Police Just ILLEGALLY Searched My Home...Can I sue?

So the phones and internet have been out here, and I couldn't remember the telephone company number here, so i speed dialed 911 accidentally, then hung up a second later. I meant to speed dial the telephone company
An officer showed up 10 minutes later saying someone called 911. I explained it was an accident and I was just trying to call the telephone company to see what was going on
He asked if he could search my apartment and I said "I don't consent to any searches". He said he wanted to search to make sure no one was dying in my apartment. I said once again "I don't consent to any searches". He continued to ask if anyone else was home and I just shook my head no.
He then told me he would get a warrant and bust my door down, and I said ok go ahead and closed my door.
Then 5 officers showed up at my door 2 minutes later, frisked me, detained me, and illegally searched my entire apartment.
Can I sue these fuck heads or will they win in court with probable cause?
Officer also called me a "god damn idiot" for not letting him search, and told me I would likely be charged with obstructing justice or something along those lines.

talk to a lawyer but I think they might be able to bypass the warrant if they believe someone's in imidiate danger inside. But they had no reason to believe that by the sound of things

How did they detain you if your door was closed, are you saying they kicked it down....totally without a warrant, and with no probable cause or reasonable suspicion to do so.
you're full of shit, and 5 cops responded two minutes and all of this was over a 2 second accidental 911 call where no words were said...come the fuck on.

I was outside on the porch talking to them. They told me to put my hands laced above my head and turn around, they searched me, entered my home and searched it.
The door was unlocked. Was in the middle of cleaning when they showed up and didn't have keys on me and didn't think to lock it
Why would I make it up? He called them after I told him to get a search warrant

Cops here are really hungry. They do nothing but sit around busting people for going 65 in a 55 zone on an open highway, and busting college kids for weed/ being drunk on part nights
They're bored.
It didn't even ring so it surprised me that they showed up. No one called me back either.
It could have been because the phones lines were out since this morning up until about an hour ago.
I hung up within 2 seconds.

They had probable cause. They were under the impression you were holding someone against there will and they managed to grab the phone and dial 911 but you hung it up. The police are trained to think in the worst case scenario. That's all that will be said in court and the judge will usher you on your way. If you really wanna know just call a lawyer and explain exactly what happened. I bet they say exactly what I say.

someone hitting 911 by accident isn't probable cause in the slightest, unless a voice said "help" before the hangup, they would need reasonable suspicion that someones life might be in danger for them to enter without permission and "I don't consent to searches" doesn't give that to them....I'm not gonna keep going with this thread through, best of luck OP, I just can't buy it.
Probable cause means they have some kind of evidence. They saw or heard something, smell it, something along those lines.
Reasonable suspicion means they have a lot/at least some indicators suggesting there is something else going on, one quick 911 ring and hang up isn't that. For example, someone else calling and saying they might of saw someone being forced into the home, and gave a description of the person doing it that matches what OP was wearing/skin color/gender
They had suspicion, not reasonable suspicion, and that wouldn't be enough. OP could of been trembling in fear when they showed up, that is also not a reason, you're allowed to act however you want, even if it comes off as suspicious.

No when you accidently call 911 you ride that shit out wait till they answer say shit I seriously miss dialed and they let you go. Hanging up immediately is suspicious as fuck. And the police call log starts the second you finish the last 1 there is no waiting for them to answer they immediately know you dialled 911.

You don't know how the law works, sorry to tell you, the amount of reasons OP could of called is endless, they're minds can jump to worst case scenario, there actions can not without good reason, and this is not good reason. They can't assume, and than act on that assumption, they need cause, evidence, REASONABLE suspicion, not suspicion alone.

Your an idiot for not staying on the phone and telling them you accidently called them. If they get called and it automatically hangs up they think that's a distress symbol, these "fucking pigs" were doing there job.
What they thought might have been happening was totally plausible and if you had of let them in your house they would have just checked around not searched for drugs. Plus you should never keep your illegal drugs out in the open.
You will be wasting your time and money if you sue them because they had probable cause. If they had of found drugs they couldn't arrest you because it wouldn't of held up in court because that's not what they were searching for, that would be an illegal search and seizure.

