Disturbing video shows man scream for help as police officers make aggressive arrest over smoking weed

Police are investigating an arrest that was captured by a bystander in a pair of videos in Brooklyn, New York, on Wednesday night that showed a man apparently getting assaulted by several police officers and arrested for allegedly smoking weed in a park.

"I never thought it would happen to me," said Fritzroy Gayle in one of the videos, who was stopped by a plainclothes NYPD officer from the 69th Precinct.

Fritzroy Gayle, 20, was on his way home from his second job when his mother Daphane Gayle called and asked him to pick up a few items from the store.

At some point, the young man met up with another man and went to 100% Playground near Glenwood Road and East 100th Street.

Anti-crime police officers in plainclothes observed the two men in the park smoking a lit marijuana cigarette, according to an NYPD spokeswoman.

"As the officers approached the individuals, they fled the location," the spokeswoman said.

At some point, a young woman, who says she was on her way home from work and that she noticed the "undercover cop" and one of the suspected men with his back against a metal gate. She started recording.

"What crime did I commit? Tell me! What's the problem?" the unidentified man asked the plainclothes officer while both of his hands were in the air. "I did not commit a crime."

The officer appears to ignore the man's questions and radioed for backup. A gaggle of uniformed and non-uniformed police officers rushed over.

"Help me!" screamed the man as he is seen on the video getting thrown to the ground.

The first two-minute video appears to show some half dozen police officers tackle, knee, kick and stomp on the man while he's on the ground pleading for help.

"I never been arrested a day in my life," the apprehended man is heard saying in between cries. Meanwhile, more bystanders gathered and are heard asking for the officers to stop.

"Do you need me to call someone?" asked the woman -- who identifies herself as "Velvet" -- and who recorded the videos. She said she regrets not asking him for his parent's contact information sooner, she posted later on Twitter.

Meanwhile, the man's 58-year-old mother was calling her son nonstop when he did not get home at his usual time of 7:30 p.m.

"All I know is he was not dead when they took him away," she wrote in a Twitter thread.

"Upon apprehension, one individual was arrested and the second individual was issued a summons," the NYPD spokeswoman said. "This incident is currently under internal review."

Just as Daphane Gayle was getting ready to go to her son's friends house to make sure he was safe, her daughter in Florida called alerting her to the video that made it's way from Twitter onto Facebook.

"My heart was racing. I couldn't even speak. I thought they were going to tell me he was dead," said Daphane Gayle, adding, "I kept looking at it and was saying to myself is this going to end like another Eric Garner situation."

Garner was stopped by police in Staten Island and was seen on video grasping for his last breath as several officers attempted to arrest him for allegedly selling loose cigarettes. Garner's last phrase "I can't breathe" became the battle cry for anti-police brutality rallies lead by activists and civil rights groups like Black Lives Matter.

Garner's July 2014 death was captured on cellphone video. He was 43.

Daphane Gayle raced to the precinct at 2 a.m. she said, and sought answers as to why her son was being detained, to no avail.

"I waited and waited and waited, they couldn't even tell me why he was there," said Daphane Gayle who is traumatized that the video plays repeatedly on social media. "It wasn't until someone told me to call Rev. McCall that they let my son go."

Daphane Gayle said her son had bruises all over and his pants were ripped.

"This traumatized him and it traumatized me," she said. " I know the police are here to protect, but the way they were hitting him kicking him ... he didn't even have anything on him."

Both New York City's Mayor Bill de Blasio and NYPD Commissioner Dermot Shea "have concerns" about the caught-on-camera arrest.

"I don’t like what I saw obviously -- it’s not what we’re trying to do here," said de Blasio at a press conference Thursday. "I don’t want any officer to stand on someone’s leg if they don’t have to. I want more communication between officers and the people they’re confronting."

"When you have two people take off running -- I've been in that situation myself -- and you don't know what you have. ... we will have to take a look at the entirety of it," said Shea. "The end is what concerns me. I'd love to have a different outcome where we wind up on the ground wrestling with somebody."

ABC News' request for more information about the arrests from NYPD was not immediately responded to but the man seen in the video was arrested and released Thursday afternoon, according to sources familiar with the case.

Shea did not identify the weed smoking suspects, but said they are ages 20 and 18. The man seen in the video was charged with possession of marijuana, resisting arrest and obstruction of governmental administration.

Since July 2014, the late Brooklyn District Attorney Ken Thompson announced that individuals would not get prosecuted for some marijuana charges. Under the leadership of Brooklyn District Attorney Eric Gonzalez, the policy was expanded in 2018 to not prosecute low-level marijuana possession cases, including those involving smoking in public.

"The only individuals currently prosecuted for these offenses are those who pose a threat to public safety (e.g. driving with burning marijuana), create a genuine nuisance (e.g. smoking on public transportation or in a schoolyard where children are exposed to smoke) or are involved in violent criminal activity (i.e. “drivers of crime”)," according to a 2018 announcement about the policy change.

