I got one last year for marijuana in California in March 2019. The arresting officer took forever to file the charges so I was Scott free for 9 months. They don't suspend licenses for weed dui's until after the conviction. Got a lawyer in sd county (Hands up to Dod Law for a good plea deal) (I no longer live in sd county by the way and not in oc either). My license was suspended 1 month and then restricted for a year, and the restriction ends in just a couple weeks. I'm glad I had a license restriction during a pandemic because I have no reason to drive around anyway due to the quarentine.

It was my bad, I was smoking in my car in Orange county on the freeway and I accidentally had my hazard lights on. Oc cops (especially chp) and judges are hard on dui's. Breathalyzer was 0% for alcohol,I ended up having 17ng of thc per ml of blood, which is A LOT but I was barely high because I only had a few hits. Colorado's legal limit is I think 4ng.

My lawyer got me 49 hours of community service IN LIEU of a $2,000 fine, so instead of a fine, I only paid a booking fee of $434. I did the 3 month dui class, along with the license suspension/restriction which ends this month.

All in all, I'm not proud of it, but it really allowed me to reflect on my past drug use as it pertains to driving. I drove a couple times on acid about 13 years ago, once on shrooms 13 years ago, drunk once a few years ago after bar hopping in Hollywood, nearly daily on weed which led to my dui. I guess I was destructive. Even though nothing bad ever happened, no accidents. The time that I got my dui was the worse time in my life, I was extremely depressed and I thought I was going to end up killing myself eventually. Well I'm probably happier now than any time of my life even though things aren't super ideal. I'm trying to find peace and move on from that chapter of my life.

I actually got one for adderall believe it or not. Long story short, I was 17 and dumb. In my state at the time you didn’t get in much trouble forn1st time DUIs.... so it was just like some traffic school stuff, a small fine, and you could only drive at certain hours for a couple months or something. Might have lost my license for a little bit but don’t remember.

I have fun quite often but the one thing I don’t do anymore is drive around while doing so. Can completely ruin your lives and others lives. Glad it’s over with for you man

There needs to be an acronym for texting drivers. Maybe a DWT. Just as bad as DUI, take away their licences. I would, I got hit by a texting driver and nearly died.

Its called distracted driving here and if you hit someone that's reckless driving or manslaughter. which is the only actual crime that occured. I hope you get a bullshit DUI or your license taken away for texting and driving too. I hope you lose your license and can't get to work so your you can't feed your kids your wife leaves you and you lose your housing for texting on your phone. I hope the whole economy tanks and we live in some hyper nerfed nanny state after nobody can drive for texting. Cuz we all know how effective these laws are at actually preventing crime. Oh wait statistically they're next to ineffectual and are essentally just largely used to generate money and fuck with people.

I got one when I was 20. It was NYE and I was driving sober to a party with 8 xanax bars in my shirt pocket (no, not all for me). I clipped a curb make a right turn and got pulled over. I immediately popped all the xanax because I wanted to avoid possession. I figured since I was sober I'd be able to get away quickly. But they performed a whole field sobriety test. I was fine throughout most of it but they started hitting at the end. At the end they checked my eyes and asked me to do some cognitive stuff while standing still which I could do. But then they told me I could go back to my car... and while I was walked I stumbled and fell. I tried to get up and stumbled again.

They were confused. One cop was like "man you seemed totally sober when we pulled you over, we were about to let you go."

I had to do some community service, pay a monthly $75 fine, and have a breathalyzer installed in my car for one year. Was a pain in the ass. It's off my record now though since it was like 11 years ago, I paid to get it expunged.

Never have, but I barely drive any more. My belief is that with chronic cannabis use you are always pretty stoned, even the next day. And that is likely what a blood test would reflect. Some would argue that x blood level doesn't necessarily mean you are impaired.

I forget some of you people live places where dui laws aren't ridiculous. In my state you don't have to even test positive for anything. They changed the laws after ppl kept getting in wrecks in wierd RC. The state just has to prove your impared which is essentially just the cops says your impared that it end of story.

Yeah that is fucked up if it's just the cop's word. Here they did introduce some fucked up stuff around the time of cannabis legalization to placate the MADD types.

