Absolutely bizarre behaviour by the human species.
Very common in the place he was at. If you go there in November you will see lots of hippies walking through the dune grasses, all trying to pretend they are not looking for mushrooms. Some carry binoculars and bird books, others walk dogs and some carry surfboards. On the top of the ridges you will see rangers with binoculars, looking for hippies.

Depends on how the legalization legislation is written. Some proposals set free prior offenders or even clean their records, while other bills don't mention anything about those already caught, which means that those who are locked up are out of luck.

If you don't pick them, it'd be very hard for them to do anything to you legally. When I take mushroom photos I move a few of them so they are set up in front of the others, so all of the features are visible in one photo. That's how you make a photo that can be used in a field guide. Moving mushrooms would be possession, briefly.
