i was at my senior party two nights ago and around 35 kids got busted up by the local pigs. well, all they did was take down our information (name address phone DL#), and ask if we would like to take a breathalizer. no MIP's were given out that night.
i refused to take a breathalizer. i figured "well.. he's asking me.. so i have a choice.. no thanks!", whereas almost every other kid took one and failed miserably. apparently they're going to send our information to the county attorney, who will decide what happens to each of us. since it was such a large number of kids drinking, and this is my first offense, i'm hoping i'll get off semi-easy..but who knows..
one other important fact: i told the cop that i had had 'a beer or two.' he was hassling me like mad and in a drunken stupor i admitted to it.
my question is... is it smart to refuse taking a breathalizer? i was much drunker than 'a beer or two,' and wasn't too interested in knowing the alcohol content in my blood. however, the cops only think i drank 'a beer or two' and have no evidence to prove otherwise. but i guess because i was there, i'll get an MIP anyway.
actually this just turned into more of a story than a question but i'll post it anyway 
also.. the cops called everyone's parents (even those of us over 18) and had them pick us up.. i was planning on sleeping in my car with my keys in someone else's pocket... but alas..

If they have no proof that you were drinking...LIE.....and since you already admitted to having" a couple"...LIE...and say that you never said that!!...NEVER ADMIT !!!

well it's already been said.. and it was immediately written down after i said it (in quotes by my name.. 'had a drink or two').. but won't i just get an MIP for being at the party anyway?

Does Nebraska have the Zero Tolerance laws when it comes to underage drinking? If so, they could give you an MIP for being there. They have such laws in Iowa where they don't even have to prove you were drinking. If you get caught at a party with alcohol, drunk or not, you are charged and your license is taken away. I didn't grow up in NE so I'm not sure of the local laws regarding underage drinking.

hmm..yeah.. i just looked into that lightly and i think we do... 'doh!
also... im thinking about going to florida for a while.. is it necessary for me to wait around until i get a ticket to go down there? i'd be visiting a friend and probably pretty hard to find... is this highly illegal?
they mentioned nothing to me about what was going to happen in the future concerning the bust.. i was told by someone else that they were sending the information to the county attorney. so how could it be illegal to leave if i was never told that they were even USING my information ?

Don't do that, if you don't take care of the charge they'll put a warrent out for your arrest. It's not a big deal really, you'll just get a fine and maybe probation at worst.

i haven't gotten charged with anything yet. and i wouldn't be leaving BECAUSE of the ticket.. it just so happened that i got my information taken down days before i was planning on leaving...

well it's good to hear that you guys think that. hopefully i don't get diversion or probation, that's all i'd really be pissed about - since i'm trying to leave this state (and that would obviously prohibit me from leaving)

where i live you can only get probation or a record if you are in posetion. its ok to to walk around town drunk if you want after the party but if you have any booze on you under 21 you will get a mip and probation court fines ect...
and under 18 you cant buy cigeretts. but if you already have them you can smoke them as you please. kinda messed up if you ask me.

that's an MIPT (minor in possession of tobacco)...not a standard "MIP" which is assumed the cause of underage alcohol

I got an MIP when I was like 15 or 16... didn't hear anything about it... then one year later I got another one for possession of marijuana and alcohol... a few weeks later i got called in to a hearing, and it turns out that the old MIP kinda got lost, but then popped back up. Luckily I was leaving the country in 2 weeks, and so they only made me take some stupid class on "drug and alcohol awareness"

Well, the admission is enough to get an MIP. However, since it was such a busy night for the cops, you might be able to change your story and sya you never said that. Unless you have some weird bullshit laws, just being at a party does NOT mean you get an MIP. Good job turnin down the breathilyzer, not so good of a job saying you "had a drink or two" - in the words of the last cop I said that to "Well, that's enough now isn't it?"
Also, just because you haven't heard anything does NOT mean you got off. A friend of mine had a court appearance for an MIP, and when he got there found out they had tacked a possession of marijuana charge on to the list. He sure as fuck didn't hear anything until he was at the courthouse.

if you admit that you were drinking, there's no point in them even giving you a PBT. if you're underage, and admitted to drinking, the case is closed.

I don't know what all the big deal is. Here in Pennsylvania we got some really stupid underage drinking laws. Although the laws suck and you lose your license here if convicted, it's still not even a misdemeanor charge and is similar to getting a ticket. I managed to get one, but the charge was changed to disorderly conduct and we didn't lose our licenses. A house party got busted and we tried to duck out and should have made it but we got caught before we hit the woods. They busted about 20 people that night as well. Try to bargain with the magistrate or whoever you're going to see about the charge. Try to get some support from somebody respected in the community or try to plead that you're a good person, that's what happened to us, our charge got changed to disorderly conduct instead. This saved us from losing our licenses, but we still all had to pay a $400+ fine. Just try to argue the same way you would a traffic ticket, "Please don't take my license, send me to some stupid classes and fine me the max please." The magistrate might go for it, they don't care as long as they get your money. MIP won't even be on your record either, unless you get busted with weed or something. That's my advice, and next time, if you have an oppurtunity to get the fuck out the next time your in such a situation, do it! As long as the cops can't find or ID you, they can't bust you. Now don't do something stupid if they see you, it's already too late and you'll just get more charges tacked on. Just remember the golden rule, "It's never a crime if you don't get caught" PS Edit - One of the girls there wasn't even drinking, and even asked for a breathalyzer test to prove she wasn't, but here in PA it doesn't even matter, if you're even near alcohol and you're underage, the pigs have the authority to charge you. Alcohol "touching" has made it's way to PA

ahahahahahaha USA IS FUCKED UP here in Switzerland people over 16 can drink beer and wine. Over 18 - everything else Weed is decriminalized. THERE ARE NO FUCKIN COPS ON DA ROADS. ONLY CAMERAS AHAHAHAHAH! smuggling herb is so easy here. not only herb I guess. I know you know how its around the world but this shows how much US SUCKS ORIGINAL RUDE BWOY!

The US really needs to reform its drug laws. Eventually, over time, they will have to or face a possible revolution again, because the number of people using drugs is not going down every year.....
And it still amazes me that in this 'advanced' society we live in, people that get high after a hard day's work are criminal enough to be thrown in prison with serial killers

ok, so now - a month and a half later - i get a court order in the mail for the charge of minor in possesion of alcohol. bummer.
court's on the 30th, i'll post how it went when it's said and done.