The NYPD has discretion to arrest anyone for marijuana possession, but Gonzalez "has called for the issuance of civil summonses as a response to low-level marijuana use and possession, as opposed to criminal summonses that make up the current response to most low-level marijuana offenses."

Criminal court summonses are issued in order to avoid arrest and getting fingerprinted "unless they fail to show identification," according to the state's Unified Court System.

"Civil summonses are similar to traffic tickets, and compliance is ensured through fines, not warrants and arrests. In addition, civil summonses carry no possible jail time and are adjudicated by the City’s administrative tribunal, the Office of Administrative Trials and Hearings (OATH)," according to the city's Criminal Justice Reform Act.

A spokeswoman for the Brooklyn District Attorney's Office said "We are aware of the concerns regarding this arrest and will be reviewing the incident."

After the videos were posted, they were liked over 100,000 times, retweeted over 54,000 times and received over 4,200 comments including a thread by city criminal defense attorney Rebecca Kavanagh.

"Regardless of the reason for the stop (because I am sure NYPD will come up with a reason like a report of a gun) there is no possible justification for this horrific use of violence," wrote Kavanagh.

The Civilian Complaint Review Board (CCRB) was also alerted on Twitter about the video and has created a thread to explain to the public and the women who posted the video on how to file a complaint.

Civil rights activist Rev. McCall held a rally outside of the 69th Precinct on Thursday at 4 p.m. "We will not be silent," said Rev. McCall.

"I keep telling God that I'm grateful that he is alive, that's all I can give thanks for," said Daphane Gayle who is contemplating filing a notice of claim against the city and the NYPD.

Bullshit. Police are here to control. Even when its comes to their role in the dispensation of justice, their part comes almost exclusively after the commission of crime...and that represents a sliver of LEO resources, less than 10% of the money allocated for LEO goes to detectives and investigative efforts; even less goes to crime prevention.

The vast majority of it goes towards the militarization of our police force, population control, revenue reaping activities, and generally treating us like an occupied population.

There is nothing unusual about this story. As a white teenager living in  relative suburbia at the time I was once targeted by local LEO for cannabis use, except I didn't actually have any in my possession they were just smelling it on us, I ended up hand-cuffed thrown face down in the culvert beside the road with an officer digging his boot into my back and they were verbally abusive and inexcusably rough to all my friends as they got more angry/aggressive the longer their search efforts were fruitless. Ended up with my own set of bruises especially on my back and circling my wrists(along with a fair amount of broken skin from the tightness of the cuffs as I was jerked around by one officer after another as they took turns screaming in my face trying to get my to tell them the location of the non-existent "dope").

And I've got quite a few more stories like that. Having guns pointed in my face for no reason at all, an attempt to plant evidence on me, having my girlfriends tips from the whole week stolen from her at a roadblock, being strapped/bagged/gagged in one of those special wheelchairs in jail for many hours for asking for toilet paper then being denied the use of a toilet afterwards...all laced with undue aggressiveness and abuse throughout. I can't even imagine what those experiences would have been like if I was a person of color or in jurisdictions infamous for such behavior.

To put it simply, fuck the police.

Fuckin' hell mate! What state did that happen in? I have been caught with weed and a bong in the car by police, the 1st time I went to jail, the second time I was with a couple of friends and the cop made us stomp on the bong and grind the weed into the pavement and let us go. I've never been roughed up by the police, but I've never ran from them either, and I'm extremely nice and such when addressing them.

As to above comment, one time maybe 10 years ago a nyc officer made me break my pipe, as If to break my heart or something. Either way, Real dickhead behavior. These kind of cops need to go

It’s ridiculous because in places like Brooklyn people smoke weed very openly even though it’s merely decriminalized and not “legal”. Most cops don’t bother with that stuff. I assume weed busts these days are not so glamorous for cops. It’s like shooting fish in a barrel, fish that are legal in most states and hopefully soon in NY as well

In the video, I first thought the “cop” was the guy getting arrested, but then you see the actual dude pleading “what did I do”. One thing tho, this happens to white people in NYC all the time too, yet I never see those videos.

The reasoning is that cops who go rogue for weed busts look for anything like 420 caps, or any sign someone blazes. They’re actually usually less afraid to bust white people. Especially poor white people. They don’t really bother upper east side manhattan residents, white or black. NYC is more of an elitist thing

There are huge (dispatchers and everything) delivery services that sell weed and coke to any kid in affluent areas. Those drivers or operators don’t often get busted. Same with even a deli in the ghetto not too far from me. They’ll bust people coming out, if they’re white, in a mostly black neighborhood. But they don’t really bother the deli. And this isn’t a dispensary, they sell guns and crack also and it’s dangerous to go there

I think the guys running made the cops more suspicious. Still doesn't excuse the behavior. BUT, the guys probably ran because they didn't want to get beat, arrested, or killed, it's a catch 22.

