Florida Lawmakers Considering Limit on THC in Smokable Medical Marijuana

Critics of the proposal to cap THC in smokable medical cannabis say it will just force patients to buy and smoke more marijuana.

On March 21, smokable medical cannabis products finally became available in Florida dispensaries. But already, House lawmakers are proposing legislation to limit THC levels in those products. It’s a move that critics say undermines the recent repeal of the ban on smokable medical marijuana. THC limits, they argue, will simply force medical cannabis patients to purchase and smoke more cannabis.

Florida House Committee Chair Proposes 10 Percent THC Cap for Flower
On Wednesday, the Florida House will take up discussion of a bill  proposed by Health & Human Services Chair Ray Rodrigues that would limit THC levels in both smokable and ingestible medical cannabis products. The bill would also erect barriers for sick children, making it more difficult for minors to obtain full-strength medical cannabis products. Another provision would give the Florida Dept. of Health authority to fast-track any new rules addressing the state’s medical marijuana program.

The specific caps would limit THC in smokable products to a level far below the industry standard for flower. A 10 percent THC cap would likely require cultivators to breed new, less potent strains. The proposed limits for edibles would be higher. A 35-day supply of medical cannabis edibles, for example, would have a 7,000 mg total cap. 200 mg per day is more than most patients—but not all—would require.

Critics Say THC Limits Will Cause More Spending and More Smoking
Two weeks ago, Florida Gov. Ron DeSantis signed the legislature’s repeal of the ban on smokable medical marijuana into law. Gov. DeSantis had himself pushed for the repeal of the smoking ban. But Rodrigues, who is a Republican, cited studies linking high-potency cannabis to psychosis and schizophrenia, as well as studies suggesting cannabis produces deleterious effects on developing brains, as reasons for his proposal.


Yet studies on cannabis use and mental illness are far from conclusive. Often, researchers publicize preliminary results that have not been vetted or peer-reviewed. But since such studies fit a popular anti-legalization narrative, lawmakers often neglect taking a closer look at their actual findings.

But whether or not Rep. Rodrigues’ concerns are well-founded, critics say a cap on THC won’t produce the desired effect. Ben Pollara, a legalization advocate and critic of the proposal, called it “a tax on patients.”

The 10 percent limit, Pollara said Tuesday, will force patients to pay more “to buy more marijuana to achieve the same effect as if the caps were not in place.”


Additionally, patients seeking to achieve the same effect with lower-potency flower will have to smoke more, negating one of the declared objectives of the bill. If patients can’t afford to purchase more flower, the cap has the same effect as a ban.

Bill Would Make It Harder for Minors to Obtain Medical Cannabis Treatments
Another provision of Rodrigues’ proposal would expand medical marijuana requirement for minors. Currently, Florida minors need approval from two doctors to obtain medical cannabis treatments. If those treatments call for smokable products, the second recommending physician must hold a medical board certification.

Rodrigues’ proposal would increase those requirements. A second approval from a board-certified pediatrician would be a requirement for all forms of medical cannabis, from tinctures and oils to flower. If the proposal becomes law, caregivers of children with qualifying conditions would have trouble accessing anything by low-THC cannabis.

10% or less...  I can't remember the last time I smoked anything with less than 12%, most have been around 15-17% with some stuff thats around 20% every so often.  10% would require rolling almost twice as many joints to get the same effects

A limit on thc is bullshit. You can just smoke more of the lesser thc shit. Dumb asses! Fuck tards got nothing better to do than make up new laws and make things worse.

You can buy grain alcohol that is super strong. People are getting in accidents and killing others drinking Bud light.

I know people that need 1 gram of THC per edible to feel anything (heavy weight use who grew up with cultivators).... What about people like them? What about rastafarians who uses cannabis like a religion? I'm sure that supply limit is too much.

there is no limit on thc, you'd have to vape like 100 pounds of weed all at once

the only thing it can take from  you is vitamins and nutrients in which case having more access to thc rather than smoke would benefeit

Dude wtf are you saying? First of by limit you mean LD50, which there is, and you're right it's ridiculously high.... Second where did you get this vitamins and nutrients? Does the bud become the vitaburgler? Third I'm sure the reasoning has much more to it than losing vitamins and minerals.

Some substances, like amphetamines, cause your body to burn through certain vitamins/minerals quicker than it would without said drugs. Not sure if the same goes for weed, but it wouldn’t surprise me. The stuff does interact with the bodies endocannabinoid system, which regulates a whole fuck load of bodily functions.

for some people though who smoke two joints a day it means nothing, maybe an extra glass of OJ or an extra fruit or something

There's other concerns such as triggering underlying cognitive or psychological issues, which anything can do some more than others where pharmaceuticals are usually the ones with the risk of developing suicidal ideation while cannabis use is known to reduce suicide rates in areas it's more heavily used.

The CAP is at 10%?? Thats insane. I was expecting it to be 25 or so for top shelf. So if youre buying "fire" its 10% thc? What about a cheaper outdoor strain? Would be pretty weak. In LA you cant even find 10% thc bud. I wanted to buy some cheap outdoor, even that was 14%. The black market shit i get in my state is def at least 15-20%. Why should potency matter so much? If the weed is too weak for recreation it prob wouldnt be good medicine either.

Do these politicians think 10% thc weed will stop traffic problems while satisfying patients?

Do they plan on selling c02 pens and bho? Or, edibles can be extremely powerful. 200mg is pretty strong IMO. What about oils that are 70-90% thc?

Lately it seems alot of states that try to legalize are all fucking it up or not accomplishing legalization. The east coast seems to be on a seemingly impossible mission: sell weed but mostly give chances/licenses to people already hustling in "communities devastated by the war on drugs" (man, you should see my old neighborhood, and it was mostly white...kids getting arrested every night, violence, people robbing you for $10, and eventually opioid explosion). And dudes driving around all day with the sole purpose of getting dimebags to 15 year olds. And sometimes hiring them to divvy up an ounce and sell it off in 0.5g bags. Now that was a drug devastated neighborhood. And im mostly just mentioning the weed, not the ODs

Im surprised these states arent selling dimebags to maximize profits. But then again, thats kinda what prerolls are (quantity/price-wise)

Oregon's top shelf is so cheap right now that the olcc is allowing medical patients to buy 5 oz at a time now. for awhile we were capped at 1 oz per purchase. Oregon's scene blows california out of the market completely. Their shit sucks ass, same with colorado except one area. I'm sure all the legal states have good herb but the oregon willamette valley has always been underrated and if it's good grape growing conditions, then we probably grow some of the best herb in the world. There was a time in my youth when they weren't sure if commercial grape wine farming would be viable here, ha!

Cali's shit sucks ass? I just came back from LA. Prices are great a year later (4g for 30, tax included, 50 for 1000mg cannabutter, plus no charge for delivery)

I do love oregon weed too. For a while i was getting all oregon shatter packs. "Proper" was the brand name, was like 20 for a gram, and the strain i had the most of was called "Blurple" (blue dream x purple something) which was tested at 82%

They also made Moby Dick, which was only 65% thc, but turned out to be my fav out of the oregon packets. It was full of cbd, tasted and looked amazing, and was a real nice dab. There were also some indicas, i forget which but Proper was some cheap, good stuff

If its cali weed vs oregon weed tho, id have to go with cali. I hit up the nearest well-reviewed delivery service and got some super crystallized Tahoe OG. And that was like mid quality/price on the site. Def good enough for me along with the butter tho. I guess legal states will always be competing. When in cali i heard alot of "cali vs colorado"
