needing medi tht are getting shut out by the rec movement
I think the high %THC content will keep the medi movement going
Although the rules ®s r fckin over the caregivers
I walked into a medi building looking 4 weed in while in ME &just the smell alone gave me a contact high (they were nice enough to tell mr where the rec dispensary was though)
