HPD ends use of field test kits

HOUSTON, TX - The Houston Police Department says it will no longer have officers conduct field tests that give initial indications whether a substance is an illegal drug.
The tests have been criticized over the years for giving false positives in cases around the country. In Harris County, where Houston is located, the tests have led to wrongful drug convictions and exonerations after lab tests confirmed no illegal substances in many cases.
Police Chief Art Acevedo said Friday the change was made for safety reasons. Carfentanil, a synthetic opioid, was discovered in recent local drug seizures. Officials say the drug can be deadly if not properly handled.
Authorities say the change won't significantly affect how drug cases are prosecuted.
The Harris County Sheriff's Office also said Friday that it's stopping drug field testing.

i dont know why you gave this a thumbs up.
now you get to wait until they clear it with their labs before you are "free" for not having drugs.
willing to bet the courts will side with this practice as "probable cause"

It will make them less likely to arrest someone for having drywall or baby powder when the buggy test shows positive. It gives them no probable cause and if they arrest someone and it turns out not to be drugs they can sue and probably win.

they aren't testing on the side of the road anymore, they already said that.
...and that is the very definition of probable cause.
that you have probable cause they have drugs.
powder substance in unlabeled bag? probable cause.
piece of drywall in a pocket that looks like a crack rock? probable cause.
i doubt you understand. leave your feelings out of it, the law doesnt run on them.

A piece of drywall is not probable cause for arrest with nothing else, show me where that stood up? When it turns out to be nothing, they don't have the protection of saying the test showed positive and the citizens lawsuit can go forward and likely collect. So sure they could arrest but knowing they can be hammered they will be much less likely to do it.

You still aren't grasping it. Detaining someone for probable cause is legal. You really think they will let you go free while they are waiting on lab test results?? Lol. Everyone knows that. A piece of drywall or powder is not enough for an arrest. It is not probable cause unless maybe its bagged up into little bags. Then it could be real or fake drugs which are illegal too. It all depends on the circumstances and facts. People have been arrested for doughnut icing but without a field test to provide cover, they can sue and likely win.

Son, you have no fucking idea what your talking about. It's apparent when you take one stance " not probable cause" then go on to say " probable cause but..." . I'm sure you won't admit it so I'm not going to waste my time educating someone who "already knows it"

Honestly, if they suspect u of having drugs tell me the actions they will take since u know better than someone who deals with this stuff on daily basis

Read some more article this police department is ending the use of field test kits due to worries about potential fentanyl and fentanyl analog exposure NOT reliability/validity of the test kits.
