American Kratom Association Issues Consumer Advisory, Urges FDA to Regulate Kratom
September 18, 2023 - QA Magazine

Washington, D.C. — The American Kratom Association (AKA) issued a Consumer Advisory in response to recent wrongful death jury awards in Florida and elsewhere, urging the FDA to regulate the herbal substance derived from a tropical tree (Mitragyna speciosa) native to Southeast Asia.

The Consumer Advisory states the following:

1. The American Kratom Association urges the FDA to immediately publish product manufacturing standards for kratom products that are sold to consumers and encourages the removal of kratom products that do not contain adequate labeling with recommended serving sizes, product ingredients and appropriate warnings on conditions of use.

2. Until the FDA implements a set of standards to protect consumers, the AKA advises kratom consumers not to purchase or consume kratom products that:

   
  • Have not been certified by an independent third-party lab to be free of dangerous contaminants or that contain adulterants that could be dangerous to consume.
  • Are offered for sale from a vendor that markets its product with illegal therapeutic claims.
  • Do not contain the name of the product distributor so that a consumer can file an adverse event report if required.
  • Are delivered in unprofessional packaging, such as zip-close bags, or that have handwritten product information.


“Recent reports of product liability awards for irresponsibly manufactured or marketed kratom products are the direct result of the FDA’s failure to regulate the kratom marketplace and, in some cases, the exploitive behavior of trial attorneys who do nothing to compel the FDA to act responsibly,” said Mac Haddow, AKA’s senior fellow on public policy.

Based on the AKA’s review of litigation reports, the product liability awards by the courts have been based on the failure of the product manufacturers to provide labeling instructions for responsible use and little or no information on the contents of the potentially adulterated products, according to Haddow.

“The safety and addiction profile of pure, unadulterated kratom is well-documented by science, and there is no known level of kratom use that would cause any fatality unless it is irresponsibly consumed, adulterated with a toxic drug or used concurrently with a deadly drug substance,” Haddow said. “The AKA supports congressional action to compel the FDA to develop and implement a set of standards for the manufacturing and marketing of kratom products to protect consumers in the United States.”

This is an offensive maneuver, and it's smart. The AKA is putting the FDA on notice before the FDA goes after kratom again. It puts a ban out of the question as it has shown the FDA has done nothing to curb the concerns above. Kratom will become more expensive, but thats better than a ban.

Kind of.  But anyone knowledgeable can see its just posturing.  Regulate it as "what?"  Should kratom adhere to botanical drug standards?  How about as a "food"?  What about as a "dietary supplement?"  The regulations for each of these are vastly different, and AKA knows it.  When discussions of scheduling kratom arose 5-6 years ago, AKA fought against it.

So AKA wants "regulation" but they don't say as what.  They're also murky on specifically what type(s) of regulation they want.  Its political theater so they can say: "See, we want regulation to protect people."

I have no particular reason to trust the AKA, FDA, or vendor, who are all strangers to me, with their own motives.

But, it grows as a houseplant, or in sheltered locations in temperate climates. :shrug:

If this thing is customary or indispensable to you, why not get your hands a little dirty, rather than trusting some seal of approval from an external authority.

They are trying to prevent it from being banned or considered for a ban. The FDA cannot make this claim as they have not tried to regulate it first or set forth serious thoughts of such. I think having it regulated for 3rd party testing is adequate regulation, and part of the AKAs platform.

AKA was also instrumental against the DEA during their consideration for a ban.

Some self appointed bureau is setting terms with the feds, on your behalf.

EDIT -- At least, that is vaguely some kind of organization, instead of burning random things to the ground.

I would rather have a private institution , broker a deal with the power players then have no representation of the issue for those above to do whatever at their whim. People that want to form thier own organization against kratom are welcome to as well.

Again, the AKA did go toe to toe with the DEA, and they backed off. Thats doesn't happen much.
