JACKSON (WNE) — Casey Hardison, an infamous DIY chemist and longtime advocate of psychedelic drugs, says the Wyoming Controlled Substances Act is unconstitutional — and he got to say so Tuesday in Teton County District Court.

Hardison said drug laws are “an assault on his due process and equal protection rights” protected by the constitution because the controlled substance act doesn’t apply to use of spirits, wine, malt beverages or tobacco.

“It is as if the majority is saying these are good drugs and those are bad drugs,” Hardison told 9th Judicial District Judge Timothy Day and 21 others during Tuesday morning’s virtual hearing. “It is precisely this kind of arbitrary, absolute power in Article 1 Section 7 the Wyoming Constitution prohibits. The act must be declared null and void.”

Hardison, 49, is in Teton County Jail awaiting trial on five felony charges of delivery of marijuana and aggravated assault. Agents with the Wyoming Division of Criminal Investigation said Hardison tried to run them over with his car during a botched undercover drug raid in Jackson in 2018.

Teton County Deputy Prosecutor Carly Anderson argued that Hardison’s opinions on the lack of constitutionality of the state’s drug laws are just his way of trying to legalize marijuana, which she said was a legislative issue.

“Defendant guises his case for legalization of marijuana under constitutional arguments,” Anderson wrote in her most recent reply in the court’s case file. “A review of defendant’s constitutional challenges will show he failed to meet his high burden of proving the unconstitutionality of the Wyoming Controlled Substance Act and the court should deny his motion to dismiss.”

The Wyoming Supreme Court has suspended in-person jury trials because of the pandemic, and Hardison’s trial is scheduled for January.

He's a pretty well known LSD chemist who spent time in prison in the UK after getting busted. He's had several run-ins with the law since being deported back to the USA after serving his sentence.

Difficulty has more to do with reading abillity and ability to precisely follow directions. You need no knowledge of chemistry whatsoever, you just need to understand some basic principles as simple in concept as: water boils at 100C and freezes at 0C. Otherwise all published syntheses of organic and inorganic compounds can be reproduced successfully by pretty nearly anyone with at least average intelligence. Problems always have to do with availability of materials, not esoteric knowledge.

Yeah, went 70% to ~25% Trump to Biden...and a perfect illustration of how fucked our government set up is. Wyoming gets 3 electoral votes with just over 250,000 people voting, Michigan gets 10 electoral votes with over 3,000,000 people voting...I know its based on population, but not going to take the time to look it up, you get the point. And its the same deal in the House, regarding number of reps.

The two years I spent out there were enjoyable, for the most part. The scenery is amazing, the people are pretty easy going, for the most part. They do have a serious gun fetish, but I've never been one to shy away from firearms. The only real gripe I had, apart from the nonstop cowboy/rodeo thing is the political landscape. They definitely have some catching up to do. I'd return there to visit, but you'd be hard pressed to get me to pack up and move back out there again.

I've been around the city my entire life (besides those 2 years) and the coolest thing for me out there was driving down these super remote roads in the middle of nowhere -- I would just pull over and walk around for a bit and it was the quietest quiet I have ever heard in my life. You couldn't hear a single man made thing anywhere. Just the wind and the occasional bird squawk. I also have a picture of a bald eagle I took back then on one of those lonely roads that was just sitting on top of a pole watching me. I'll try and see if I can post it.

What part of WY were you at?

Very curious to hear how this pans out, gonna be thrown out more likely than not but still good progress, and there is always a chance the judge sees reason or is a bit more open minded. And then that would be one hell of a precedent set.

JACKSON (WNE) — About a month after being arrested in California on a Teton County warrant, Casey Hardison is back in Jackson and ready to represent himself on five pending felony charges.

Hardison, an infamous DIY chemist and longtime advocate of psychedelic drugs, was extradited back to Jackson to face charges that stem from a botched 2018 drug bust with the Wyoming Division of Criminal Investigations that led to a high-speed chase through Jackson.

After being booked into the Teton County Jail last week, Hardison appeared Thursday afternoon in Teton County Circuit Court, where he told Judge James Radda he intends to represent himself.

“I am well versed in my rights,” Hardison said.

Hardison also made an oral motion for discovery, including camera footage from his 2018 interaction with DCI, dispatch logs, forensic reports of the chain of custody of the marijuana from the exchange, and lists of witnesses the prosecutor intends to use.

Hardison was wanted on a $500,000 arrest warrant in Teton County on charges of delivery of marijuana and aggravated assault and battery from that drug bust. DCI agents said Hardison tried to run them over.

Hardison said he thought he was being robbed. According to court documents, agents with the Wyoming Division of Criminal Investigations tried to arrest Hardison in an undercover drug sting. But the raid left Hardison with $6,000 of government cash and the cops with 2 pounds of marijuana.

Of which I am aware, noone particularly voted on the Wyoming Controlled Substance Act, and noone realistically cares about your blood chemistry, so long as you're not being a pest. Which nameable person is the victim, and what are the damages.

I spent my senior year of high school in Wheatland and I went to LCCC in Cheyenne for a year. My brother was with a chick whose family owns a ranch up around Laramie Peak, so I got to go up there quite a bit. It's absolutely gorgeous in the mountains and it's really cool when you see big herds of elk and antelope.
