Hiring an employee

I have a small farm that is just the wife and I.
The time has come that I need to hire a part time helper. I'm thinking around 15 to 20 hours a week. I'm pretty new to this and was wondering what I need to do to make this legitimate. Do I have to pay workmans comp? Get some kind of tax number for him?

We are officially a farm with a farm tax exemption on our consumables if that matters

Your farm should be turned into a business, biz licence, tax ID # etc. Run the farm like a biz. Insurance, overhead, payroll, vehicles, accounts receivable / payable.. run the farm as a business.  Even if you declare a loss, it's fine.  As a small biz, you really don't want to show much profit,for tax purposes as you can deduct almost everything.

It is run as a business as you speak. I've just never hired an employee and am not sure what that entails

Depending on your state, part time employees aren't entitled to much, however you will need insurance, and if the employee is paid on the books, you will most likely need workman's comp. Workman's comp is pretty much mandatory. It is expensive, but can protect you in the long run, if the employee gets disgruntled and wants to sue you for a bad back, or wants 4 months of pay because he threw his back out.  Be surprised by the actions of some folks, regardless if friends, family, or strangers. End of the day, protect yourself self and business assets.

I’ve done farm work like what your talking on a few farms, and the best run ones gave me a 1099 and were upfront about that before I started.  I wasn’t covered by any comp, and I could write off a lot of my own tools that I would bring.

You may also need to register with the Department of Labor, or similar office, with your state. The paperwork I was sent said within 10 days of hiring an employee, you may also consider the contractor route, less hassles TMK.

The amount of hassle required to hire people is precisely why I'm automating from the start, no employees here, ever.