They have 8 people and have to resort to strikes to control someone smh


With proper training they can easily take people into custody without having to hurt them.

They work for the evil king, they’ll never be punished.  Every now and then they’ll sacrifice one to appease the masses but other than that they’re free to beat you for no reason.  They “smelled marijuana”.. disprove that in court.

NYPD is the new LAPD.

There was a story a while back about under covers picking up a 17-year-old girl for smoking pot, raping her, and throwing her out the car without stopping. Nothing will surprise me after that.

Also, I’ve been in 2 separate incidents where we were stopped on the highway, the car reeked of pot, and only one dude was searched (puerto rican but looks black). We didn’t have anything left both times, but I might as well have been carrying an AK...

IDK about that. From what I've seen, police racism is still pretty much systemic in the NYCPD.  This wasn't about beating down that one guy.  It was about reminding minorities what "their place" is.

It’s elitism more than racism.

White stoners are targets too. But you will not see them bothering anyone affluent, black or white on the upper east side.

But whatever your skin color, if you have signals around like 420 hats and such, you are equally likely to get searched by a cop that wants to bust someone. I have had many experiences, as have both white and black friends of mine.

That said, it’s undeniable that NYPD has chilled out since Eric Garner. Still, occasionally someone gets arrested for a joint. And occassionally something truly horrible like this happens. i quite literally have PTSD from the Bloomberg nypd era

There are more shitty cops concentrated in low-income areas, that much is true, but there are people of all colors there. They won’t feel bad cause a stoner is white. In fact it’s safer for the NYPD in a way

One time they tried to throw a felony charge at me for Nothing, shit took months to resolve, and money for a lawyer, not cheap. And the guy comes in late AF, it’s all corrupt. If you can’t afford a lawyer you’re fucked black or white in this situation.

It is often painted as just as skin color thing. But I’m not black, and I still very much fear having to spend the night over a bullshit joint or something. I’ve been robbed by cops, they talked shit about my ex-gf in front of me, I’ve spent nights for basically nothing. But again, mostly Bloomberg era. After the body cams and shit they have to be more careful

Nobody should have to deal with pot hunting cops

I'm sure this is "mostly" true in NYC...but its much less so in the rest of the country. Especially down here in the South. Sure, justice is still doled out based on socioeconomic status without much regard for race as well, but thats not the whole story.

I mean, even if it were just about poverty(its not), thats a condition that can still largely be predicted by race and as a result communities are still fairly segregated on many levels...and any action or treatment that is decided by economics is also by function decided by race.

That's kind of the point, you very much have to fear spending the night...people of color down here very much have to fear not walking away at all, and even if they do they are likely to incur a couple extra charges and face more aggression and abuse...and then its time for court, and thats where the racial disparity in our criminal justice system really shines.

Spending the night for a joint... much worse if you’re caught in nyc with like a decent amount of blow or any powder

more than likely you have to fight off what starts off as a felony (you’d only be able to do this by hiring a lawyer, and if you can’t pay you’re usually screwed)

So, black, white, asian, it depends on how you look to the judge and what kind of lawyer you’re able to hire.

In the durty souf it wouldn’t surprise me if that were true and you had a bunch of Joe arpaio types running shit. Every city is different, and rural areas different as well

In NYC if you’re just some high kid in the middle of the night being busted for any drug, they can fuck you up, make you smash your pipe (I dunno why that’s so popular with cops actually, they take pleasure in it, that’s kinda creepy imo), when NYPD in general feel like like they can get away with something, gotta watch out.

Things only chilled out after they knew there’d be much harsher consequences after the Eric Garner case, some cops I guess haven’t learned. Most just know that their ass is on the line, it doesn’t make them good people though

In general they think they’re fucking superheroes, for sure. Not just there to protect the people and wave hello. No, more like Batman.

I get what you are saying, but even in a system which is prejudiced on socioeconomic status and not race...when race is the greatest predictor of socioeconomic status then it is a racist system.

But yeah, cops are fucking dirtbags...and thats by design. They won't even hire people that are too intelligent, too stable, or too empathetic to be cops. This is true, literally. If you score too high in any of those areas they won't hire you.

They purposely seek out stupid assholes with psychological issues. They want them juuuust on the right side of sane, dumb as a brick, with no qualms about hurting people(whether directly, or through the system). But of course when you are teetering on the edge with every hire, quite a few crazies make it through.

It's because they want people who are capable of violence upon anyone, won't think too hard about fucking up innocent people if they are told too, and won't quit a few years in when they see how fucked up the system is.

The militarization of our police force has just made things worse. We are now an occupied nation.
