  • 1944:  Jack Casady is born

Quote:

Jack Casady (born John William Casady, April 13, 1944 in Washington D.C), is an American musician considered one of the foremost bass guitarists of the rock music era and best known as a member of Jefferson Airplane. First playing as a lead guitarist with the Washington D.C. area rhythm and blues band "The Triumphs", he switched to bass during his high school years and while still underage (and with a forged I.D.), played the Washington D.C club scene, backing artists such as Little Anthony and the Imperials and Ray Charles. He became the bass player for Jefferson Airplane when lead guitarist Jorma Kaukonen, a high school friend and former Triumphs rhythm guitarist, invited him to join in late September 1965. Jefferson Airplane became the first successful exponent of the San Francisco sound. Their singles, including "Somebody to Love" and "White Rabbit," had a more polished style and successfully charted in 1967 and 1968. Casady, along with the other members of Jefferson Airplane, was inducted into the Rock and Roll Hall of Fame in 1996.

  • 1967:  Ken Kesey's second trial for his Telegraph Hill marijuana bust ends in a hung jury

Quote:

Kesey Jury Hung

SAN FRANCISCO (AP) —The second trial of novelist Ken Kesey on a marijuana possession charge ended Thursday night [April 13, 1967] the same way as the first — in a hung jury.
After slightly more than 11 hours of deliberations, the jury reported itself deadlocked and was dismissed.
The jury was reported deadlocked 11-1 for the conviction of the 31-year-old Kesey, author of "One Flew Over The Cuckoo's Nest," and "Sometimes A Great Notion."
The former Springfield, Ore., resident was arrested Jan. 19, 1966 on a San Francisco rooftop in the company of Carolyn Adams, 19. She was later convicted of possessing marijuana and testified at Kesey's six-day trial that the packet of marijuana found beside them belonged to her.

  • 1973:  Bob Marley and The Wailers release the Catch A Fire album

Quote:

Catch a Fire is the major-label-debut album for Jamaican reggae band The Wailers, released on Island Records in 1973. The album established the band as international superstars. Leader Bob Marley in particular became world-famous. The socially aware lyrics and militant tone surprised many listeners, but others were attracted to songwriters Marley and Peter Tosh's confrontational subjects and optimistic view of a future free from oppression.

Catch a Fire peaked at #171 and #51 on Billboard's (North America) Pop Albums and Black Albums charts respectively. It is number 123 on Rolling Stone's list of the 500 greatest albums of all time, the second highest placement of the five Bob Marley albums on the list, after the posthumous compilation album Legend. It is also regarded as one of the top reggae albums of all time.

Happy 75th Birthday to Melissa Cargill's ex-boyfriend Jack Casady!

Quote:

When Owsley had begun making LSD back in about 1965, one of his principal collaborators had been his girlfriend Melissa Cargill, who had been a chemistry student at UC Berkeley. As far as I know, Cargill was not a partner by the time LSD was made illegal in October 1966. However, I also know that Ms. Cargill became Jack Casady's girlfriend, at least for a while, so the ties between Owsley and the Airplane ran much deeper than may at first be apparent. I don't know if Cargill was still close to Casady in 1970 (as the saying goes, I don't know Jack), but Hot Tuna's presence was not at all a coincidence. At this time, Grace Slick was very pregnant (she would give birth on January 25, 1971), so the Airplane themselves would not have been available.

Just wanted to remind everyone that Kesey's second Telegraph Hill trial was a hung jury because one juror decided that he was not guilty and would not budge.  That's called jury nullification.  However, rather than go through third trial for Telegraph Hill, Kesey decided to plead no contest a couple of weeks later.  But it's still a powerful reminder of how jury nullification can be used to fight unjust laws.

Quote:

Lone Juror Balks Kesey Conviction

Psychedelic author Ken Kesey remains free on bond today, thanks to a lone juror who stubbornly refused to change his mind.
The 31 year old writer's second trial on charges of possessing ' marijuana came to naught last night when a jury of eight men and four women declared themselves "hopelessly deadlocked" in Superior Judge Joseph Karesh's court.
The judge asked the foreman, Thurman L. Stewart, an insurance claim adjuster of 1755 Van Ness Ave., whether there would be any possibility of reaching a verdict with continued deliberations. Stewart indicated that would depend on one person.
Karesh sent the jurors back into their room, instructing the foreman to put the question of a possible verdict to the one dissenting juror. Five minutes later, the jurors filed back into court and Stewart announced the dissenter would not budge.
Thereupon, after six hours and 20 minutes of deliberations, Judge Karesh declared a mistrial, in view of the fact that the jurors had indicated in a note to the judge that they stood 11 to 1 for conviction.
Karesh allowed Kesey to stay free on bail and ordered him to return to the Superior Court at 9:30 a.m., April 28, for determination of whether a third trial would be held.

(The San Francisco Examiner (San Francisco, California) 14 Apr 1967, Fri Page 44)

And to give you a summation of Kesey's legal issues, he had been arrested for marijuana in La Honda on April 23, 1965 and on the rooftop at the Telegraph Hill house on January 19, 1966 with Mountain Girl.

He was on the run for about 8 months before being arrested by the FBI on October 20, 1966.  His first trial ended in a hung jury on December 1, 1966.  His second trial also ended in a hung jury on April 13, 1967.  His charges for jumping bail were dropped.  He ended up taking a plea deal on May 2, 1967 and then was sentenced for both convictions on June 30, 1967, where the judge made both convictions concurrent.  He was released on good behavior after doing just four of his six months.
