The checks and ballances that prevent any group of people from becoming the sole arbiters of the way we live are being dismantled - the PATRIOT act allows the exectutive branch to act without judicial oversight, and this bill would remove the judiciary check on the power of the legislative branch.

And those fuckers complain about activist judges. If this passes we'll have an activist congress.. and I don't think it'll benefit anyone but themselves and their special interests.

Not only would it allow the legislative brance the to operate without judicial oversight, it would allow congress to overturn any SC decision it found not to be in the best interest of the country. Congressional overturn of Roe v. Wade, anyone?

All the more reason - it is imperative not only to remove Bush et. al. from the White House in November, we must take back either the House or the Senate as well. I hope some of y'all are working half as hard as I am to get this done...

while reading up on this I came across the following passage from the constitution....

"The Supreme Court shall have appellate jurisdiction, both as to law and to fact, with such exceptions and under such regulations as the Congress shall make.?

So basically, congress can tell the Supremes they may not rule on certain issues.

There has to be a case in the courts for it to reach the Supreme court. I don't think it's possible just to decide that a law is unconstitutional and appeal to the courts to stop it - there has to be a specific abuse in question.


For example, the PATRIOT act is written in a manner to make it very difficult to challenge in the courts. The ACLU is suing, but read this:

That is hardly true. Some Christians have decided it is ok to force their beliefs and morals on others. That is hardly supported biblically. I view what they do as a perversion of Christ's teachings.

incorect... the bible supports the complete and total anhialation of anyone that does not believe in god... Noah and the Flood, Sodam and Ghamorah, babelon are just a a few of the examples in which thos that dont believe in god are destroyed....

If this passes, and I sincerely doubt it has a snowball's chance in hell, somebody will immediately challenge it the first time it is enacted.

You know, I don't share this opinion, but a very strong argument can be made that the Supreme Court, a group of 9 unelected and virtually unaccountable men and women, have usurped far too much power from the electorate. They have essentially invented a constitutional right to privacy (which I am very happy about) in Roe v. Wade and which continues to grow, finally. They could easily turn and not become so freedom friendly. And then how would we get rid of them?
