Can You be Charged With Cultivation Based on Photo Evidence

So say a raid takes place and you have pictures of a grow on your mobile device/camera. This device is seized and taken in as evidence. The data is then pulled from the device and filed as evidence. Is it likely, or even possible, that a new cultivation charge will come out of the woodworks based upon these photos?

I don't think they could determine the species and prove presence of psilocybin through a photograph.

The photos could possibly be admitted at trial, however if a scheduled substance was found growing, there would be little point in using the photos
|
