I'm pretty sure its against the law to import any live plants without the correct credentials from you and the sender. that's not to say it wont go right through customs though. I doubt you would get arrested but you might get your plant taken or get fined.

I don’t know the specifics but all it should need is a proper phytosanitary certificate. I’m in the process now of “importing” 5 Ariocarpus plants from Italy. All I need, to the best of my knowledge, is the certificate. I seriously doubt it even really matters though. I’ve had at least four or five different cacti shipped in from other countries without one and it’s never been an issue. If customs were to get it I’m pretty certain your worst case scenario would be a letter and loss of your shipment. The only reason I opted for a phytosanitary certificate on my most recent order is because it was only about $17 extra to protect my entire order which was much higher.

I recently had some seeds confiscated from Aussieland... the reason for this was the lack of phyto-chem certificate.

Wow I generally thought customs didn't open seed packages cause they are just in envelopes. Where as cacti would be in boxes. Now you got me worried about some cacti seeds I'm waiting on from Peru.

It was intercepted on the west coast.. Ive heard they are a little more anal about shit.. prob because cali is a large agro state. My guess is the dude just put some seeds in a baggie and maybe just wrote the strain name w a sharpie or something. He was cool though and issued a refund asap. Sucks though, the genes looked solid.

To legally import from South America you need an APHIS permit through the USDA and the sender will need to get a phytosanitary certificate through his origin country. I will tell you that getting phytosanitary in Peru is incredibly difficult. Easiest way is to have the plant sent to Brazil to be certified phytosanitary before sending on to the US, following the APHIS directions for labeling very carefully.
Aside from that it is possible to get them through US customs without certification. It's all about inconspicuous box labeling.