They didn't. The 911 call didn't even ring in. If they bring up the logs it was less than 2 seconds before i hung up. I didn't even think it went through
Why would I consent to a search after explaining to them that it was an accident and they know the phone lines have been down?
Just because some jackass believes someone is bleeding to death or whatever based on a 1 second phone call where no one said anything and didn't even fucking ring in doesn't mean they have the right to search my residence.
They fucked up telling me they'd get a warrant, then illegally searching without a warrant. I'll be putting these shitheads into the ground .
Just talked to my lawyer and he says we've def got a case.

Calling and hanging up can be and I'm sure has been a distress symbol. Someone breaks into your house, your calling 911, but he/she puts a gun to your head forces you to hang up almost immediately. He/she ties you up and duck tapes your mouth, answers door when cops come and says they cant come into the house to check if anyone is in DISTRESS, they just say ok, leave, and you die.

An officer showed up 10 minutes later saying someone called 911. I explained it was an accident and I was just trying to call the telephone company to see what was going on
He asked if he could search my apartment and I said "I don't consent to any searches". He said he wanted to search to make sure no one was dying in my apartment. I said once again "I don't consent to any searches". He continued to ask if anyone else was home and I just shook my head no.
He then told me he would get a warrant and bust my door down, and I said ok go ahead and closed my door.
Then 5 officers showed up at my door 2 minutes later, frisked me, detained me, and illegally searched my entire apartment.
Can I sue these fuck heads or will they win in court with probable cause?
Officer also called me a "god damn idiot" for not letting him search, and told me I would likely be charged with obstructing justice or something along those lines.

If this really happened, I'm pretty sure it's standard practice in most places for them to call back. This case (where they did call back and the call was unanswered) is somewhat similar though:

Idk zappa I got 4 felonies over turned by my state supreme court because an officer was called to my home for a welfare check on a previous tenant. When no one answered the door because no one was home he opened my door to make sure no one was dead and saw a bong. I was even so dumb to consent to a search after they told me they saw everything and I thought I was fucked. But the court ruled he had no right to open my door because it wasn't an emergency and all the evidence that was collected from the warrant they got based on what he saw was dismissed due to being tainted by the poisonous fruits of the illegal entry I think is how they worded it.
Now having sail all that I read the op and no other comments so if I missed something Iapologize.

I think the idea that police can be allowed to act because they "think" something might be wrong is a dangerous mindset, it could be useful on some situations, but easily exploited and an easy scapegoat for almost anything

Me too, but what if RanOutOfWeed had just beat someone and they ran to the phone and tried to call the police, that was their only chance of survival. What if that person were you, what if it was someone you care greatly for, then the cops showed up and rescued yourself, or loved one.
I think a situation like this is a slippery slope, why I agree with you SirShroomsAlot, I must say I understand where the police are coming from. I definitely think many police abuse their authority, but I don't think that being a member of this site automatically puts me against every police officer out there.
I had my home broken into a few years ago, and actually needed the police, and they were very nice. I have also had my life just about ruined by the police who abused their authority, so this is a hard one for me.
I don't think it's going to teach them anything by continually allowing them to violate peoples rights, and yes people need to stand up for their rights, but what if the situation were real.
Also he's in an apartment, I thought there was something you sign that states they can enter your apartment because it's not technically his, maybe I am wrong though but I could swear I remember reading that a few years ago when I was getting an apartment, at least it was that way in the state I was in then.

Speed dial.
Couldn't find the phone book anywhere and our speed dial has 911, telephone company, and some friends. 1 and 2 are cop/ tel company
couldn't remember which was which and phone lines were down from 7am to around 3pm so couldn't look up number
wanted to call tel company to see what was going on. Could dial out to some places but not others.

I have done it more than that. I call them to report alarms all the time. In fact I made a call to them and when i hung up I picked up the phone again it hadn't disconnected and I guess the operator hadn't hung up either. When I said "hello?" they freaked and sent a cop. They don't usually come in they pull up outside and I go out and chat. A potential domestic they will enter. There is no jurisdiction anywhere in North America you can hangup on 9-11 and then refuse them entry from your porch. You called 9-11 don't pull this rights bullshit. Your wife could be bleeding on the floor and they have the duty to check that. If they walked away and she died there would be hell to pay. If you accidentally called 9-11 let them in and check and it will all be over in 10 minutes. It's your fault it happened anyway, don't be acting like the cops are fucking you over.