I'm a daily smoker but I don't wake up stoned the next day. Within 2 hours after smoking I'm usually pretty "sober" again. Cannabis doesn't really impair me though, unless I'm extremely stoned I can function just fine.



That is one thing I worry about though since I always have THC metabolites in my system....

I haven't smoked at all yet today and I don't feel high or stoned in anyway at all right now...but since I've been a daily smoker of cannabis for years now the levels of THC and THC metabolites in my blood/system are likely always beyond the legal limit.

So even though I'm 100% sober and not impaired at all right now, even though I have not put any drug into my system today, according to the metabolites in my blood I am likely far beyond the legal limit and could be considered a DUI of cannabis.

Most people who get dui's are NOT even actually intoxicated at the time they were pulled over. Most of the people in my DUI class were either slightly buzzed or not even drunk at all when they got pulled over but they still had a blood-alcohol content. Alcohol has a very deceptive digestion rate. All of those blood alcohol charts are also outdated and were created when a standard size alcohol drink was smaller. Back in the old days a standard alcohol drink was one quarter of a fluid ounce of 80 proof liquor which is basically a quarter of today's shots. At least this is what one of my teachers from DUI school stated.

Nowadays, with today's drink sizes (12oz beer, 5oz wine, or 1oz of 80 proof liquor), it actually takes 2 hours for a standard drink to fully digest, but that 2 hour number goes up exponentially the more alcohol you have. A lot of people who blow .2 or higher are either not drunk at the time or just barely buzzed. People who blow a high number like that were more than likely drinking throughout the entire day but not really getting drunk like only drinking one or two beers per hour but the way alcohol digests, it never really leaves their system and it just keeps accumulating. All of the people who blew .2 in my DUI class were not drunk at the time but they did report that they had been drinking nearly all day but not getting drunk like just having one or two drinks per hour. The reason they got pulled over was because they did something stupid like blowing through a stop sign or not using their turn signal or just something dumb and pretty like that.

based on this information, if you get drunk, you should probably just wait a full 24 hours before driving if you don't want to risk getting a DUI. especially all you people who love to smash down eight or more beers in one sitting.

There was one girl in my DUI class who had been awake since 3 a.m. for work and at the end of that day her and one of her friends went to a bar and had three drinks. Only 3 drinks. She waited a few hours until she didn't feel buzzed whatsoever anymore. By this time she had been awake for 24 hours. On the way driving home, she fell asleep at the wheel and rear ended someone. the reason she fell asleep at the wheel was because she had been awake for 24 hours, It had nothing to do with the alcohol. So she wasn't even buzzed at all but guess what she blew on the breathalyzer? .08%, gee, just the limit and she wasnt even fucking buzzed in the slightest. This is why most DUIs are bullshit.

The night I got arrested, literally the only reason I got pulled over was because I accidentally had my hazard lights on. The cop lied on the report and said I was swerving but I swear to God I was not fucking swerving. I failed the field sobriety test because it was fucking freezing that night and the cops made me do all the bullshit without a sweater. I was also wearing the cheapest sandals you can possibly get from Walmart. My lawyer told me that all of the field sobriety tests are a bunch of biased bullshit and that even a lot of people who are SOBER cannot even do them. They are designed to be failed easily.

By the way, for marijuana, they only charge you for the amount of ACTIVE THC in your blood. They do not charge you for the amount of metabolized THC. They can tell the difference when they do a blood test. I lied to the cop and told him that the last time I smoked was two hours prior to getting pulled over but based on my blood content, my lawyer knew for a fact that I had literally just got done smoking or smoked way sooner than just 2 hours. So with a blood test, they can tell if you are high or not. If you are not high then there will be zero ACTIVE THC in your blood but the METABOLITES of THC will be high but you don't get charged for already digested THC because technically it takes 30 days for THC to leave your system so all they know is that you could have smoked weed 30 days ago. ONLY the ACTIVE thc is considered in a conviction. 

And 99% of the time you can bet that the cop is going to lie through his teeth and make things up on the report.

