looks like a tomato to me, which is a part of the nightshade family.  I am not sure if thats what you meant cause there are tons of nightshades

actually didn't see the flowers, gotta bite my tongue

The flowers/fruit look like peppers to me, but the leaves don't.  I have a huge bitter nightshade, and your plant there looks nothing like it.

You could call it a nightshade but there's a few plants commonly called that, or variations of that name like Burke demonstrated above.

Your plant is in the genus Solanum and I'd call it Black nightshade, to tag a more specific common name to it.  This one looks very much like S. nigrum, although I don't know your continents plants too well. Leaves are usually edible but not the fruits(Toxic), some species fruits can be eaten though.<<<Research and get second opinions before doing so>>>(disclaimer ftw!)

I'll second karode's opinion. It matches pretty well the Solanum nigrum plants that are common here in Portugal - the fruits will turn very dark purple to black once ripe.

Yes it is A black nightshade plant...aka solanum americanum or solanum nigrum. It does contain traces of tropane alkaloids but you would become poisoned by solanine if you took enough to feel the effects.

Thanks guys!  I've spotted this over the years it pops up in different places around my yard. Weird it came up In my basal.  I'm glad I spotted it before the wife picked a bunch for dinner.  I'm kinda excited.
