I was driving north to Colorado, when I got pulled over. About fifty miles from the CO border. I was doing 87 in a 75mph zone. Let me first say, that I had a bong in the trunk, and a ten strip that was hidden very well. I normally never speed when I have drugs in the car, but I really wanted to make it to a pot shop before they all closed, so I chose to go 10-15 over the limit in order to get there on time. My car did not smell like weed whatsoever, and like I said, I had no paraphernalia in plain view. Because of that, I honestly didn't feel any more nervous than I would have if I hadn't been carrying. My guy wasn't able to reup before I left, so luckily I was stone cold sober.
The officer initially seemed friendly, although he did tell me he was going to write me a ticket, which I was fine with. I tried to joke around with him, and keep things loose. I told him I was jamming out to my favorite song, and admitted I had made a mistake by not watching my speed. I gave him my ID, but I could not find my proof of insurance or the registration to my vehicle. He told me to look around the car for it, and walked back to his car to run my ID
In my rear view, I saw another police car pull behind the other officer. The officer who pulled me over, walked back to my window, and asked if I would step out of the vehicle. He didn't mention anything about my lack of insurance or title.I kept my cool, and got out of the car without protest. He walked me over to the side of the road...
"Have you ever been arrested before"
"No"
"So you've never been to Idaho?"
"I was actually arrested in Idaho."
"I thought you told me you had never been arrested before...What were you arrested for?"
"Marijuana. It was expunged off my record six years ago...I apologize officer I was not aware that I was legally obligated to tell you that, since it has been expunged"
He then starts walking towards my vehicle, and asks "Would you mind if I looked around your car a little bit?"
"You'll need a warrant for that. You can go ahead and look through the window and go right ahead and smell it too, but I don't consent to for you to search my car. You don't have probable cause to do this to me"
He started grilling me about the last time I had smoked, and I told him it was years ago. The arrest that he saw on my record was six years ago, and like I said it was expunged. Completely ridiculous that I was in that situation. The only reason he pulled me out of the vehicle was because of the arrest over half a decade ago.
He walked back to his car, while the other officer stood there with me. I complained to him that I did not like or understand why I was being treated like this. I told him they had no evidence or any reason to suspect anything, and that I felt like I was being harassed, and even suggested I was being profiled.
The officer came back out of his squad car, and handed me a ticket, and walked me through the usual bullshit, about when the ticket is due and how much I owe.
"So you wouldn't mind waiting around for a little bit, to have a K-9 stop by?"
At this point I was sounding quite defensive, it was simply unavoidable.
"Look officer, my car is full of stuff. I don't have the time for this. Am I under arrest or am I free to leave?"
He gave me a classic cop smirk, like he knew I was lying, and said, "get out of here son"
I have respect for most policemen, and appreciate the work that most of them do. Like anything though, it only takes a select few power hungry assholes to taint their reputation. Guys like this are why a lot of people are losing respect for them. It isn't ideal, at all, that any dumb fuck, can take train for six months at a trade school and walk out with all the power in the world. I don't think any more 'good' people choose to be cops than any other profession. It only takes a few.

Absolutely. Keep your mouth shut, and if necessary get a good lawyer and they do the talking. Last year I got out of a DUI because my lawyer basically got all the evidence thrown out. The judge was cool and acquitted me of the DUI, because he said the criminal offense put a huge burden of proof on the state and they clearly did not meet that burden. He knew I was drunk though. And he convicted me of the summary suspension for refusal to be tested, saying it was a civil offense and the burden of proof on the state was far less. It was expensive, the lawyer and the year with a breathilizer in my car, but I have no DUI on my record so it was a lesson learned.
