Valoum was for emergency tripping situations. I rarely use. Been using kratom for my chronic pain issues. I just can't believe a first offender with a top end lawyer could get 30 days in jail.

I will find out my urine results November 24th and that's about it. Still pleading not guilty. But we shall see. I might be able to do jail time before and after my work days too. God damnit if it stays on my record for life though...

Just tell them you took the Valium and smoked some weed cause you were tripping too hard on LSD and they pretty much cancel eachother out.

Why so long for a piss test? Also if you are a first time offender you can probably get your record expunged after a certain period of time.

Hahaha not so sure that's a good idea. I don't want them to think i was on anyrhing except maybe weed. But if lsd and valium show up on drug test, then I might just have to tell the whole truth and hope for the best. I figured I could get this expunged after awhile. I just hope I can keep my job I have now until then.
If I do have to do any jail time, I will shoot for work release. Living in jail but able to leave for work. Or jail on weekends for awhile

Something that you could do that might help your case is start going to NA meetings or drug counseling. I know it sucks, but it shows the judge that you are trying to rehabilitate yourself. She might go easier on you if you have evidence showing that your trying to be a law abiding citizen. At least, I've seen this advice posted for other people with drug charges.

That was a joke please don't tell them you were on LSD. I highly doubt they'd test for that considering testing for it is expensive and it only stays in your system for a couple days. I bet you could fight all three of them and say you had taken Valium a day or two before and you smoke pot but weren't on it at the time. Please do not say anything about LSD

Yeah I wouldn't even go to your employer just yet either. You are technically innocent right now so jumping the gun and rambling to your boss that you might spend a month in jail is ridiculous.
I'm not sure what your lawyers been telling you but he is obviously trying to scare you or some shit. Sure, you got a shitty dui but it isn't something I've ever seen anyone go to jail for. I have literally seen at least 8 people get drug dui's and not one went to jail. The only time I've seen someone go to jail was when my friends brother crashed his car blacked out into a wall and broke his femur and shit. He also was given work release as well.
I've watched 3 of my friends get etizolam duis and walk away with nothing. (not sure why they don't test for it). 1 friend got dui on xanax and got fines only. I have 2 friends who got weed dui's but they were caught in the act.
Basically what I said before is crucial, What did you tell the cops at the initial scene? As previous poster said you can have THC/Valium leftover in your system from days before. Doesn't mean you were high on them at the time of the accident.
also don't do any more drugs. You will almost certainly get a drug test after your court appearance and that will guide the judge in deciding if you just made or a mistake or are a serious problem...
trust me on that one.

Why would my lawyer be trying to scare me like this? Cops didn't know shit except I failed the sobriety test miserably which led to the drug test.
I was so surprised when jail time was mentioned too... I'd be cool with community service and fines, but jail time PLUS this shit on my record... hopefully I can get it expunged eventually or not even get the ovi. I wouldn't tell my boss. If I do have to go to jail for that long, then I would hope they have the decency to at least let me do work release, as in I leave jail only for work...
Hard to say still. And I'm pretty sure my lawyer is dead serious. This judge I got is pretty unlucky. She normally does 30 days in jail for any dui. But this past year "she's lightened up her policy a bit." Let's hope I'm apart of her new attitude cuz that's fucked up man.
Well I will know for sure Nov 24th what urine results were and what they want to use against me. I'm still sitting outside courtroom and letting my lawyer do his thing. Fingers crossed. At least I didn't have any drugs in my car haha. I'll keep you guys posted if you care to hear

I got a DUI last summer and a paraphinalia charge in Virginia, which apparently has the harshest DUI sentences. They gave me 240 days all together, all suspended for good behavior, 1100$ in fines, 10 week asap class that costs 400$, and 12 month suspension of my license they really fucked me.
I had already did 30 days in jail too, everyone told me the same shit, 1st offense will get you hardly any time but I guess Virginia just sucks. I was parked asleep in my car when they got me too...

So you got 240 days in jail the second offense? First offense was 30 days in jail if I understood ccorrectly? Yeah you really got fucked. Sorry man. How is all this effecting you now? Still on record? Chance of getting your ovi expunged? What kind of work can you do to make a living? I think if I can't ever get this shit expunged, I'm opening a business or some shit. Nah man 1st offense. I stayed in jail for 30 days when I got arrested , didn't post bail so when I did goto court figured I'd be done with it, time served ya know. Nope, got fucked by the judge, had a public pretender tho cuz I figured wouldn't be too serious, in retrospect shoulda hired someone.
I work at a bar right now, and help my dad with his SEO business. I have worse things on my record so not really worried too much about the DUI.

Dude it's going to be on your record if you are convicted your not underage so the only thing you can hope for is to get diversion program. I'm saying your lawyer maybe trying to scare you because they do that. They tell you the absolute worse case scenario so you don't feel bad about dropping 5,000$ on their services.
You would be infinitely more fucked if you were drunk. I'm pretty sure you will get suspended license and possible drug counseling. Given that you hit somebody it does play a big part in getting off and not. You failed a sobriety test and you were driving. If you would have just gotten caught on your own accord it wouldn't be as tricky but hitting someone even a mild fender bender can be the difference between dropped charges and fines.

Recently was convicted. First EVER offense. Paid 18k for a lawyer. Still spent 4 months in jail. still have 8-10 months hanging over my head and I'm on 3 years of DOC probation. It is a felony conviction and will stay on my record forever. While I was incarcerated for those 4 months my Father was diagnosed with stage 4 Leukemia of the bone marrow and had to leave his job at Boeing to spend 100 days minimum in the cancer care hospital. This was his 3rd cancer battle in 5 years and we thought we were going to lose him. All of this was hard. Especially not being able to participate in it aside from a once a week visit 'behind the glass'. My purpose of telling you this is not to scare you but to give you hope. Hard times come and hard times go. Circumstances seem overwhelming sometimes but it all works out. If things can turn bad quickly, then they can turn good just as quickly. I am still under one month out of Jail and have been hired in a high level position at a car dealership. My father is recovering, miraculously, and has been in remission for about 40 days now. My probation officer is the most lenient and understanding person i've ever met. The list goes on! Do not worry, it will work out, even if you have to serve time. Good luck and I hope you had an awesome trip on that "surprise LSD" lol

I think you're pretty spot on. I would think if convicted, I could get it expunged eventually... idk. I would be very surprised if I did jail time nor do I think it's that necessary. Sure I fucked up, but give me my one break. No one got hurt aND I am overall good and contributing citizen. I'll be kinda pissed at my lawyer if he doesn't pull through.
Main thing is to get an ovi conviction off my record if I get one. And to not let my job find out. We shall see my friends. I know I'm stressing but this is a good way to let loose and express how I'm feeling.Quote:

Holy shit man 18k and 4 months in jail? Damn that's crazy. But cheers to you for keeping a strong and positive attitude. I'm glad things are working out now and your father is doing better. Keep your loved ones close.
