Legal question concerning pharmaceutical companies.

I asked these questions in another thread, but I think they deserves their own thread:



Is it legal for a pharmaceutical company to sell the same pill for $1 in one country and $4 in another?


Is it legal in America for a phamaceutical company to charge a poor person $0.25 for a pill and a wealthy person $400 for the same pill?

Yep.

Probably not. There's an antitrust law on the books making illegal every possible variation on product pricing. There is literally no way that any business can avoid breaking several of them at one time or another during the course of normal business -- it's just that normally these "violations" are not charged. They could be, but even the most zealous prosecutors have by now recognized the insanity of the conflicting regulations, so they break out these moldy oldies only when they have a real hate on for a particular company -- i.e. Microsoft.

Of course, the company should be able to alter its pricing as they choose, but this is America we're talking about here, so don't hold your breath waiting for it to happen.

Seems like repealing or modifying those laws would go a long way towards easing the health care problem.
