Can new landlord refuse us or my dog?

My girlfriends dog bit someone recently. Again. She has a criminal charge of "failure to control a dangerous dog." Both very minor bites. Not convicted yet of the latest charge. We are trying to move apartments. And I'm nervous that when they do a tenant background check, they will see the charge and either refuse my girlfriend because of her charge (unlikely) or refuse our dog to come with us.
But we have him registered as an Emotional Support Animal because she has a minor disability. So he is allowed to come with us even if apartment has a no pet policy. But I'm not so sure with the criminal charge.
What should I say if they ask about it? Maybe say it was when she was watching over her parents dog? That it wasn't our dog? Can they even refuse him since he is an EMA even with the charge?

Federally yes they must allow. But sorta grey zone with the criminal complaint.

It differs by state and municipality I imagine. As long as the landlord accepts dogs though, don't really see him denying you unless they have a policy on "aggressive dog breeds" or something they mentioned to you.
But I'm just chiming in, I don't actually know or anything.

Federal law requires the landlord to allow emotional support dog. Most landlords don't give two shits about the law or know the law.

Well this complex is huge and they have their own lawyer. And will do a background check. I just feel like it's going to raise some questions

If they do a background check on her and the charge comes up then probably YES.

I agree with this.
Years ago I had a Chow/German Shepard mix, he looked more like a German than a Chow though, but had a purple chow tongue which raised some eyebrows from a place trying to get into. Just explained the dog was well behaved, and IF there were any incidents I would find other housing, never had an issue though.
This was over 10 years ago though, and down south, so maybe laws have changed, I don't know.

no the landlord is not required to automatically allow an emotional support animal. They are required to allow an emotional support animal if the tenant provides a doctors note stating the animal is needed for a disability related to a mental illness and that the animal is required to mitigate the disability.
Different law from a service animal.
The landlord also cannot bar her from renting because of charges, only convictions.
If she has no disability that a doctor states requires this animal for mental health reasons then you may not be able to, but this doesn't mean the landlord knows the laws fully either, you can probably bluff your way through if you have anything somewhat official looking for paperwork for the dog.

They can just deny you without stating the reason, or give you a bs excuse.
That dog should be put down for biting people.

Yeah you can't just say it's an emotional support animal.
And if it bites another tenant they could take you to court over it and have you thrown out. Even if it's an official emotional support animal.

Some people deserve to get bit. Both times I got bit (like a real skin breaking blood daring bite) it's because I got in the dogs safe space when it was clearly agitated. The second time the dog repeatedly warned me to back off and I didn't listen so he snapped at me. I don't think he actually meant to bite me so much as to get me out of his space (my own dog and I've seen him give plenty of warning snaps to other dogs so I think that's what it was) but again I was too close and he caught me under the nose and on my forehead.
Bit scary when you realize a dog can get it's jaws around your entire face. But it was definitely my fault and not the dogs. I was in its space, harassing it, when it was clearly upset.

A girl and I were having an argument once, her dog which I had been around since he was a puppy and had practically raised myself was there, she got really mad at me and raised a glass like she was going to hit me with it or something, her dog attacked her.
I have never, and would never train an animal to attack a person, so that was a shock to see her dog take my side, only gave her a small nip in the leg, but enough to draw blood and scare her to death.
We lived together for a few years after that, but she always acted distant from her dog after that. I think because I was around her pooch more than she was, that the dog figured I was its owner. I used to lay on the floor and wrassle with him, when I let him outside to shit I would run under the moon and howl with him like a nut job, I think he thought I was like lord of the dogs or something, so took my back by default.

My parents and I do not accept dogs in any or our apartments/houses. Perfectly legal if it's on the rental contract as a clause. High risk for dmages, piss stains and accidents
