Jan. 11—COTTONWOOD COUNTY —

Three counts of fourth-degree felony drug sale were filed against Lakefield resident John Spillman, 33, for allegedly cultivating mixtures containing psilocybin or psilocyn, a Schedule 1 controlled substance.

On Dec. 12, a Mountain Lake police officer was informed by a reporting party that mushrooms were being grown in a closet at a Mountain Lake residence. The reporting party supplied the officer with photographic evidence of glass jars described as containing black and gray looking sand. The reporting party believed the jars were being used to grow "magic mushrooms" because of a conversation reportedly overheard between Spillman and his girlfriend.

A warrant to search the residence was granted and executed the next day by law enforcement. Spillman reportedly told one officer he was growing "gourmet mushrooms" that he ate and gave to co-workers. Law enforcement located several mason jars of soil, plastic containers with white moldy substance, and materials used for plant cultivation in a basement storage room. The jars were labeled with various common names for psilocybin mushrooms.

According to the report, law enforcement recovered 35 mason jars with suspected psilocybin mushrooms growing in them and 46 plastic containers of white moldy substance. Eleven syringes and plastic bags labeled "For Microscopy Use Only" were also located. Seven of the syringes contained clear solutions and some were labeled as "psilocybe cubenis."

Also found during the search were various paraphernalia items and apparent marijuana plant seeds as well as some packages containing stickers of cartoon characters and stickers with vendor logos on them, all addressed to Spillman. Packages contained swabs reportedly labeled as spore samples were also located.

In Spillman's bedroom, two notebooks were recovered containing several names of different spore samples, names of possible suppliers, and what appeared to be a recipe.

If convicted, Spillman faces a maximum sentence of 15 years in prison and/or a $100,000 fine for each of the three felony drug charges. Spillman was issued a summons to appear in court on Jan. 25.

This is why I always think it's a bad plan when people on here say they'll just claim it's gourmet mushrooms. The cops are never going to believe that. Even if you had real gourmet mushrooms, they'd still think they were psychedelic. Cops imprison people for stuff that just looks like drugs (but isn't) all the time.

It doesn't sound as if there even were any mushrooms found. And the poor guy is still potentially looking at 45 years. That is so f'd up!

Be careful who you show it to.

No one is going to know you're growing mushrooms unless you sell them or talk about them. This person went so far as to pretend to be a friend to go in and take pictures.

What motivates someone like that? Did they really just think they were doing a patriotic duty by helping the arrest of a mushroom seller? You don't even get a payment or reward for turning in photos like that. What's more likely is they did it to settle a personal grudge.

They do shit like that, compound charges.  For instance you get caught with shrooms, felony posession, felony amount (with weed etc), intent to distribute, felony.  They slam fuck you with felonies in hopes you’ll just plead guilty, take one felony directly up the anus and then they point and laugh as you leave the building.

Stupid.  To get a warrant a judge of course has to sign off on it.  To say it was gourmet is inane as is talking like that when dealing the mushrooms.  That is all they are mushrooms, just ones society and government has made it out to be like crack or such.

He learns the hard way.  I did with lsd but never dealt it, just wanted to enjoy it and a 3rd degree felony and a really shitty time in County and 10 years of probation and the fines. 

That is what bothers me so much is the mass conditioning of idiots in society about "drugs".  And how law enforcement takes advantage of one's ignorance of it and the laws.  I learned the hard way as well long ago but fool me once...:finger:

Hope he made enough from his "drug sales" to get a good lawyer.  Another thing I learned at a young age, Public Defenders are overwhelmed and don't give a shit and a judge gives so much more respect to one "criminal" if you have a paid for lawyer and with the fine and paying for piss tests and the great honor of taking my time and money to do so and to see a probation officer, let alone how hard it was to get work and the shame and just outright rejection when meeting with human resources and, he is a good guy, we look forward to you working here to, complete shift, he is a criminal and has a felony.  We are sorry.  Will never forget that level of coldness though I forgive it.  What is the point of holding onto it when one has wisdom and understanding of the system?

Best to him.  His life is really going to suck for awhile.

Have all spores labeled with coded gourmet species

doubt it would work since they can test mycelium but its a worthwhile step

If they get a warrant it won't matter but for the normal grower, good advice.  And of course, watch what you say as apartments are garbage for sound control just talking, let alone with music, t.v. sound system.  Lol. 

I just keep a fan going constantly.  Blocks it out to a degree.

That's retarded how much he's being punished for growing mushrooms.
Whoever passed that law and made the penalties so harsh is clearly corrupt as fuck and only cares about money.
People like whoever made the penalties for growing mushrooms so harsh are the kind of people that are ruining the world with their ignorance and childishness.
They should be locked up and never be in a position of power again, because they are absolutely insane.
