Legal (Grammatical?) Interpretation: Letter of the Law vs Practical Application

How is the difference in the way the law reads and how it is applied in practice described?

For example, a speed limit may be clearly posted as 55mph on a highway, but everyone's doing at least 70--and zipping past two cop cars parked side by side, as the officers chat, seemingly oblivious to all the crime in front of their noses.

There's a clear difference in how the law reads, and how its practically applied.

How is this described? Someone told me once, but I forgot. Something like "the law" and "the common understanding of the law" or something like that?

maybe if you speeding an you got a clean record they don't care but maybe you speeding an you don't have a clean record then they care.
