Legal Questions About Police.

Idk if this is the right forum to post this in but I need some legal advice on what to do about my cop problem.

So today I was walking in a parking lot for a grocery store and I see this cop he looks at me and starts following me in his car. My friend lives in an apartment and I go sit down outside the building looking at the cop following me he has been going in and out of side streets and keeps showing up (its a 5 minute walk from the grocery store so it was obvious he was following me). He pulls over and gets out of the car and says do you live here? I said no sir I love way down that way. He then asks for my exact address and my name and claims me pointing is not descriptive enough for him. I said is there a problem officer? He said people my age have been breaking into cars and he said I look like the type (I was dressed in my rasta grateful dead t shirt I swear to god everytime I wear the thing something like this happens). I told him I'm not doing anything illegal and then asked what legal reasons he has for talking to me. He said he had no legal reasons and that it was a field interview so I asked if I was being detained he said no and then I asked if I was free to go he said I need to talk to you so I just kept asking if I'm free to go and refused to answer anymore questions. He got all pissed and let me go after 5 minutes of him trying to search me and harass me. He was being a serious dick he kept asking for my friend who lives in the apartments name, my name wear I was from, what my age was, what my address was, and why I was there. Luckily the bastard let me go.

Later today I'm by the gas station smoking a black and mild. He happens to pull up (out of all the cops) and gets all upset about me smoking and starts asking for my id and claiming I'm loitering on the gas stations property (even though I know the owner I go there and smoke my black every now and again and not by the pumps there's a bench I like to sit on and drink my soda). I get mad because its the second time he is bothered me over nothing and ask for his badge number and name but this fucker just gets mad and walks back to his car and drives off yelling we're watching you and when you fuck up I will be their. 

So if this fuck keeps messing with me can I sue him or the police department? Luckily I have a iPhone and will record his ass on video next time he tries to troll me. But what can I do, this fucker is bound to get me on some dumb charge if he tries hard enough. I had an 8th of weed on me but luckily I understand my rights enough to keep him from finding anything but I think that made him seriously angry (because its obvious I don't want his ass to search me and I think he knows my rasta t shirt is a sine ive got bud). So if he keeps doing it over and over just doing his "field interview" can I make it stop or get him into trouble? I don't like the idea of this pissed off troll with a loaded handgun trying to find me "fucking up".

Its really pissing me off I was minding my own business going to visit my girlfriend then just going to the same spot I do every day to visit my friend, get a soda and smoke my black. This is america I shouldn't be harassed like this from someone im paying with my tax dollars. Its fucked up honestly I just want to be left alone but this asshole has to mess with me just because ive got a little bit off weed and look like a stoner. Like wtf I wasn't bothering anybody I just got off work and wanted to go get high with my girl and ive got to deal with this guy and from the looks of it ill be dealing with him every time he sees me now. I wasn't even driving today so I would be responsible and not drive around high as fuck :mad: sorry im just kinda pissed about this.

You're a young male with a Grateful Dead shirt. Perfect demographic to harass. Unfortunately it's a lesson a lot of us here had to learn the hard way: you gotta dress better in public, man.

I don't think you'd have a very successful lawsuit against them when they catch you either. The officers on COPS say being nosy is just part of their job.

A grateful dead shirt, or ANYTHING even remotely associated with drugs is reasonable suspicion.

Loitering is loitering even if you know the owner, they didn't think you had an apparent reason to be there so they are allowed to ask why you are sitting or standing there.

You honestly were about ten seconds from being arrested :lol:

He's doing a car burglary investiation and sees you possibly loitering in a drug related shirt at a near by location and matching the description. That gives him reasonable suspicion to temporarily detain you and search your immediate area and person for burglary tools, stolen property, and weapons.

Finds the 8th and you get cited or arrested depending on where you live and how pissed off the arresting officer is.

The law can be very good at taking a normal person on the sidewalk and turning them into a case #

Don't hold in public if you can, dress like a stereotypical middle-class conservative college kid going to church, and be super nice and naive with the police.

No reasonable suspicion, no drugs, great attitude. If they mess with you at that point you can sue for harassment and illegal search and seizure on the grounds of a lack of probable cause. :thumbup:

The police do not need a reason to talk to you and ask you questions, but you are under no obligation to answer them and they can't detain you unless they have reasonable suspicion that you have committed or about to commit a crime.  Sitting on a bench smoking (if you are legal age) is not a crime.

Every time this guy comes up to you, video him.  The police do not like being recorded but you have every right to do so.  If you keep recording him when he comes up to you, he will leave you alone.

I'm just worried he might shoot me or something they have been on the news a lot for killing people over nothing and he seems really angry and has a gun. Who ever gave that cop his gun and bage should be fired immediately. This cop is not right the outher cops are usually plight and respectful  but he was a straight dick. He kept looking at me like he wanted to seriously hurt me or something. Idk if I see him again I will record him I did not see him today because I went out of town with a friend. But fuck I hope he forgot about me by now. Maybe he is a dick to everyone he meets I hope someone else pissed him off more than I did.

Recording him as soon as you see him is a good idea.

You could have handled it better when he came to talk to you - The correct thing to say is "Are you detaining me or am I free to go?"

Unless he says "Yes, I am detaining you", walk away. 

He can ask you questions all day, but you should not entertain any of them.  If he says that he is detaining you, tell him your name and address, and refuse to answer any other questions.  Keep filming and keep asking if you are free to go.

Dress better in public, if you are carrying weed dress like a nerd.  Shirt with a collar will make you invisible to cops.  Consider getting a haircut.

Cell phones are a great thing to use - if you aren't filming him you can be browsing the internet or whatever, it automatically gives you a reason to be sitting anywhere.

EDIT: Do police usually ask anything of the person in the passenger seat?
Once me and my friend got pulled over, for a taillight I believe, the cop was young and Black and actually quite nice, but focused and serious.
I was in the passenger and he asked me if I had an ID. I actually hadn't realized he was talking to Me at first, through the driver window.

I didn't have an ID, so he got my full name and went back to his car to apparently see who the fuck I was.
He come back and let us go.

I must not look like an average joe

Sadly, profiling is part of human nature. We all do it to some degree. I have a step-brother that is a cop. He admitted to me (in private) that they do profile. They focus in on people they think look like shit-bums. They just have to act like they're not actually profiling when they do it. Nor can they ever admit it.

I've always heard that you're not technically required to show ID if you're a passenger in a car and the cop has no reason to suspect you of anything. If you're clean then it's probably just easier to tell the cop who you are and let him be done with it. You could try and refuse but that will probably just cause them to become more belligerent with you. I definitely would not answer any more questions though.

I'm not a cop or a lawyer so take my advice on this with a large grain of salt.

It seems to me that police are asking about passengers a lot more than they used to. Now it's probably less common NOT to get asked for ID as a passenger.

Just don't be such a :underage: you might as well wear a shirt that says "I do drugs". If you're serious about using substances and not being harassed don't carry shit on you and dress like a normal person, not a drugged out hippy :thumbup:

I would definitely NOT recommend doing this. Part of their training is in interrogation and they are not morons. Check your arrogance. And if you get taken to court it's your word against theirs. They will be believed. You will not. Watch this video and rethink your position:

I have, more than once.

I've avoided court in the first place many times by doing things my way.

So, arrogance or not it has worked and I'm not one to believe in luck after one or two times.
