Frankly, this disappoints me. Secret courts are not the American way.


Supreme Court Rejects Appeal on 9-11 Detentions

WASHINGTON ? The Supreme Court refused Monday to consider whether the government properly withheld names and other details about hundreds of foreigners detained in the weeks and months after the Sept. 11 terror attacks.
The high court turned down a request to review the secrecy surrounding detainees, nearly all Arabs or Muslims, who were picked up in the United States after the attacks on the World Trade Center and the Pentagon.

Most of the more than 700 detainees at issue in the case have since been deported. Some picked up after Sept. 11 were charged with crimes, and others were held as material witnesses. Only Zacarias Moussaoui, who was detained before the Sept. 11 attacks, is being prosecuted in the Sept. 11 attacks.

A Washington study center critical of the Bush administration responses after Sept. 11 sued to learn names and other basic information about the detainees. The appeal raised constitutional questions under the First Amendment right to freedom of speech and freedom of the press, and legal questions under the federal Freedom of Information Act.

"The Justice Department is keeping the names secret to cover up its misconduct," said Kate Martin, director of Center for National Security Studies.

"The Justice Department is keeping them secret to cover up the fact that they rounded up innocent Arabs and Muslims instead of suspected terrorists."

Twenty-three news organizations and media groups, including The Associated Press, joined in asking the high court to hear the case.

How Awful: Lawbreakers Deported

The government grabbed people on thin suspicion, then moved to deport detainees who had no demonstrated link to terrorism but who had violated civil immigration laws, lawyers for Martin's Washington-based group argued to the court.

The government sealed immigration records and omitted detainees' names from jail rosters, among other tactics, to make sure that details of hundreds of arrests remained secret, the lawyers said.

The high court's decision not to review the case represents a victory for the Bush administration. Last week, the high court disappointed the administration by taking on a higher-profile terrorism case involving the rights of an American citizen captured on the battlefield in Afghanistan. The Bush administration had argued strongly that it has authority to hold the hese "special interest" detainees from aliens not suspected of terrorism ties.

The case is Center for National Security Studies vs. Justice Department, 03-472.

why act so surprised?...reports like this have been off and on sinse they first detained all these ppl after 9/11.

The only good way I can think of that would allow these people to be detained or interrogated without public knowledge would be if a certain board were set up to ensure that the courts and such were not being abused. I don't think that is the American way, tho.

In some IRA literature I read in a course on terrorism, some leader was asked the purpose of terrorism. He said that the real goal of terrorism is to cause the government (target) to enact such restrictive laws on the public that the public, too, becomes against the government. It's disturbing that this seems to be the effect of 9/11.

I sometimes listen to his show...for the shock value.

I still have not got my Dad to hear it...he's from Saskatchewan (praries therefore serious long range reception at night), and on the AM dial somewhere in the 1500's, at night, is Rush Limbaugh.

I say to my Dad "Dad, it's like, NAZI Germany and their propaganda shows against Jews, except this is for neo-conservatism. YOU HAVE TO HEAR THIS GUY TO BELIEVE IT!!!"

You really do...If you have never heard him luv...check it out. He's guarenteed to have an effect.

I didn't say I've never heard him. I just didn't like his style, even though when I did listen, he was most often right. I guess it's been about 10 years + since the last time.
