Police arresting me on obviously false charges, then impersonating bail bonds calling my family while in jail. What in the f? * 1

So this is pretty fucking bizarre, I have to find an attorney today to help sort this shit out, but wanted to bounce this off the shroomery folks here.

I am 37 / White / Male, usually a bit rugged in my appearance, but I work 18 hours a day some days so I feel a bit rugged most of the time.

---The Arrest---

Last week I passed out in my vehicle around 7am in a business parking lot in plain sight (right off the road) on a weekday morning, I didn't mean to doze off, but must have been so tired from doing shitty overnight food delivery that once parked my brain just clicked off for a bit.

My brain clicks back on when two police officers are approaching me vehicle (not running), asking me how much I've had to drink, at which point I am entirely confused as I don't remember falling asleep and am not understanding they think I am intoxicated immediately. After being asked for my license / insurance it begins to sink in, I explain to them I've been working all night and apparently dozed off while parked, at which point they yank me from the vehicle for a field sobriety test (watch the tip of my pen test for all of 5-10 seconds).

Once out of the vehicle one officer begins what I assumed was a pat down for weapons, but then begins to feel objects inside of my pants cargo pockets, and helps himself right into the pockets to pull out whatever objects are inside. After telling the officer I do not consent to being searched, he leans me against my vehicle to administer the 5-10 second "follow the tip of my pen" field sobriety test, and then continues to tell me I am being placed under arrest for Drive While Impaired (on what we don't know yet).

I get slapped into the back of the squad car and the two officers begin to toss my entire vehicle, eventually finding a handgun behind the passenger side seat, and the roach from a joint in an ashtray. I let the officers know I have a valid permit to carry a concealed weapon in my wallet, which they verified on the spot was valid, but continue to toss my vehicle saying they found burglary tools in my possession. I advised anything of tactical nature is for my own safety / self-defense while delivering food overnights, as I've had "ambush orders" called in previously, where the order is placed so the people at the delivery address could jump / rob / carjack / kill me. They take it all anyways, fair enough, I'll have my day in court.

They get a search warrant to have my blood drawn immediately before dumping me at jail, when asked if I can speak with my lawyer prior to signing any warrants, they advise "If you don't sign this we are charging you with another crime" to which I just sighed and signed the warrant, knowing this whole arrest is shady as fuck but not wanting to escalate the situation.

---In Jail---

Initially I was told that I was being taken to jail on a 36 hour Probable Cause hold for DWI, at which time I listed no emergency contacts for myself during my intake, I'm not one to leave this info off my personal records but this time I just felt leave the shit off - So they have no outside contact info for me other than my direct contact info. A change of clothes and few coughs later, I am laying in my new luxury jail cot for the weekend.

After 24 hours I touch base with my girlfriend to let her know I am alive and safe, at which point she informs me that a family member found me via "Inmate locator" for the county, and it listed the arresting offense as "Felon in possession of a firearm", and I asked them to check it again while on the phone.

I've only had a single speeding ticket on my adult record, the police verified my permit to carry a concealed weapon on the spot, these charges are obviously complete bull shit. When I said this to my girlfriend she said my mother had received a call from a bail bondsmen that day, advising her I had some underage charge that needed to be expunged for me to lawfully be allowed to have a permit to carry, and this bail bondsmen advised to my mother where I was at in my jail sentence (if I don't see a judge today I'll be out tomorrow at noon) which I was a bit surprised they would have that updated of info on me even as a bonds person - Especially considering I've never called or spoken to a bail bonds person in my entire life.

I tell her I'll see her soon, hang up the phone, and decide no more calls from inside jail as shit is getting way too weird.

---Discharge from Jail---

After holding me hostage for 36 hours, the police were kind enough to kick me out into freezing weather with no phone / shoes, all my money loaded onto a prepaid mastercard, at 8pm on a Saturday night in the middle of a major metro area known for savage jumpings and murders in the downtown area. Lovely.

I survive getting home, I can no longer see the arresting charge on the county website via Inmate Locator after being released, and now I'm trying to piece together everything that just happened starting with the call to my mom to clarify the call with this bail bonds person while I was in jail.

After about 30 seconds of hearing about this phone call, it sounded to my absolute shock, that likely a police officer that would have knowledge of my current jail status, had called her impersonating a bail bondsmen to secretly extract information from her to solidify or justify their charges. I have never heard of this being done before, but going through the checklist, I can't imagine how it could be anything other than a police officer / detective:

- I provided no emergency contact info (How did they get her phone # at all?)
- I contacted no bail bonds person ever in my life (How did they know my updated court status?)
- The phone # that called my mom is unlisted / not associated with any bail bonds in my entire area (I haven't wanted to call the phone # directly yet)
- The charges are complete bull shit, and would need one hell of a dirty assist to not get laughed out of court / get an officer shit canned from their job

I finally got my vehicle out of impound today with a warrant left in it, which left off most of my possessions that were taken from my vehicle, and right now I am wondering what in the flying fucking hell just happened.