Oh and I have had way more close calls regarding getting into a possible accident due to texting and driving as opposed to being high and driving.

also, the average amount of times that a person drives intoxicated in the year before they get caught is around 80 on the low end and 100 on the high end. what this means is that any random Joe schmoes that you pull from the population has probably driven intoxicated 80 to a hundred times or more in their lifetime.

And also there was a dude in my DUI class who had a few drinks at a cheesecake factory restaurant. When he left the restaurant in his car, he made a "wide turn" when he pulled out of the restaurant driveway and he got pulled over instantly. Cops like to hide places where there are nice restaurants where people get drunk at and they will just wait for somebody to make a wide turn or not use their turn signal or something stupid.

so you should be driving as if there is a cop hiding somewhere at any given time.

Man.. I used to be that all day every day smoker. I remember driving over the grapevine at night, and going 100mph while hitting a bowl :lol: So I can't judge anyone. But honestly, kids, it's not a good idea.
If I'm planning on getting fucked up at all, I ride my bike or take an uber. Way less stress.

No. Never driven drunk and I make sure me and my friends never get in cars with drunk people.

Weed is not as impairing as alcohol. I still don't drive until I've waited 2 hours after smoking. But there is no law about what constitutes impaired driving on marijuana so they could probably pop you for driving after smoking 12 hours ago. who knows.

That is one thing I worry about though since I always have THC metabolites in my system....

Yeah it probably varies by individual metabolism. When I smoke chronically, I feel "not stoned" after x amount of time in the sense of feeling like I would be more stoned again, but the permafog is always there.

Good question. No it does not count if it does not kick in by the time you take a blood test. I took a Seroquel pill right before my drive because I wanted it to kick in by the time I got to my destination so I could go to sleep. The cop asked me if I took anything recently besides weed and I told him about the Seroquel. I probably should not have told him but even after I got to the station and did the blood test, no Seroquel showed up in the blood test. They did a specific test for Seroquel that they probably would not have done had I not told the cop that I took it. So I did not get charged for the Seroquel. Only the weed.

I've had 3 DUI's. One was straight up legit and I'd just gone out with the missus for a few, closing time came and we stupidly left first. Pulled out of the pub and got stopped immediately, blew 0.11. Copped a fine and 3 months suspension, which I didn't really care too much about because I was working at sea. But fair enough. I learned my lesson. I decided never again.

Years later got 2 bullshit ones though.

After one beer I got stopped for some bullshit reason and blew 0.02. I'd moved states the year before though and when I'd sold a vehicle before I moved the paperwork went wrong, but I didn't know because I wasn't there and I got a fine. Not knowing about the fine I didn't pay it so my licensed got suspended. Legal limit driving on a suspended licence is 0. Magistrate didn't care about any of these circumstances, 3 months suspension, big fine, community service and a year provisional to boot.

11 months into my provisional I got stopped at 6am driving to work. Blew 0.01. Provision said I must be 0. Plead my case in court, explained that the provisional licensed and last DUI was bullshit to begin with. Magistrate was actually pretty cool but also said his hands are tied, that he would chuck it out, but there's mandatory minimum sentencing laws on DUI. Lost my licence for 6 months, copped a fine that was reduced to some cool community service... but when I got my licensed back had to have this stupid machine in my car for a year that I had to blow into to start and blow into every 15 or 20 minutes while driving, to make sure I'm not drinking. Was fucked up bullshit with that stupid machine.

If I ever get another DUI I'll probably see a bit of jail as well as losing my license for years and all sorts of evil mandatory shit politicians have cooked up for repeat offenders.

Ya I actually have two but didn’t want to admit it. No real excuse but I was making bad decisions going through some legit depressing stuff. I got some jail time, then Huber, then house arrest didn’t a few months and a big fine. That was after paying 5k for a master which I honestly couldn’t afford it all so I got some help.

The fourth DUI is a felony. Just wait 24 hours after your last sip of alcohol and you will be fine. You can have a bac even if you feel completely sober and literally are not buzzed anymore. That's why so many people get duis. They are sober but don't realize how long alcohol takes to leave your system and they get busted with a .01 or .02 and cops don't mind throwing people in jail for the slightest things. You reach the legal limit pretty fast and waiting until you're sober is not long enough for all the alcohol to completely digest. However many drinks you have, you should wait at least 2 hours per drink before driving. 4 drinks means you should wait 8 hours after your last sip.

If you are the kind of person who can drink a whole 12 pack or even a 24 pack in one sitting or in one day then you definitely should not drive for at least a FULL 24 hour day or two if you don't want to blow any blood alcohol content. This is what one of the teachers in the DUI school said.

Yeah it's different per state. In California at least, 4th dui is a felony. And if anyone dies you get charged with manslaughter/murder.

I would rather drive a Lexus than a BMW or Mercedes. They are just as reliable as a Toyota but only with a performance engine and more expensive.

I knew a guy who had 3 if I recall correctly. Had to blow in one of those breathalyzer things just to start his car. He also had several drug possession counts on his record for good measure. Public intox arrests -- the whole nine. He was a severe alcoholic from high school on. He was a nice guy but he just couldn't shake his demons on that front. He lost job after job because he would show up to work completely hammered. Shit he would drink at work from what I heard. Sneaking off to the bathroom and pulling swigs off a flask.

In his late 20's he was driving (with a suspended license), drunk, and was going home one night at like 2 in the morning. He swerved into the wrong lane and hit some poor girl head on. She died. He survived and was charged...with intoxication manslaughter I think. Because of his extensive history they threw the book at him and he got like 30 plus years.

On myself long after I would technically be "sober" when I do drink.  I'd have to agree with the guy talking about what the DUI teacher was saying
I got 1 when I was wrecked  on Xanax and heroin.  Hit a curb and disabled my car.  Cops showed up

It's 9 months jail here in my state in Australia for a 3rd low range DUI. But it is in a 5 year period, not over a life time.

High range offences, like if you are driving completely smashed drunk, unable to walk, and drugged at the same time will probably see you in jail for a first offence. People die because of that sort of behaviour and you won't get much sympathy in a court.

Teachers at DUI school are like DARE teachers, not everything they say is based in reality. The human liver can process about 10g of pure ethanol per hour. It will keep working until all is processed. Extra drinks just queue the work it has to do. If you get home after work at 5 and drink 10 mid range beers you are definitely going to be alcohol free by 5am the next morning. You will probably feel like shit and be hungover, but you won't be drunk.

So 24 "standard" beers will put you over for 24 hours, but 12 won't.

Understanding how much alcohol is in a drink is important. There's calculators online to help with that shit if you ever wake up hungover and are worried about DUI.

You misunderstood me. Every standard drink takes 2 hours to clear your system. 12 beers will put you out for 24 hours, driving-wise, 24 beers will put you out longer than 24 hours. A lot of people get hammered at night and then go to sleep drunk and then get a dui the very next day with a bac. I can also tell you didn't read the entire thread, which is fine. The charts you see for bac are false and misleading. They were made in the old days when a standard drink was a 1/4 of what it is now.

My dui school teachers were NOT like DARE teachers lol. Last I remember, COPS teach the DARE program. My dui school teachers are all recovering alcoholics and have gotten dui's themselves. They were actually pretty cool. They didn't give a shit if we got off topic, which we learned we could do to make time pass faster. I was able to discuss openly my marijuana use and I even talked about a spiritual mushroom trip I had at the time. One of the teachers was native American and understood the peyote ceremony so she understood me. I actually kinda miss dui school in a strange way because it was the only place I could really talk openly about my shit and not be judged. You end up making buddies in dui school and you all offer advice to each other. Not all dui schools are like this. It was complete no bullshit open discussion.

Anyway, I hope you don't get anymore DUI'S.

Then added to those variables there are genetic and health variables that will effect the breakdown as well. Surprisingly alcoholics process and break down alcohol quicker than non addicts, this is how they can get away with drinking markedly more, amounts that would hospitalize ordinary people.

Alcohol is clearly a very dangerous and poisonous drug, I agree I overstepped the mark there comparing DUI counsellors to DARE fools, I apologise. Just the truth about what alcohol is and what it does is a horror show, there are no lies required.

I don't understand the context. It's very ambiguous. Is this binge drinking? Having a drink every day? Drinking all day every day? Alone it is not something that is meaningful.

