This is a heart breaking story, but I hope you realize this is also an extreme outlier. What would you want to see done differently? According to the article, the complaint was withdrawn in two weeks and charges were never laid. A basic investigation seems like an appropriate response for any rape accusation.

Would you prefer to see police deciding which reported crimes are worth investigating? Do you know that a tendency for police to not investigate legitimate rape claims is partially responsible for the fact that the vast majority of rapes go unpunished or unreported. This is why a push to support the victims of sexual assault exists; it is in response to a large societal bias for disbelief.

Every statistic out there shows that false accusations are a minority of reported rapes (usually ranging from 2-10%). Obviously this is still a problem, but to imply that the response to false rape accusations is to be increasingly suspicious of every rape claim is basically to say that you believe we should transfer the harm done by false rape accusations over to harm done by unreported and uninvestigated rapes; which is no real solution at all.

How many families do you think have had to deal with a suicide over a rape that was never even reported? This is why the #metoo movement exists.

If you want to properly respond to the issue of false rape accusations, while also doing everything you can to improve the reality for sexual assault victims there are two, if you ask me, basic things that you can do.

The first is learn about the reality of sexual assault in our society. Learn about the issues surrounding consent, common behaviour of sexual assault victims, the difficulties of trial; and yes you can also learn about what kind of person makes false rape accusations. You will find that the narrative of vindictive women ruining men's lives with a single false claim is actually a very rare occurrence. You'll also find those who make complaints of rape are generally disbelieved, and the men guilty of it are generally excused, or assumed to be innocent.

The second is to push for a shift from retributive justice (based around punishment) to restorative justice. The main damage caused by false rape accusations is the punishment that is inflicted on the undeserving - even if a conviction is never made, trial is a punishment in and of itself and society may respond with its own vigilante justice. Our entire concept of justice revolves around crime and punishment; would you expect anything different as a result? Restorative justice won't necessarily prevent all false accusations of crime, but it will ensure that punishment won't be inflicted on the falsely accused before they can be exonerated because punishment will no longer be the sole focus.



Edit: Maybe I'm wrong in my assumptions about you, though, so I'll ask again: what is your proposed solution to false rape claims? How could people have responded differently in the case you bring up?

You had me until restorative justice. In practice that has meant releasing violent criminals early and decriminalizing very bad crimes to misdemeanors. It makes crime an entitlement.

Restorative justice makes the assumption that punishment is not the most effective way to reduce crime. Academic assessment of restorative justice is positive. Most studies suggest it makes offenders less likely to reoffend. A 2007 study also found that it had the highest rate of victim satisfaction and offender accountability of any method of justice. The Scandinavian prison model focuses on restorative justice, and also has one of the lowest rates of recidivism in the world.

California just decriminalized a LOT of violent offenses. The fellas and the hombres are taking full advantage. They got rid of bail which has been good and bad. Good for innocent folks and poor. Bad for repeat offenders. Petty theft isnt even worth a police officers time. Lol applying scandinavian justice system to non white populations doesnt work. Whites have low crime wherever they are. Be it europe or us or canda.

Look up prop 47 and prop 57. Terrible laws that have lead to drastic increases in crime in commiefornia. Petty theft is < $950. Yea $950! Theres been a shitload of girls going into upscale white yoga pants stores stealing tens of thousands of dollars of clothes recently. There were 17 apple stores hit in norcal for $100,000 total they start fighting when confronted. These criminals are getting worse and worse and criminal justice reform is especially lenient to repeat minority offenders. Its become an entitlement in ca to commit crime.

I want metoo murdered. The laws as they stand are enough to enforce justice. Its illegal to rape or sexually assualt. His death and his moms death are the result of feminist hate for men and new found weapons of mass destruction. False accusations should be sentenced as harshly as a violent rape. It ruins lives or takes them. Effects whole families.

  I have to agree with what your saying here . Prop 47 has turned parts of San Francisco into open air drug markets . It’s unbelievable . There’s a cvs across the street from the building I’m working in that has a security guard that fights  all day long with homeless drug addicts trying to steal shit . I watched one of the craziest lookin meth addicts I’ve ever seen walk in there and punch his way out with a sandwich in each hand .
    There is human feces and empty syringes everywhere .
  Prop 47 was passed due to prison overcrowding though , I’m not sure which is worse . I don’t feel like overcrowded prisons do a good job of reforming people , they come out tougher and crazier than when they went in .

Even your reference to those two California propositions shows a lack of understanding regarding restorative justice. Reducing criminal penalties is not restorative justice without having a corresponding program to get offenders to take responsibility for their actions, to understand the harm they have caused, to give them an opportunity to redeem themselves and to discourage them from causing further harm. Is California providing these programs alongside the reduction in criminal penalties? Criminal justice systems can undergo reform without engaging in restorative justice.

Furthermore, do you have anything showing a link between a rise in crime and the passing of prop 47 and 57?