I will likely lose my job, that will likely lead to me losing my home, and I doubt I'll be getting any job offers again any time soon - All right as the temps are about to hit the negatives for the winter / right before the holidays so my immediate and extended family can absorb that I am the new adult criminal of the family that is on their way to the gutter.

---So my question is, am I out of my fucking mind right now? Did I overlook something?---

I feel like this is so insanely out there for a police contact, I feel like I am making all of this up, and I'm having trouble believing my life has basically been ruined by cops framing me... all because I dozed off in my vehicle for 20 minutes?

I've either slept like a rock or not slept during the night after this arrest, knowing that I have to tell my boss I was arrested with a fucking gun, and I am having trouble believing that I have to get fired from my job in about 2 hours now because of all this incredibly bizarre police bull shit.

Any input very much appreciated, I have to start coffee and begin looking for attorneys I can afford to sort out this mess, what a nightmare.

This morning my girlfriend also woke up with a sort of PTSD to this whole situation, seeming to talk herself into and out of leaving me, worried that the police might seize our vehicles / raid our house to press more charges to cover up the current ridiculous charges or substantiate their current charges.

Its now moved from "How far are the police going to go to nail my ass" to "How far WON'T the police go to nail my ass" under my roof - Awesome! :laugh:

Sorry to say, but I think you did a number of things wrong.  I'm not an expert but I'll tell you what I think I know.  It wasnt a traffic stop so you probably didn't have to hand over your info; many states aren't stop and identify states, so they can't expect you to hand over your info.  Field sobriety tests are complete crap; the cop can say whatever he wants to show you failed.  Never agree to do one.  You should never talk to cops.  Full stop.  You slso shouldn't have signed anything.  If it's all bullshit, another bullshit charge won't matter and now you have a fight to negate what you signed.

The good news, if you're in the states, is that you have actual rights.  I'd try to find a civil rights lawyer as yours may have been trampled on.  Maybe try contacting The Civil Rights Lawyer on Youtube as he may be able to point you in the right direction.

I appreciate the response BikerB, I'd like to just contrast what I think I also know for greater legal minds to possibly comment on which understanding is correct.

This one it kind of seems like depending on who you ask you get a different answer when it comes to being found sleeping in a vehicle with the keys to operate it within your reach.

I've actually dozed off a couple months ago in a parking lot waiting for an order, was woken up by a police unit driving by, who only stopped to ask if I was medically OK and then told me they'd prefer me parked and sleeping than swerving around falling asleep on the road.

I couldn't agree with you more on them being shit, I'm not sure where refusing one lands legally, unfortunately I was not asked to conduct a field sobriety test in this case - When I told the cop I didn't consent to a search he simply took his pen out and told me to focus on the end of it.

Does me not giving verbal consent to a field sobriety test invalidate the arrest entirely? I sure hope to come back to this thread and say fuck yes it did, though I am not sure at this time. I will come back to answer that some day hopefully soon.

Agreed, though in this situation, I don't know that anything was stopping this asshole from hauling me off to jail. The longer I remained respectful but mindful of my rights / him crossing his boundaries during the encounter, the faster he grew impatient with me, and the faster he got to putting me in cuffs to get the burden of probable cause off his shoulders.

While I agree with this in hindsight, I'd hate to have suffered through a bunch of bullshit policing only to get snagged by the single non-bullshit steps in this whole encounter, if there was such a step the entire time.

I do appreciate the input as it helps me think through my encounter more thoroughly then just replaying what I think I already know over and over, and highlights of the stop to discuss with an attorney, thank you again for your thoughtful response brother man +5 :mushroom2: to you!

I've replayed the arrest a billion times in my head thinking of where I went wrong or the officer went wrong, and I am actually not terribly disappointed with the bumblefuck of an encounter and the following charges have likely made my attorneys job a breeze getting that whole shit pile laughed out of court.

He actually left the tiny little roach from the ashtray in my vehicle as well, the one that had me completely impaired, the fucking idiot :facepalm:

A negative tox screen should help a lot.  I'm very interested in what a lawyer would say.  Maybe post it in enlil's Ask an attorney thread to start.  He's a fantastic help.

Damn dude, thats fucked!

Sounds like a bunch of dirty cops "trapped" you. The legal system is corrupt as fuck. What may happen is they get the benefit of the doubt while your fake charges are seen as valid. Hopefully not the case but could happen :nonono:
