DA swamped with Phish arrests

SARATOGA SPRINGS -- Local police described the activity from 30,000 Phish fans as nothing abnormal for a summer concert weekend, but Saratoga County District Attorney James A. Murphy III has another adjective for it: 'nightmare.'

On Monday morning, his office had received close to 50 vehicle and traffic offenses stemming from Saturday's and Sunday's sold-out concerts at the Saratoga Performing Arts Center, he said, but what bothers him are 'some really very significant felony cases involving narcotics, assaults and robberies.'

'The weekend was less than quiet,' he said. 'It strained the resources of the state Park Police, Saratoga County Sheriff's Office, state police and Saratoga Springs Police. One case even involved the Albany Police.'

Heading the district attorney's list of serious offenses: A concertgoer from Canada was hit on the head with a baseball bat in the SPAC parking lot and robbed of his passport and wallet. In what's believed to be a related incident, a Phish fan was assaulted inside the Stewart's Shop on Northline Road in Milton. That case led to a chase into Albany, Murphy said.

The assaults are under investigation; no arrests have been made yet, he said.

State Park Police referred calls about the concert Monday to Warren Holliday, acting regional director for the state Office of Parks, Recreation and Historical Preservation. SPAC is located within Saratoga Spa State Park.

Holliday could not be reached Monday afternoon, but his statement to reporters on Sunday was: 'Things went very well here last night. It was a mellow crowd. There were very few arrests compared to the number of people that were in here.'

Days before the concert, the state Department of Transportation warned people away from Saratoga Springs because of the anticipated crush of traffic. Severe backups on the Northway and Route 9 were reported, but Murphy's perspective on the traffic is shaped by the tickets.

There were multiple arrests for driving while intoxicated and driving while ability impaired by drugs, as well as other vehicle and traffic offenses, he said.

'We received 11 recommendations for bail from the Park Police and the Saratoga Springs Police,' he said.

Also, three men were arrested and charged with drug felonies for possessing hallucinogenic 'mushrooms' and ecstasy. Search warrants are being drawn up in relation to those cases, he said.

While downtown Saratoga Springs was busy, the main evidence of Phish fans manifested itself in heavy sales of beer and ice at convenience stores. City police arrested eight 19- and 20-year-old men from Sudbury, Mass., on Saturday after finding them camping out on the roof of Subway and Celtic Treasures. They reportedly drew attention because they had a BB gun that looked like a rifle.

City police also arrested a person for ticket speculation, or scalping a lawn ticket.

All told, the weekend 'was just a nightmare,' Murphy said. 'We want people to enjoy our community, but in a law-abiding and safe way.'
