Then your analogy is idiotic.  You are also almost certainly incorrect that the search was illegal.  If it was an improper search than any evidence found would be tossed in court.  Good thing you ran out of weed.

I would bend over and take this one up that ass, sorry man.

I mean I guess I understand why they did what they did, there could have been a person you just bludgeoned with a blunt object trying desperately to escape, so I see why they were so forceful in their actions.

I hate to say it, but I wouldn't pursue this one RanOutOfweed.

Just lay low, don't act all gung ho, next thing you're going to get harassed by the police, trust me you don't want that, I speak from experience.

But the balls in your court, do as thou wilt.

I think the idea that police can be allowed to act because they "think" something might be wrong is a dangerous mindset, it could be useful on some situations, but easily exploited and an easy scapegoat for almost anything

Some kind of evidence/very reasonable suspicion or gtfo

yeah, but we ARE talking about a 911 call hangup.  think of the legal liability to the dept if they just said "ok, sorry to bother you" and this guy actually did have someone hobbled to a bed Misery style?

Again.  If they find something with an improper search it won't be admissable.  But the chances of getting damages are infinitesimal.  Especially if you weren't actually arrested.

I guess I would have to know the statistics for how much that actually happens compared to just being an accident to know whether it was worth violating everyone

Edit: saw your comment right after I replied Zappa, you do have a point but it's not like the cops in that town would forget what was found and who you are, I'm jus wary of authority

Me too, but what if RanOutOfWeed had just beat someone and they ran to the phone and tried to call the police, that was their only chance of survival.  What if that person were you, what if it was someone you care greatly for, then the cops showed up and rescued yourself, or loved one.

I think a situation like this is a slippery slope, why I agree with you SirShroomsAlot, I must say I understand where the police are coming from.  I definitely think many police abuse their authority, but I don't think that being a member of this site automatically puts me against every police officer out there.

I had my home broken into a few years ago, and actually needed the police, and they were very nice.  I have also had my life just about ruined by the police who abused their authority, so this is a hard one for me.

I don't think it's going to teach them anything by continually allowing them to violate peoples rights, and yes people need to stand up for their rights, but what if the situation were real.

Also he's in an apartment, I thought there was something you sign that states they can enter your apartment because it's not technically his, maybe I am wrong though but I could swear I remember reading that a few years ago when I was getting an apartment, at least it was that way in the state I was in then.

Man, I have for my whole life kept my mouth shut and my head down and my lights in working order and I do anything I want.  I also have never misdialed 911.  That's just fucking stupid.

There are other reasons that I didn't consent to search, but I won't say them on here cuz I don't know who's reading.

Alright then, picture this if you will:
10 to 2 AM, X, Yogi DMT, and a box of Krispy Kremes, in my "need to know" post, just outside of Area 51.
Contemplating the whole "chosen people" thing with just a flaming stealth banana split the sky like one would hope but never really expect to see in a place like this.
Cutting right angle donuts on a dime and stopping right at my Birkenstocks, and me yelping...
Holy fucking shit!

I really don't see how you could accidently call 911...

I've never heard of anyone being detained and having their place searched because of a misdial either though. I suppose anything is possible.

Just be glad you weren't shot OP

Speed dial.

Couldn't find the phone book anywhere and our speed dial has 911, telephone company, and some friends. 1 and 2 are cop/ tel company

couldn't remember which was which and phone lines were down from 7am to around 3pm so couldn't look up number

wanted to call tel company to see what was going on. Could dial out to some places but not others.

They don't automatically send an officer without trying to get back in touch with you considering they know what number and apparently the address from which it was called and than have 5 cops swarm for no reason other than saying you can't search. That's just unrealistic.

I gaurantee it, everyone in this thread call 911, let it ring for a second and hang up....GUARANTEED you get an instant call back asking if everything is okay and that will be the end of it.

No you are wrong. I have called 9-11 by accident many times and they always send a cop. You can't talk your way out of it.

someone hitting 911 by accident isn't probable cause in the slightest, unless a voice said "help" before the hangup, .

Stop giving advice. A 911 hangup is probable cause to kick your door down when no one answers. They have to attend every single 9-11 hangup call. You have heard of domestic violence right? When the police don't attend a 9-11 hangup and some woman's partner kills her it is big fucking news and everyone asks why they didn't attend. While finding drugs during the search may not hold up in court, it's not illegal for them to enter a house where they fear someone inside may be in distress. OP gave them reason to believe this.
I don't believe you called 9-11 and they just said "ok cool".

How the fuck does someone miss call the police 5 times in there life? How many three number phone numbers begin with 9? I can believe an unwarranted search but I can't believe someones stupid enough to call the police 5 times by accident.

I have done it more than that. I call them to report alarms all the time. In fact I made a call to them and when i hung up I picked up the phone again it hadn't disconnected and I guess the operator hadn't hung up either. When I said "hello?" they freaked and sent a cop. They don't usually come in they pull up outside and I go out and chat. A potential domestic they will enter.
There is no jurisdiction anywhere in North America you can hangup on 9-11 and then refuse them entry from your porch. You called 9-11 don't pull this rights bullshit. Your wife could be bleeding on the floor and they have the duty to check that. If they walked away and she died there would be hell to pay. If you accidentally called 9-11 let them in and check and it will all be over in 10 minutes. It's your fault it happened anyway, don't be acting like the cops are fucking you over.
