High on Pot considered DUI?

My friend wants to know if he should be worried about being caught high on MJ, like, can the cops give him a piss test. I dont like having to drive him places when we smoke, cuz he'll drive himself to school and work, but to smoke, he wants me to drive for this reason.

cops arent dumb, they'll know if your stoned if you show it. they smell your hair and look in your eyes. they asked my friend to open his mouth and stick out his tongue to smell his breath and to see if he had cottonmouth, and indeed he did! just took his pot away, he wasnt driving though. if he was they could've arrested him

In Ky they are in the process of implementing breathalizers that detect any substance(they claim)such as pills and pot. Dont get all whacked and cruise around, your just asking for it.

I've had a really close call driving stoned before. I got pulled over for expired registration about 15 minutes after smoking a bowl and I didn't even have my proof of insurance . Fortunately, my friend had been smoking a cigarette so the cop must not have smelled all the pot we had been smoking. We also stashed our pipes in the glove compartment, but there was still an 1/8 in my friend's jacket. Everything was going okay until he said "you guys need to hold still" then he went to go talk to his partner, then my friend said "hey, maybe it's under the seats." So we do the stupidest fucking thing we could've done and start looking under our seats . He pulls his gun and orders us out of the car and we get searched (somehow they let my friend take off his jacket first ), then I explain that I was just looking for my insurance. The cop asks if he can check for me and before I can say anything my friend says sure, so they search the car, which was really dirty at the time. After the longest couple minutes of my life, they said we could get back in. I don't know what happened, but when we got back in, the pipes were under the passenger seat... After the whole ordeal, I checked my eyes and they were pretty red. I recommend that your friend does not drive around stoned, he probably won't be as lucky as I was yes, driving stoned is considered Driving Under the Influence

If your from the US they could of arrested him for having pot. He should feel lucky they just took it away. I suppose it also depends on what state but they still *could*.

i was accepted into ARD for a dui on marijuana, which means i wasnt convicted, but i have to pay a ton of fines and do a bunch of other bullshit. and during my CRN evalutation(mandatory questions after youve had a conviction/ard acceptance) the lady told me that a joint of marijuana smoked on day one of a month will show up in a blood test 30 days later, and since there is zero tolerance of marijuana, its a dui. so not only can u not drive stoned, u cant drive and smoke marijuana. i was required to take a blood test after they had reason to believe that i was DUI, if i refused, my liscense would be automatically suspended for 1 year, and i could still be charged with DUI. i live in PA btw.

Breathalyzer for detecting pills?
I guess it's not impossible to imagine, but seems unlikely. Definitely not calling bullshit on you, but do you have any further info on this?

If you fail a field sobriety test, then you can be considered driving under the influence. The police know that there are substances that can intoxicate you and not show up on a drug test. So, in theory, you could be prosecuted for being too tired and driving. If you don't look completely sober to the cop, and you can't pass all of his tests, you can be arrested for DUI.

a breathalyzer tests for a percentage of alcohol content contained in the deep tissue of the lung( by product of oxygen exchange) when exhaled the more alcohol in your blood the more it is distributed as an amount measurable in the co2. I can't see this being able to quantify pills , maybe smoke but I don't know how much of a smoked substance is retained by the lung tissues or if THC would be measurable in o2/co2 exchange. If they could they would. Without testing of physical tissue or liquid I don't see how they could get accurate results. ??? I'm sure they are working on something... who knows...

They still need undeniable physical evidence for a conviction. They can lock you up for a night for anything though. A call to a judge can get them a subpoena for a blood test I believe. There's the rub.

There is no way a breathalyzer could detect pills, you can only breathalyze volatile substances

methinks they are bullshitting you not to give you any windows to have a sly smoke.
I doubt they will care if the passenger is baked as long as hes not acting really strange and you aren't acting suspicious or have a suspect looking car.

They are developing machines that can detect drugs in your sweat. They wipe a little bit of skin with a cotten cloth and toss it in the machine which then tells them all the compounds detected in the sweat. I don't know, but would doubt, that the results are quanitative.

I was pretty stoned last night and got pulled over. I had a tail-light out, my lights weren't on dim when I passed him, and I had expired insurance plus a drivers license that the address was old and the cop noticed. After all that, he just gave me 2 warnings, and 1 ticket for the insurance that could be dismissed if we proved insurance. He never mentioned the tail-light out for some reason. I had ClearEyes, and smoked out of a pipe. Maybe the lack of smell and red eyes made him not even think about it.

Yo, I dunno what you all are talking about.
Drug tests prove USE and do not measure IMPAIRMENT like a breathalyzer. A good lawyer can argue that to a judge. The most someone ever encounters while smoking pot in a car is a possession charge and a little bit o'ball breakin'. And yes, it's cool to smoke on the road. Just not in busy places and practicion of common sense is key. Radar detectors help. Here at my college, it's too dangerous to puff in the dorm because of my room assignment, so me and my friend drive off to rural country roads outside the city to get high.
