80-year-old medical marijuana patient with expired card jailed for less than an eighth of cannabis

CLARE COUNTY, Mich. -- An 80-year-old grandmother in Clare County was jailed for the first time in her life, because she had a small amount of cannabis at home but her Michigan medical marijuana card expired.

Delores Saltzman and her son Mark tell FOX 17 cannabis saved her life: it worked up her appetite when she was sick; helped her heal after surgeries; and eases her pain from ongoing health conditions. They are disturbed a deputy jailed her overnight for using her medicine.

"After I smoke I go down to a one, pain-wise," said Delores Saltzman, 80. "Before I smoke, I would say I’m an 8 right now."

This November, Saltzman turns 81. She lives with arthritis, diverticulitis, muscle and bone aches, but she says cannabis keeps her moving and making art.

"This is the little paper I work with," she said showing the camera, "it’s called quilling."

"[Cannabis] saved my life because I had a bad bleed about four years ago, and Mark took care of me," adding when doctors prescribed her opioids, it caused stomach pains and vomiting.

June 13 around 9 p.m., Clare County Sheriff's Deputy Ashley Gruno knocked on Delores’ door. According to court records, Gruno was trying to locate Saltzman's great granddaughter, and return her lost phone and ID. That’s when the deputy smelled marijuana from Saltzman's porch.

"[The deputy] asked whose it was, correct?" Mark Saltzman asked his mother.

"Right, and I told her it was mine," Saltzman said, explaining she was honest with the deputy.

"[The deputy] came in and kind of frustrated you; remember how you were telling me that your anxiety went up off the roof?" Mark asked his mother, to which she said, "Way up."

Court records show the deputy seized: several pipes, four joints and one purple jar with an undisclosed amount of cannabis. When FOX 17 asked Saltzman how much marijuana she had, she explained it was less than an eighth of an ounce.

Saltzman also says the deputy searched her bedroom, took pictures, even helped her clean up her kitchen.

"I got everything done but the one pan, and I says, ‘Are you ready hon?’ because she’s just standing there leaning after she put the bread and ketchup away, just leaning there, " said Saltzman. "I said, ‘Are you ready hon? Let’s go.'"

Then, court records show Saltzman was handcuffed in the patrol car. She says the deputy did not read her rights to her, and she was escorted to jail for the night.

"That’s ridiculous what they do to people, they don’t need to make you that cold," said Saltzman. "Old Arthur was screaming at me!"

"She won’t know who Arthur is," Mark said to his mother.

"Arthritis," she clarified.

Saltzman hopes sharing her story will help others.

"That’s what I want people to do: don’t be ashamed of something that’s going to help you feel better," she said.

Her son Mark says this deputy made a mistake.

"I just thought it was absolutely ridiculous to put her through this like that: they could have given her a ticket," said Mark Saltzman.

"And just show us your card later. Reapply for your LARA card, show us this, and then drop the charges."

FOX 17 reached out to the Clare County Prosecutor and Sheriff about how this case was handled.

Clare County Prosecutor Michelle Ambrozaitis wrote FOX 17 this statement:

"Law enforcement went to Ms. Saltzman’s home looking for an individual who had been known to stay at that residence.  When the deputy arrived, she could smell the odor of marijuana.  When she interacted with Ms. Saltzman at the door, Ms. Saltzman admitted to have been smoking marijuana and possessing marijuana and that she had allowed her medical marijuana card to lapse.  At that time, Ms. Saltzman turned over to the deputy 7 marijuana pipes, 4 joints, a grinder, and a purple glass jar that also held a quantity of marijuana inside.  The deputy arrested Ms. Saltzman for the illegal possession of marijuana and lodged her in the Clare County Jail.  Based upon that arrest, a police report and request for charges was generated by the deputy and presented to our office.  My assistant prosecutor authorized a possession of marijuana charge based upon the admission by Ms. Saltzman that she wasn’t a medical marijuana card holder and the evidence that she did possess marijuana illegally.  However, our goal is to ensure that individuals who utilize medical marijuana are doing so legally.  As such, Ms. Saltzman was encouraged to obtain her medical marijuana card and if she did so, the case would be dismissed.  She did obtain her medical marijuana card and the case was dismissed."

Then, court records show on August 2, a Clare County judge signed an order to dismiss Saltzman's case without prejudice.

Then, Clare County Sheriff John Wilson wrote this statement to FOX 17, but did not comment on whether his deputy should have arrested Saltzman:

"What the person was doing was illegal, had she renewed her medical marijuana card she would have been fine.  I agree with the action the prosecutors office and allowing the subject to renew her card, thus dismissing the case. The person was illegally in possession of marijuana."

Saltzman's renewed Michigan medical marijuana card is on its way to her, but she urges voters to legalize marijuana in November and end the stigma.

"I'm hoping that we all learn a lesson from this and that we make amends, and people will get out and vote for it," said Saltzman. "We’re the ones that have to stand up we are the people, and we just got to fight for our rights."

Simple personal possession is something that can still get you arrested in Michigan?

I figured most states that have medical cannabis have at least decriminalized cannabis, where possession of small amounts is just an infraction. (But apparently not...Just looked it up....possession is still a misdemeanor in Mich...with only a few jurisdictions that have decriminalized).




I'm living in a bubble out here on the west coast...I mean I still know it's illegal in many parts of the country, but hearing stories like this is a real reminder about it all. This non-sense needs to end.

