Student accused of nude broom attack on prof was high on mushrooms, defence hopes to argue

Matthew Brown was charged after a naked man broke into home and beat professor with broom handle



Former Mount Royal hockey captain Matthew Brown is accused of attacking an MRU professor in her Springbank Hill home last year. (mrucougars.com)
The Mount Royal University student who is accused of brutally beating a professor with a broom handle after breaking into her home wants to argue at trial that he was too high on magic mushrooms to understand his actions.

Matthew Brown, 27, is charged with two counts of break and enter, assault with a weapon and mischief. The suspect was naked at the time of the attack.

An MRU faculty member in her mid-60s was attacked in her home by a naked man in January 2018 and beaten with a broom handle, which left her with torn tendons, severe bruising and a broken hand, which required surgery.

Police have said the MRU connection was a coincidence — the professor lived in the southwest community of Springbank Hill where a party was taking place at a neighbouring home.

Brown, who is originally from Truro, N.S., has no criminal record and played major junior hockey before he became the captain of the MRU varsity team for three years.

A hearing is underway, with Brown's lawyer Sean Fagan arguing his client should be allowed to argue extreme intoxication as a defence.

Fagan characterized the section of the Criminal Code that prohibits the use of extreme self-intoxication as a defence as "unfair, unconstitutional and unjustifiable."

In order to use that particular defence for crimes of violence, judges — in this case, Court of Queen's Bench Justice Willie deWit — must agree with defence lawyers through two steps of legal arguments.

First, deWit must find that, without the extreme intoxication defence, Brown's Charter right to be presumed innocent and/or his right to life, liberty and security of the person has been violated.

In each of the 11 cases heard in Canadian courts since parliament changed the law in the 1990s, judges have sided with defence lawyers at this stage.

It's at the next step where Canadian case law varies.

Judges must then consider whether the breach is justified under Section 1 of the Charter, which allows for limits on a person's rights if the Crown can prove those limitations are justified. 

Prosecutor Deborah Alford argued Tuesday that there needs to be "criminal accountability for this behaviour."

If Fagan is successful in both prongs of his application, he can then raise the issue of extreme intoxication at trial. But it will ultimately be up to a jury to accept or reject the defence.

The trial is set to take place in November.

Victim hid in bathroom
After waking up to the noise of her glass door being smashed, the victim walked out of her bedroom to find a naked man inside her home.

She was immediately attacked by the man, who hit her repeatedly with a broom handle.

The woman ran to a bathroom and locked herself inside before fleeing to a nearby home, where her neighbours called 911. Brown was arrested nearby a short time later.

The month after the attack, following a hearing, the university ruled it would allow Brown to complete his degree but would not permit him on campus, a decision the victim's family called "reasonable."

Courts don't go for the 'I was high' defense.  They don't go for the 'I was drunk' defense either, yet used to.

For every  bizarre action caused by psychedelics there are 1000s caused by alcohol. but this Is the news captures people's attention.
I think the only time your level of intoxication should able to be used as defense would be if someone drugged you without your consent/knowledge.
It's nice they let him finish his degree that would not happen in America.

I don't even think that not knowing you smoked PCP is a defense in America.  There are a lot of hardliners in the states that think you should be a virgin saint and see themselves as always excused.

It's the position of authority.  I'm perfect God, you are the devil and there is no innocence in you as there is perfect innocence in me.

They'd say "you shouldn't of been smoking marijuana" if you raise the PCP defense.  Marijuana is not a lesser crime to these people.  They know almost zero difference between drugs and their social status or effect.

Mushrooms can occasionally cause violence in some people especially with improper set, setting, or dosage. But on the other hand millions of people take mushrooms without causing any kind of violence.

If we could somehow screen people out who have the possibility of doing stuff like that under the influence, that would be awesome. But to do that, we'd need to do a bunch of scientific research to find out how we can detect an inclination towards violence under the influence, and we'd have to somehow prevent people who have such an inclination from getting mushrooms, both of which are impossible under prohibition.

Yet another good reason to legalize, regulate, control, and study mushrooms. We could prevent stuff like this from happening if we legalized.

Anyone can. Anyone can become violent.  Not Having been violent before is not the best predictor.  Anyone can become psychotic.  Not having beem psychotic before is not the best predictor.  Life is, full of surprises.

