He has done incredible harm to the nation.  Most likely harm that will last for the remainder of my lifetime.  No one said he was harmless.  A prosecution of him, however, will do further harm to the nation.  Balancing that with whatever benefits may or may not arise out of "justice" is the key here, and I just don't see the upside of a prosecution at this point.

so we should not punish the crimes if litigation is too costly?

Yes...we should not litigate it if it is too costly to do so.  The reputation of this nation is a high cost.  One that I don't believe is worth paying for whatever benefits may hypothetically come from a prosecution.

if the cost of litigation is too high for someone who is commuting crimes that damage the nation... at what point does it make sense to start having laws at all.

i vote that we abolish all unenforceable laws.

so if we wont enforce campaign finance laws. lets not have them.

if its ok to lie on your taxes... lets simply not have laws that require you to not lie on your taxes.

if its ok to have art donated to your charity, and then put that art up in your private residence.... then lets just do away with that laws all together.

if its ok to call up and threaten people to throw out or change votes... lets just do away with the laws that make it illegal.

why would we have laws...and punishments for those laws which we will not actually persue.

you are suggesting something quite different. you are suggesting that we caught the person vandilizing the house but we should do nothing about it... because of a hypothetical threat to the house that MIGHT occur if we prosecuted the vandal.

Yup.  Predicting the future is always dicey.  If prosecuting a vandal would cause more harm than good, she shouldn't be prosecuted.  The tricky part is always figuring out the likely harm and good.  With Trump, I'm not sure I can see a whole lot of potential good that would come out of a prosecution, but I can certainly see a lot of potential harm.

ok well your vote is noted. if we take a vote on that your voice will be heard... in the meantime you try to get together with a few hundred million of your closest friends who think we should stop prosecuting crimes and try to get it on the ballot...

When does prosecution have to consider the likely harm to a nation? It should be real simple: whether the charged person is guilty or not. Isn't that how the law is supposed to operate, without political interference? Separation of powers and all that?

No, you see, if a criminal threatens to do more crime in retaliation for prosecution, then in the interests of preventing more crime, we should avoid prosecution. Pretty simple, right?

To clean up Enlil's analogy: A vandal shows up to your house and vandalizes it. They are caught, but they say that if you try to prosecute them for the damage they did, they'll call their buddies and have them burn down your house in retaliation. The obvious course of action is to prevent further harm to your house by letting the vandal on their way, preferably with an apology and maybe a few million dollars in apology money.

this is where it gets really sketchy to believe enlil is a lawyer (as he claims).

now im not specifically saying he isnt, there are many types of lawyers with degrees from important places and deploma mills alike, but many of my family members are and were lawyers my uncle regularly argued cases against railroads in front of the supreme court... and because of this i feel i have a handle on how most real lawyers feel about the law... most of them are REALLY pro law... pro rule of law... pro constitution... pro country.

many of them argue cases to win, even when its in conflict with those ideals because they believe so strongly in the right to good representation for their clients that they believe (rightly so) that getting a client off is PART of that idealism.

enlil is the only lawyer i have met... or know of, as i havent actually met him and cant vouche for him as a lawyer or even a human... but falling under the assumption that he isnt just lying... he seems to be the only one i know of who wants to just NOT ...

i mean im an anarchist... not a lawyer... and im all for a system with as little oppression as possible and no leaders at all.

but for a lawyer to be against laws... seems really really odd.

A prosecutor always has to determine the interests of justice.  The people are a party in a prosecution, so the harm to the nation is necessarily a factor.
