The order doesn't have the force of law anyway.  The 14th Amendment clearly says "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States..."

It's not rocket science.  Anyone born here is a citizen unless they aren't subject to U.S. jurisdiction...such as a foreign diplomat's child who would be diplomatically immune to the jurisdiction.

They can applaud all he wants.  He can claim to invalidate whatever part of the constitution he wants.  It's all words though, and none if it has any bearing on reality.

Have them throwing matches and yelling about it before he goes in there with an ax, decides to “rearrange” some of it.

That way he can “put it more in line with modern American values“

I assume this case will see some kind of injunctive relief, but I’m not sure a state has standing in this matter. Normally, for the courts to decide on something like this , it would take someone suing on behalf of a child that was denied citizenship due to the policy.

Meh...trump will try to deport someone born here, and then it'll kick up from that. Either way, there's zero chance the Supremes are gonna side with Trump on this.  I seriously doubt any circuit court will either.  There's no real argument that the 14th isn't valid law, and there's no way to interpret it to deny citizenship to someone born here and simultaneously claim that he/she can be deported.

It’s all rhetoric. Executive orders cannot overrule the constitution. Congress would need to pass legislation, amendments and such. Then and only then will the rhetoric become reality.

Until then the courts will tell him to kick rocks.

Congress can't overrule the Constitution either.  A congressional law ending birthright citizenship would be just as meaningless.

Sure...we could amend the constitution, but Congress can't do that alone just like Trump can't.  There's zero chance of the 14th amendment being repealed, though, and if it was, that would pretty much end all civil rights in this nation including freedom of speech, religion, etc.

You've got it backwards, though. His executive order is only legal if someone is willing to enforce it.

I know a guy who was born in the US to diplomats and he’s a citizen. Turns out in reality a birth certificate from a US state is all you need to prove citizenship.