I have never taken mushrooms and attacked anyone. In fact it's usually more like "please no bad vibes, I am tripping balls FACE so no bad vibes I don't want the bad trip."

So this guy was presumably at the party, and was given or bought mushrooms to eat, then left and got naked (not necessarily in that order) and went into a neighboring house?

Sounds like he was pretty damn out of it, makes me wonder how much he ate and how he ended up leaving the party. Maybe he got naked so they kicked him out and he tried hiding in the nearest house :strokebeard:

Regardless of what happened that's fucked up how badly he beat that lady. I wonder what the hell he thought was going on.

I don't think that's possible at all.

There are waaaaaaaaay way way too many variables at play when it comes to psychedelics to determine who might have a possibility of becoming violent/out of control after they consume a psychedelic.

If this dude was not in the setting of a house-party, this might have not occurred....If he took a smaller dose, this might not have occurred...If he took a larger dose, this might not have occurred....So many possible ways stuff like this might or might not happen.

We really don't know what "set him off", what triggered this freak out (besides the fact he was on mushrooms lol).


And if that's something to do with mushrooms...then it should certainly be done with alcohol too, because far more violence occurs after the consumption of alcohol than it does with mushrooms.....but good luck trying to make that happen. Making it illegal for certain individuals to obtain/drink alcohol would never happen.

Not directly related...but I worked with psychedelics for 10+ year and had over 150 trips before I had any sort of "bad time" or a "freak out"..Before then all of my trips were absolutely smooth sailing with out even the slightest hint of a bad time or feeling "out of my mind", I was a natural swimmer when it comes to psychedelics....But one night I found myself in the middle of a street, damn near naked in the middle of winter, in the middle of the night about 3am, with a big garbage bag in hand containing a bunch of mushrooms and spawn....before that night I had never come anywhere close to having even the slightest hint of a "bad time" while tripping. Things can get out of control quickly when it comes to psychedelics, it can happen to anyone.

Definitely.

The guy is douchey looking jock. I mostly agree the argument that people who get violent on drugs were probably already violent people, the Big Lurch argument. I been really fucked on shrooms, even naked fucked up, but never got violent, probably because I am not a violent person. I find it hard to swallow you are Joe Niceguy and the shrooms made you do it.

These stories disappoint me. Heroin/meth/cocaine use are decriminalized here in Calgary (we have legal supervised injection sites) but if you get caught with shrooms or LSD its always a crime. Psychedelics have no one advocating for us, we get 99 percent negative media, and we will never ever become legal.

When I was living in the dorms in college some friends got there hands on something called 2cE. Long story short I wound up BUTT ASS NAKED sprinting around the neighboring apartment complex screaming my girlfriends phone number at the top of my lungs. Some friends saw me and chased me down, and tackled me to try to put some pants on me. I yelled I HAVE TO PEE and they let me up. Then I bolted (still naked) to the closest appartment and crashed through the window. Then (bleeding everywhere) I jumped back out of the appartment through another closed window. By this point police had arrived and continued to chase me. I'm told I cleared a 12' fence in what looked like a single bound, and then got tazed by the police back up who had just arrived on the other side. I woke up in the hospital with 60 stitches and a catheter. The school expelled me, trespassed me from campus, and then put holds on my transcripts. The girl who's phone number I was screaming is now my wife, and we have 3 beautiful kids that I would have never made if I hadn't jumped out of college first.

HOLY FUCK!

I've never had an entire bad trip, but have had bad moments that seemed to last forever. In reality it was 10-45 mins or so, and the trip was not as good as some. I find if there is pervasive negativity I just isolate myself and reflect by myself and work out the mental stuff I'm going through, then I'm good. I have never taken more than 3 hits of paper LSD (only once at that), and I have never taken more than 5g of mushrooms (only twice). If I had to guess how many trips I've had total, it might be 100 plus adding all the trips on psychs (2c's, mushrooms, lsd, etc...) I always tell people that taking drugs is like cooking with salt. You can always add, but you can't take away, and you don't want your food too salty!

But they do not become violent in order to satiate some inner rage or anger. As hard as it is to believe, or understand from the outside, these people mostly become violent because their hallucinations/delusions have convinced them that their lives truly are in danger, and are mostly acting in self defence no matter how incomprehensible that may seem to other people.

