if only u could go back in time, and call 911 right before the cops showed up tto say "sorry, i misdialed 911, i was trying to call the phone company".

That way, u have a record of what happened as the cops showed up.

But since u didnt call back, now it looks suspicious.

You should realize that 911 has no ring. Its instant, cause ya know, in emergencies, every second counts.

Well, now you know that 911 calls are instant and have no ringing wait time, for next time

Read this: http://www.varnumlaw.com/blogs/western-michigan-federal-courts/warrantless-entry-allowed-in-response-to-911-call-where-there-is-evidence-o/

Quote:

The Strickers filed a complaint alleging that the police violated the Strickers' Fourth Amendment right by illegally entering their house and illegally searching their premises. The Sixth Circuit affirmed the district court's dismissal of the case, concluding that the police had an objectively reasonable belief that an exigent circumstance existed—i.e., a medical emergency—for the police to enter.  The Sixth Circuit also agreed that the police had the right to perform a protective sweep for individuals and a search of the bedroom and drawers for clues as to what Andrew ingested in order to aid in his treatment.

Bullshit.  On every cellphone I have ever had it is voicemail.

Why the fuck do you need to put a 3 digit number on speed dial?

Quote:

Permitting officers to enter a residence to render immediate aid was upheld by the U.S. Supreme Court with the comment, “numerous state and federal cases have recognized that the Fourth Amendment does not bar police officers from making warrantless entries and searches when they reasonably believe that a person within is in need of immediate aid.” A “warrantless entry by criminal enforcement officials may be legal when there is compelling need for official action and no time to secure a warrant.” The reason given for allowing these entries is that the police are acting to assist the person in need rather then make an arrest or collect evidence. [7]

In order for the warrantless, consentless, entry and search to be legal, the officer must “reasonably believe” a emergency situation requiring immediate police intervention exists.

So the phones and internet have been out here, and I couldn't remember the telephone company number here, so i speed dialed 911 accidentally, then hung up a second later. I meant to speed dial the telephone company

An officer showed up 10 minutes later saying someone called 911. I explained it was an accident and I was just trying to call the telephone company to see what was going on

He asked if he could search my apartment and I said "I don't consent to any searches". He said he wanted to search to make sure no one was dying in my apartment. I said once again "I don't consent to any searches". He continued to ask if anyone else was home and I just shook my head no.

He then told me he would get a warrant and bust my door down, and I said ok go ahead and closed my door.

Then 5 officers showed up at my door 2 minutes later, frisked me, detained me, and illegally searched my entire apartment.

Can I sue these fuck heads or will they win in court with probable cause?:mad2:

Officer also called me a "god damn idiot" for not letting him search, and told me I would likely be charged with obstructing justice or something along those lines.

My LG has it as speed dial #1. It is hard coded and can't be changed.

Just double checked in the manual. #9 is the 911 speed dial and #1 is the voicemail.

Hard coded, unchangable.

According to that, they need hard probable cause (noises, sounds, smells, etc) to enter the home without a warrant. They had NOTHING aside from me exercising my rights and a 2 second 911 call that no one said anything.

Ummmm, no.

According to that

Define reasonably. Not to my satisfaction, to the courts.

I think you have a good case for the sole reason that the 911 operator DID NOT CALL YOU BACK.

U should get a lawyer, you have a good case on your hands
