just had house raided by state police looking for firearm.

and they stumbled upon the mushroom grow.  they never said anything they had a hard on for the pistol which isnt here. 

they pulled the PC out of the closet and could clearly see 4 bags fruiting and about 3.5 dried sitting out on nightstand

never even brought it up they just wanted pistol.

never gave much back to community but i feel someone could benefit reading this,

ive grown for years being sketch about personal grows but w/e now

A little confused, is this a cannabis grow or a mushroom grow?

Either way sound like you should clean house and stop growing.

I am not a lawyer but it sounds like they found drugs in plain view while executing a search warrant. Just because they didn't arrest you on the spot doesn't mean they won't tell the drug enforcement team to pay you a visit.

fixed original post, it is a mush grow and no im not worried if they wanted it they would of took it as evidence on the spot or even asked questions about it.  im sure they made calls to see if they were interested  either way not worried about it at this point in my career just growing for personal

thing im most bugged about is my girl ate the 3.5 and has been gone 24 hrs with my car:curbyourenthusiasm:

I think you should be worried unless you are in a locale that has deprioritized or decriminizalized. 

From what I read police work in task forces, you were raided by a task force focused on reducing illegal guns.

They will file a report on the search and that will include the fact they observed illegal drug activity.

The report then goes to the drug task force and they can do nothing or they can take it to a judge and come back again with a warrant to search for drugs.

The gun task force could even request that the drug task force do this so they can hem you up and get cooperation on the pistol they originally came looking for.


Idk you do you but I would clean house, better safe than sorry.

i feel like those calls were being made while i was still in custody no? why allow me to get out and destroy evidence?

They may have not wanted to do the paperwork associated with seizing evidence for a crime outside the focus of their task force or they may not have known the law around mushrooms.

Don't underestimate the power of lazyness and ignorance among govt workers.

Like I said you do you but I would clean house and sit tight for a little while.

If the search warrant was only for a firearm they can't do anything about the drugs until they get an additional warrant for that. Clean house dude.

Wrong. Anything discovered either in plain sight (the eighth on the nightstand) or while looking in a place where they might find the subject of the search is evidence.

The classic test is a search warrant is issued for an elephant;

The police find drugs in a desk drawer. This is inadmissable because there is no way that an elephant could be inside the drawer, ergo the warrant did not allow search of the drawer.

The police find an illegal cannabis grow in the large barn outside. This is admissable because they discovered it while searching a place the elephant could have been.

In this case the bedroom and closet both could have contained the pistol for which they had a warrant to search.

i know ive been taking everyones comments into consideration.  im also thinking they may of not thought they were of the illegal kind?  since they left the 8th just sitting on nightstand instead of grabbing for testing.  all criticism is apricated

Ive had a similar situation where they had a warrant for one thing, saw something drug related when serving the warrant, they didn't do anything at the time (just like your situation)... so I cleaned house... Waited and thought they had moved on/didnt care, but they showed back up a few weeks later with a new warrant... I was sitting back thanking the higher powers that I cleaned everything up and the second search found nothing..

So, i know everyone has already said clean house, but I wanted to let you know that from my experience it's better safe than sorry.

If I was a cop and I saw something during a search I would assume the person cleaned house immediately after we cops left.  So I would sit back and let enough time pass to let the person assume the coast is clear and fall back into their ways.  Hunting 101.

The shortest period in the linked article was 22 weeks and the longer ones were on the scale of years.

It has been only a month since OP's first post so nothing is stale at this point.

And I am sure OP doesn't want to drop thousands on a lawyer to get the search tossed based on staleness so unless you are putting up his defense fund Alan this is pretty bad advice.

So much depends on local jurisdiction/politics. And while arrests are sometimes used as a method of social control, actual charging documents are almost always somewhat political. Unless it's some place that's still worked up about "dope-smoking hippies," or still sad that they can't bust kids on dead tour anymore, mushrooms simply don't check anyone's boxes.

I heard a story about a weed grow that got raided at someone's house, where they were also growing shrooms. Nobody home at the time. Seized the plants and lights, but just sort of kicked over the shroom grow.

They left a message for the guy telling him that they had served a warrant for his weed, and that he needed to turn himself in. They also mentioned in passing that they "found something else, didn't really know what it was, but just stop doing that too, OK?"

I've heard similar enough stories about pretextual traffic stops that lead to drug searches. Same utter lack of interest in pursuing potential hallucinogenic mushrooms.

I think their attitude in a lot of places is that, regardless of how much they suspect they're looking at illicit mushrooms, actually determining/proving it is going to be a giant pain in the ass (no field test kits, etc.). And since they're not likely to be running up the supply chain and taking down kingpins, or seizing huge piles of cash and other assests, it'll just end up costing the system money. For something that literally got added to Schedule 1 as a half-concieved afterthought.

I always think about the absurdity of the situation with the spore trade. If anyone higher-up, or with any political clout, actually gave a shit, then spore sellers would be the first to go. Or be shut down by new laws.

On that note, PF's account of getting busted by the DEA is a very interesting and informative read. Probably the highest-profile federal shroom bust ever, and that only came about because dude was advertising in High Times and sending people instruction booklets at the height of the Bush Jr. Administration. Though what probably drew attention to him was just all the oogles being sketchy and fucking up their addresses, which led to a bunch of random people contacting postal inspectors when they got "syringes of drugs" in the mail.
