seriouos question,
if i had the knowledge and enough income to get the equipment / reagents i need, is there anything illegal about genetically modifying things in my apartment? this has nothing to do with illegal drugs btw

As long as none of the reagents are restricted chemicals and you weren't posing a risk to the public it should be legal.
Surprisingly the US has been slow to enact restrictions against the "DIYbio movement"
Germany and several other places have bans and the FBI has been involved according to wikipedia (if you believe the source).

Nah, the worst thing would probably be Agrobacterium tumefaciens, which is a plant pathogen.
Honestly, all that stuff is pretty innocuous.
I got caught here with worse and the police didn't seem to care that much

Yeah you are fine, they wont even know what it is and even if they did you aren't creating bio or chemical weapons or narcotics. All the government seems to care about is drugs and the military.
There are even private-party labs that are open to the public (all charity based). You find one in your area, register, and they let you use the equipment as long as it is not used to make weapons or drugs 
Biology and genetic engineering are becoming more common outside of a institutionalized setting with the knowledge and technology becoming more available. Many people also wish to work independently from their professional setting but do not have the lab to do so, hence the "community labs" started arising.

if I can do stuff there i don't need to wait until i move
which is good because i don't want to rush it. i can always stay in a hotel or something in the meantime
it's a bit of a hike to sunnyvale, but if it were for a whole day or weekend that's fine

No problem! People with the skills to innovate shouldn't be bottlenecked by lack of resources or red-tape. It is a waste and completely absurd, think about all we learnt from people like shulgin and what void would exist if they did not have a privately owned lab.
Good luck with everything and be careful out there, lots of superstitious folks out there that love to hunt down and ostracize scientists who aren't working on a plantation for mongers.

Yes, it's legal to modify DNA.
I think there are some kind of restrictions on releasing the organisms, but I am not sure that it is a criminal thing. FDA stuff.....
There are a lot of biohacker spaces in the USA where the general public can show up and make GMO's. Here are some pics of mine:

I have been told that I can modify whatever I want, but when I am done with it I should wash everything in bleach, and that the GMO's shouldn't leave the lab. Not sure if that is criminal law or FDA regulation or neither or both.

i hadn't even worked out the logistics
maybe if were were to get the goods/cash exchange out of the way before it makes it into nature, or cell
once it's in a journal like that authorities tend to notice it more

Then we go corporate and sell teacup catdogs and different flavors of catdog for our eastern friends
