Hi. I?m thinking of selling Lophophora williamsii seeds on ebay becouse I have quite a few peyotes and more will come. I get far more seeds than I will plant and I tought of selling them.
Now to my question, Is it legal in U.S.A or in wich states is it legal. I?m talking seeds not the live cacti.
I liwe in Sweden so I wanna know If I break any law sending it over to the big country in the west.

OK, I'm REALLY not sure, but: I don't think you are breaking the law by sending them - have a disclaimer that any Americans must be a member of the NAC and that it's not your fault if they're not . And anyway, they're very unlikely to get opened up by customs, and if they are, it's very unlikely that they'll be identified as lopho's.

Pardon my knowledge but what?s NAC?
I know there?s a little chance of post being opened, but since this might be over time a large scale thing I want to be sure about my safety. Thanks for the help.

Native American Church - if you can "prove" that you take/grow peyote for religious reasons, then you are allowed to do so on the grounds of religious freedom. So if you get all your US customers to declare that they are members, then you might be able to get away with it. I'm not sure...

Very much illegal to have, transport, etc., unless (as stated above) you can prove to be part of a native american church that takes them for religious purposes. I tried to get some several times and haven't been able to yet. One company was out of Europe and wouldn't ship over here to the states. I still keep my eyes open though, heh heh.

And even then it's still hard. The government doesn't cut the NAC any slack and harasses them quite regularly. I'd say just ignore the American demand for loph's and sell anywhere but the US. Less of a headache and worry.

MANY people on Ebay will send their seeds (and Peyote) to the US without a problem. Just add in a disclaimer that it is the buyers responsibility to know and follow their countries laws. I cant see the DEA coming after a foreigner. Especially for something as trivial as Peyote seeds.

If a letter get stuck in customs. What happends to it? Do they only destroy it or do they let the adressant know if they got it.
If a send a letter thru ebay and It get caught, it?s good if the buyer knows that it didn?t get thru rather then they think I didn?t send it and will complain with negative feedback.

To avoid the bad feedback thing, disclaim your sale it's good for shipping to non-US countries.
When customs steals it they normally put a yellow slip in the package and continue it on it's way, saying they removed contraband.

See, I dunno why you'd want to sell your seeds to people outside of the US... most people are trying to get seeds INTO the US

be careful going thru e-bay, they will watch where you ship controlled items, and will suspend you if you ship "contraband" to the USA. remember, *everything* is tracked by e-bay, you might get away with it for a short time, but they would eventually find your items on their site, and would note the shipping destinations. bad news for every person involved, as e-bay makes a point of declaring that they work closely with LEO. just my $0.02