Ex alcoholics are not always a great source of information on alcohol. They are as prone to bias as the next person, and having escaped an addiction does not make one an expert on the drug itself. This is coming from an ex alcoholic, you see.

I do like science for this sort of info though. Oftentimes more reliable.

What your liver processes and what you blow is completely different. Why are you complicating this? You can be completely sober but still blow a  .02. Shit that one girl still blew .08 even after waiting a few hours to make sure she wasn't "drunk."

I wouldn't rely on some calculator to tell me whether or not I'm going to get a fucking DUI. Honestly this is probably why you have three DUIs. Like you didn't learn the second time. Not trying to be rude or anything but let's just keep making excuses as to why it's ok to have a drink before driving. the legal limit doesn't mean shit anymore. A cop will charge you with a DUI with the .01 or .02 because if he doesn't take you to jail then he is liable if you get into an accident after he pulls you over and let's you go free with a bac of .02.

Back in the 70s, according to all the recovering alcoholic old timers, cops only took you to jail if you actually blew .08 or more. But then more people started getting into accidents after getting pulled over so now the cop just takes you to jail no matter what just to cover his ass. You could blow a 0% on the breathalyzer but if the cop thinks you are IMPAIRED then he will take you to jail.

Whatever man. I wrote in clear detail how and why I got 3 DUIs.

Alcohol isn't magical shit that stays in your system for odd reasons. It's just a chemical. It is removed from your system by 2 enzymes in your liver, and also breathed and sweat out to a much smaller degree. Your age, height, weight, sex and genetics as well as general health can effect the rate it is metabolized. That's all there is to it.

If you are breathing out alcohol it is because it is in your blood. If your liver is processing alcohol it is in your blood. If it's in your blood you are effected by it, whether or not you believe you are drunk or not is irrelevant. You cannot blow 0 on an accurate device when it's in your blood, physically impossible.

You can believe whatever you want, but that is the simple science behind it.

I think this conversation has become circular, so I'll not respond again.

I've been wanting to make a(nother!) thread based upon my opinion that people should never buy a Toyota/Lexus. Yes they have a long standing reputation for reliability but I firmly believe that Toyota ownership has a negative psychological impact upon the driver that extends into their personal ideology, not to mention being reflective ov poor taste. Toyotadopes are not only a scourge ov the roadways but potentially ov society at large.

I would'nt say that BMW lowered their standards for less wealthy people; they've long had entry level lines. BMW has a tradition for a high quality standard throughout their model range that's let down by overengineered complexity. What they have become is overly complex throughout the range and the horrible reputation for reliability is reflective ov their poor execution ov overengineering. Entry level BMWs used to be simple compared to their more expensive siblings. You can now have upscale BMW upkeep and repair costs with all their vehicles! The entry level BMWs used to be demonstrative ov their slogan, "ultimate driving machine", by closing the divide betwixt road and driver, and appealed more to those who wanted a car for the driving experience. The modern technology-forward(or backward!) approach ov BMW appeals to a type ov ignorant arrogance that favors the destination rather than the drive and thus the image over the experience. One who wants to be seen driving rather than be involved in driving. And in the case ov younger BMW drivers, this translates into a high prevalence ov arrogant roadway douchebaggery. 

Perhaps you're thinking ov the 1M. The BMW M1 was a cool ass car and a bright spot in BMWs lineage, however rare as they are. That car was capable and good looking, its styling blending the crisp Giugiaro design element as seen in the beautiful Detomaso Pantera with purposeful Germanic form.

At that point it'd likely be the cheaper option for me anyway, since I'm pretty sure my blood always has a lot of THC in it if they test it I'll likely be getting a DUI (which would be a suspended license anyway, along with tons of other fines).

I only drive a Toyota because it's the only car I can think of that will last way longer than 200k miles without anything major needing replacement. I'm honestly sick of Toyota because their cars are too simple and they have no pick up.

You won't be able to get away with that nowadays. All the cop needs to do is send a little text message to the judge and then the judge issues the warrant for your DNA. they get a couple of cops to restrain you and then they draw your blood.
