Mandatory Minimum Sentences

I'm doing a speech for my Public Speaking class on mandatory minimum sentencing, particularly for drug offenders.

I am curious on your thoughts about it.

For anyone who doesn't know what it is, here's the basics:

Mandatory Minimum laws are automatic sentences for criminals. You do not get the chance to have a judge look over your case, or to have other circumstances considered. If you get convicted of the charge, you do time no matter what, even if it is your first offense. The taxpayers pay for it. It causes no apparent reduction in crime, and it is focused primarily on small-time street dealers or just plain old users. And as I said before, it removes human judiciary consideration from the sentencing.

I guess in New York, if you are caught with 4 oz. of cocaine you will do 15-25 years minimum on first offense, about the same as if you murdered someone I think. That might have been repealed though... I'd appreciate any up to date statistics from you guys.

In a strict cost benefit analysis, there is no reason for drug prohibition. And thus no reason at all

Mandatory minimums: When the legislative branch of government removes sentencing discretion from the judicial branch. So much for an independent judiciary...  :shake:

There is an interview with a guy in that documentary 'Snitch' where he says something like "The biggest regret I have in my entire life was helping write those laws"--pretty crazy, how often do you hear of a legislator regretting a law so greatly? he said they wrote it to score political points after a draftee for the local Boston Celtics had died from drugs making it a huge issue for his constituency in the upcoming election.

Couldn't this be killed by the courts? On the grounds of speration of powers? Checks and balance? Doesn't the court have the power to say how much time someone does?

Maybe they dont, I'm just assuming so because thats how it was done in the past.

Some horrible judges have actually gone against those minimum sentences and given evil drug users less prison time :shocked:  .  fortunately, savior john ashcroft is making a list of those judges  in order to force their compliance.

state law in pa has a school zone clause.

sell drugs within 1000 ft. of a school zone and it's a mandatory 2 years upstate. "school zone" includes, in addition to actual schools, daycares (making many churches and some office buildings, grocery stores, etc. 'school zones) and university campuses.

so basically if you sell drugs in any place that is remotely populated, it's a mandatory 2-4 in the state pen, no matter what the amount.

they use it as leverage to get plea bargains. you don't fight delivery charges around here. you take what they offer you. it's sick.
