MURFREESBORO, Tennessee- Twenty-three stores in Rutherford County have been padlocked after undercover agents allegedly bought candy that contained a form of marijuana.
Rutherford County Sheriff Mike Fitzhugh - in a press conference - announced his office along with Murfreesboro, Smyrna and La Vergne Police, the TBI, DEA and FBI - conducted raids Monday:
Fitzhugh says Cannabidiol, which is also called CBD, is an illegal drug being sold in the form of liquids used in vapors, gummy bears and items that look like candy:
Indictments were issued on 21 people accused of selling the illegal products during "Operation Candy Crush."
Sheriff Mike Fitzhugh and Smyrna Police Chief Kevin Arnold said sheriff's narcotics detectives and Smyrna Police launched the investigation last year following complaints from parents and advertisements about the products.
Acting in an undercover capacity, detectives from both departments bought products containing cannabidiol, (ca-na-be-dial) also known as CBD, and other synthetic drugs in 23 stores in Rutherford County.
Sheriff fitzhugh noted, "We feel these stores are marketing these items toward minors. These items can commonly be confused by a child as candy and are illegal."
The sheriff add the investigation was launched after several parents complained about the products being sold in stores.
District Attorney General Jennings Jones says he's not sure where the individual products were coming from that were being sold in stores:
Smyrna Police Chief Kevin Arnold says the thing making this dangerous is the appearance of the items with CBD. They're being made to look like candy:
Arnold, who is also president of the Tennessee Association of Chiefs of Police, says in a recent meeting with the TBI, this was brought to their attention:
We have a list of the businesses shuttered on our website at WGNSradio.com, keyword CBD.

Cbd is 100% legal so I dont see this holding up in court, especially with all the current scrutiny on the feds (they've even mentioned demolishing fbi headquarters). The dea is obsolete and these businesses could be entitled to compensation for wrongfully being raided, not punished. It wont hold up in court.
It should be taken to the federal or state level of court system if the city wont abide by U.S. laws.
Its not far fetched. I know someone who had a 10 year federal prison sentance for selling k2. He got a good lawyer and was released 5 years early and awarded LARGE ammounts of cash for wrongful imprisonment, and probably cost some people their jobs (k2 wasnt technically illegal at the time). Ya gotta fight for your rights.

At the federal level, DEA still considers CBD a schedule 1 substance.

Call me childish, but I was personally, still impressed, by the idea, that I could make my own candy.
CBD oil is not assumed to be psychoactive, although, I agree that it is causing a legitimate, public disturbance, when some newbie is surprised by a concentrate, and they tear up a plane.
If you believe in informed consent, people ought to know that they are still using marijuana under an atmosphere of prohibition. You are responsible for how you trigger other people, imhblo.
You can see yourself as a sort of pioneer, for attracting unwanted attention, or you can be discreet.

Exactly what I was thinking. I'd rather give my kid some ultra safe cbd that won't effect his mind negatively long before the red40, that's almost definitely in there. But the Feds don't care about the poisons, just the "drugs".

At the federal level, DEA still considers CBD a schedule 1 substance.
And, belive it or not, there is still several states where it is also illegal. We can't have the epileptics or tourettes patients getting there meds. What a bunch of crooks.

CBD is federally schedule 1 like thc. Its strange to see a store shut down because, obviously its not psychoactive, but the store was sadly breaking federal law, yes.
They sell CBD in most headshops around the country.
Sucks, but its tennessee
Cbd in practicality is 100% legal the way spores are "100% legal", but spores arent scheduled substances. However, every natural cannabinoid is scheduled, as well as any part of the plant, like seeds. (Federally)
Its definitely only because these states (the ones who would actually ban it state-wide too) are really afraid to open the door for legal cannabinoids. Even if its just medicine for epilepsy. They dont care. They see it as "medical marijuana" and that scares these states ("i dont wanna live in no marijuana state")
Coupled with big pharma interest

Assuming that it would be in the hands of thinking adults, my attitude is that kids could be given candy or juice (that tastes really good), in place of the amber-colored bottle or clinical-tasting stuff from a spoon.
The doctor could be dressed like a clown or cartoon animal mascot, if that helps people.
Or, you could intimidate me, for my safety.
The CBD oil could could be unlocked from a metal vault, by a gruff army nurse in S&M clothes -- to make it more professional.

CBD extracted from "Cannabis" (higher than .3% THC content) is Illegal
CBD extracted from "Hemp" (less than .3% THC content) is Legal
Must have been the first or they were unable to prove it was legal sourced CBD from Hemp plants.

Well theyre not selling rick simpson oil if cbd is a problem...
I think that has like 30% of both, no?
But this is bullshit, because in most states, now instead of "K2", they have cbd products if you ask. Almost any state, any store. Especially if they have bongs. Shit some stores even sell c02 (im talking bodegas/delis)
As well as things like nitrous oxide, theyve been part of the headshop/sex shop catalogue for years. Especially the nitrous carts that say things like "Hot Sex" on them (lol). I dont even have a body for 30 seconds so not sure how that works lol
And nitrous is a short, but very real, and potentially very intense dissociative (if you dont think its along the "lines" of ketamine, try 4 balloons in one go and get back to me). I mean, with a cracker that lets you use multiple balloons, i experienced something that blew even dmt away. I was not expecting it either. Was close to how a k hole feels for like half a minute, not that time exists in this state. I certainly was less aware of my surroundings than a breakthrough 50mg dmt trip through a nice machine
Ps i was talking to my doctor about this (someone brought it up above). Nobody has wanted to do a thing about dxm (and they shouldnt, just get rid of the dangerous versions with acet or pseudoephedrine for people that dont know how to read the back). With dxm its stupidity that hurts people. That said, for me, prolly never again lol. (Last time was like 15+ years ago, but i had a little affair with it, dxm was more special to me than even mdma and lsd for some reason, i feel like lower doses corrected my ADHD much better than adderall...and no crash, plus much more interesting...im talking doses like 180-210mg in class). Honestly i felt was so much better than an adderall. My use was really mostly for productivity.

All criminal charges are being dismissed and records expunged against the store owners, according to the press release issued Wednesday by the DA’s Office. In addition, public nuisance actions are being dismissed and all property seized under court order will be returned.
Jones said the DA’s Office initiated the arrests and store busts because TBI assured his office items being sold at business across Rutherford County were “infused with illegal controlled substances. It is the duty of all law enforcement to prevent the sale of controlled substances.”
Attorney Kevin Latta, who represents Vapesboro LLC and the owners of two Kaleidoscope stores, said his clients are “relieved. But they are indignant and they have been through a lot.”
This part is really stupid though:
Quote:
“Since the TBI lab cannot conclusively establish in court that the cannabidiol they detected was derived from a marijuana plant, the state cannot prove the substance is actually a Schedule VI controlled substance. The TBI lab reports constituted the foundation of all indictments and nuisance actions in this case,” Jones’ statement says.
So it's fine as long as it doesn't come from a cannabis plant, but hemp is ok?
I get that cannabis is illegal but it just seems stupid to have a law set up like that.

Cannabis isn't illegal in Tennessee, exactly. Hemp is legal, marijuana is not. Hemp is, by definition (at least by Tennessee law) less than .3% THC. You can grow hemp in TN with a permit.

It just seems stupid that a chemical from them would be legal/illegal depending on it's source.
If they had decent amounts of THC I could understand, but it would probably be easier to isolate CBD from cannabis. It would probably drive prices way down.
And it wouldn't be too hard to check where CBD companies make their product, and if they are using cannabis illegally.