It might well be that some people are more predisposed towards paranoia and feelings of persecution than others, but it is not a predisposition towards violence per say, and such people shouldn't automatically be demonized. It is often just irresponsible use (taking too much) and especially IMOE when cannabis is added into the mix.

But if you started experiencing psychotic delusions especially for the first time, and genuinely believed your life was in danger, your reaction would probably be to save your own life no matter what. And that would put you at the mercy of your delusions/demons. It's diffcult to make people understand just how real psychotic delusions are.

The only time I had a bit of a "freak out", that I mentioned in my previous post, was because of "delusions" and I truly felt my life/freedom was in danger....

...long story short I was delusional (though part of me still feels they were't delusions and it was rather clairvoyance because I've had similar things happen in the past with psychedelics that turned out to be very true/accurate, I guess that goes to show how "real" it can be :lol: )......but I was "delusional" that I was seen picking mushrooms earlier that day and followed back to my house. Putting it simply and short I had this entire image in my head of being locked up in jail....I was freaking the fuck out, like full on panic, pure fear & fright, full on "fight or flight" response...and I'm one of the most mellow and laid back & easy going fellas ever lol.

The fear/panic/terror manifested physically in my body as a hot & itchy, pins & needles, very dysphoric feeling all through out my body....So I tore my clothes off and ended up naked very soon after it all started (people often wonder how/why people end up naked when they're freaking out, well that's one way and reason how that can happen lol). I was pacing around naked frantically, practically pulling my hair out in stress as I paced around.

I wasn't violent but I was acting extremely erratic & frantic and wild as fuck like an animal.... I was still coherent enough to talk, I knew I was on mushrooms, I wasn't super high tho definitely up there, but I was in full on panic fight or flight mode. It was by far one of the most stressful situations I've ever been in life, I have never ever felt fear & fright & panic like I did that night.

Yes! One thing I remember from my own psychotic hospitalization (easily the most literally terrorizing night and experience of my life) was the pacing!

The endless pacing that gradually progressed to actual running as I began to try to physically flee from an experience that was emanating from my own mind and hence was impossible to escape from.

I remember a particular tragic moment (apart from the realization that I would be tortured/murdered and in being so devastate my loving family who I could hear wailing and begging for my life) during which I tried to go to sleep! Ha! The terror ended up becoming so acute eventually however that in the end that is pretty much what happened anyway as my mind mercifully began to blank out.

People who mess with psychedelics, and especially like myself back then, people who like to push it to the limit, would do well to remember that. How terrified would you have to be for your own brain to start shutting down?

Weird thing is when it got to that point although I was hallucinating, and delusional, I was no longer really tripping. It had gone way beyond that to the point where something had simply gone catastrophically wrong with my life and reality itself.

I don't think I even realized I was tripping and had I known it would have seemed utterly irrelevant to me anyway. It was an existential crisis or realization of where I really was.

Do you think your interest in the darker stuff (your avvy and sig, pennywise, etc...) could have had an impact on your mental state as well?

Well that trip happened when I was just a kid of 17 so I'm not sure my mental state was as dark, or lets say (as I'm not really a 'dark' person) not as preoccupied with the big existential life and death questions back then. 

Besides my av/sig is not intended to be dark. It is supposed to be a metaphor for what one experiences when he goes to hyperspace with DMT(or in my case Anahuasca). A rainbow colored and demoniacal circus that feasts on a persons fear, and his subconcious guilt or shame, and then uses this information to turn the screws.

The point is if you cease being afraid of it, as with pennywise, the demon or demons cease to have any power or control over you, and you will be free to enjoy yourself. Or rather you yourself will become powerful...

Albeit subliminal and not spelled out in plain english, that is not, I don't think, really a dark message.

Hmm, OK. I did put a "dark presence/feeling conveyed" on you merely by what I saw on the surface. Thanks for that explanation. As the saying goes, things aren't always as they seem. Very interesting as well.:grin: My interest in psychedelics (and psychology somewhat) is to get at what lies beneath the surface of reality and the mainstream way of being/doing things. To look behind the veil, and to pull back the curtain.