I know it's still "technically illegal" with out a medical card...but I find this particularly fucked because the old lady was in her own house. On her own property within her own residence.




It's crazy how different the laws are around different parts of this country....I'm acquainted with someone that got pulled over and caught up with a full sheet of LSD, some MDMA, some MDA, DMT, mushroom chocolates, cannabis, hash, and several pipes & other paraphernalia, and they weren't even arrested and didn't have to serve any time in jail. They just got a "ticket" and were allowed to drive away, they were told to show up to court and that was all.....Meanwhile, some cop merely smelled cannabis in this old ladies house and she was pulled out of her own house, arrested, and had to spend a night in jail. :nonono:

Openmind what states was your friend given a ticket? I live in the south and if that had happened here. The unlucky individual would be facing a lot of prison time. Probably in the double digit range. And it would of been on the news. I ended up losing my job because of a publication call "jail bird" where they show mug shots and a list of the persons charges. So even if you serve your time your still liable to lose your job and if you are renting you can be evicted. I ended up serving 6 months in prison for felony possession of marijuana when I violated probation. It's so weird how the southern states will crucify someone for for half an ounce of marijuana.

It was in California. And I don't think it was a classic "ticket" like one would get if they were speeding, but he was given some papers which I think basically just showed his case/court information and info about the drugs/property that was confiscated and he was let go. I'm pretty sure personal amounts of any drug(s) is no longer a felony in California, that's why he didn't serve any time. In 2014 California passed prop 47, which changed many non-violent offenses from felonies into misdemeanors. He had to go to court, paid some fines/fees, went to a few drug classes, was on probation for a little while and that's about it.....He was even allowed to still smoke weed while on probation and going through it all :yesnod: ...I couldn't believe it lol.


And yea...If it was in the south, I have no doubt he would be behind bars at this very moment and for years to come. When I first got word about him being pulled over and caught up with all that stuff I was super bummed because I figured he was going to be doing some time for sure....I'm glad it turned out how it did, because this fella is one of the most genuine guys I know, he's a real cool dude (I was so upset when it initially happened, thinking he was going to be locked up for at least a few years)

Holy shit this is so inhumane and ass backwards :sad: My dad was diagnosed terminal with 5 years in 06 . Cannabis saved him. He still has major CNS damage,fiber glass in lungs,interstitial lung disease and is 100 percent disabled. The weed was and still is the only thing that helped. I also have been prescribed  medical cannabis since 14 because of serious medical conditions and injuries and that's the only thing that helps my stomach pain and anxiety\ptsd. So it always has been a very personal thing for me and these things are discouraging

First, the officer comes to this lady’s residence looking for someone who stayed there before.

Two, officer smells marijuana

Three, lady admits to the marijuana

How could this situation be avoided?
Not opening the door maybe? I mean if the house smells, use common sense right? Idk

It was an 80 year old women, not a man.




And her case was dismissed>>>

And they always smell your smoke, they got very good noses


Time for smoking chamomille tea people?. It won't invite the cops, at most you get a really long haired hippie visit. Or lady visit.

I never smoked the weed officially, really, or not sure. If people asked, I didn't smoke at all.

This is incredibly lucky in any state, considering its not like the officer would know whats mdma, which is mda, etc without a field test. That is just a plethora of schedule 1 psychs/empathogens. The dmt pipes could easily look like crack pipes etc

Cannabis/hash/thc is one thing. The only way anyone i heard of has ever gotten away with anything like that is the officer didnt see it

But lets say it is true that your friend got away with that and this 80yo woman is charged with cannabis. I mean the divide is wide enough LA to NY. But this shit is nuts michigan actually has dispensaries and a legal weed culture, i thought

It is true...and he didn't "get away with it", he was still charged for possession of multiple schedule-1 drugs but he wasn't arrested and didn't serve any time. Possession of small amounts of schedule 1 drugs is no longer a felony in California. He had to go to court, got some fines, took a few drug classes, was on probation (but still allowed to smoke weed), and after a couple years it's all done and behind him now.


I'm sure the drugs were field tested as well as analyzed back at a lab to confirm/specify what drug they were specifically. He didn't have any DMT/oil pipes, just weed pipes, a bong, & dab rig, etc....Besides the sheet of L he had, it was mostly personal/small amounts of things, not a lot of any one drug but a variety of drugs. He wasn't dealing/selling, he didn't have scales, he didn't have a bunch of cash on him, he just had a variety of drugs on him.

Apparently cannabis has not be decriminalized in Mich though...only a few counties and/or cities in that state have done so.

Id find it mindblowing if he didnt spend the night. In my area, even a 10 strip is prolly a guaranteed "stay the night"
Lets hope that we can walk around with lsd mdma and mda without fear of arrest sometime soon.

Last i read something like 10mg of lsd can trigger serious time in many states. Maybe more than a year :/

An NYPD cop once told me the deal with "ecstasy" (the crazy thing is this guy had the same bday as me and somehow i got along with him). But he said a couple doses of mdma is about the same as weed (this was like 10 years ago when youd get arrested for a couple dimebags), but a larger amount like say a Q of molly or equivalent 70 rolls can trigger some serious time.

While Cali is always on the progressive side of drug issues, i feel this is still the case in most of the country (mdma/lsd= doing time or at least spending the night)

PS having legal weed but not decrim is some weird shit. Personally i think its better to have decrim and a good black market, same products really these days. I mean, theyre still selling 1000mg edibles for the same lower prices in black market states (or those with too limited medical systems, which is really about the same)
